About this file
This is a Purchasing Affidavit form required by the State of West Virginia for vendor participation in state and local contract opportunities. Under W. Va. Code 5A-3-10a, the affidavit mandates that no contract or renewal of any contract may be awarded to any vendor or prospective vendor when the vendor or a related party owes a debt greater than one thousand dollars in the aggregate or is in employer default. The form requires the vendor's authorized signatory to affirm under penalty of law that neither the vendor nor any related party owes such debt or is in employer default, unless the debt or default qualifies for an exception such as a contested tax matter or an approved payment plan in good standing.
The affidavit defines key terms including "debt" as any assessment, premium, penalty, fine, tax, or other amount of money owed to the state or its political subdivisions that is delinquent or due, and "employer default" as an outstanding balance to workers' compensation funds, policy default, failure to maintain mandatory workers' compensation coverage, or failure to meet obligations as a self-insured employer. The form also defines "related party" as any individual, corporation, partnership, or other entity related to the vendor through blood, marriage, ownership, or contract that receives or controls a benefit, profit, or consideration of five percent or more of the total contract amount. The affidavit must be notarized and signed by the vendor's authorized representative, with the specific RFQ number ARFQ HOP15 4 referenced on the completed form.

PURCHASING AFFIDAVIT
MANDATE: Under W. Va. Code §5A-3-10a, no contract or renewal of any contract may be awarded by the state or any of its political subdivisions to any vendor or prospective vendor when the vendor or prospective vendor or a related party to the vendor or prospective vendor is a debtor and: (1) the debt owed is an amount greater than one thousand dollars in the aggregate; or (2) the debtor is in employer default.
EXCEPTION: The prohibition listed above does not apply where a vendor has contested any tax administered pursuant to chapter eleven of the W. Va.
