RATINGS

Please assess each of the five (5) following areas with a rating that is based on objective measurable performance indicators to the maximum extent possible. Commentary to support the rating for the element assessed is requested where indicated at the end of each section.

Assign each a rating among the choices of Exceptional, Very Good, Satisfactory, Marginal, or Unsatisfactory. Use the attached Rating Guidelines as guidance in making these evaluations. Insert the appropriate rating.

QUALITY OF SERVICE: Rating: _______________________________ Assess the Contractor's conformance to contract/order requirements, specifications and standards of good workmanship (e.g., commonly accepted technical, professional, environmental, or safety and health standards) considering aspects such as:

· Compliance with contract requirements,

· Accuracy of reports,

· Level of knowledge, experience, and training of personnel,

· Capability of personnel to perform required services,

· Effectiveness of personnel in performing required services, and

· Overall quality of service

SUPPORTING COMMENTS:

COST CONTROL: Rating: _______________________________ Assess the Contractor's effectiveness in forecasting, managing, and controlling contract/order cost considering aspects such as:

· Current, accurate and complete billings,

· Relationship of price negotiated at initial contract/order award to final/ current modified contract/order price/value, and

· Cost efficiencies:

SUPPORTING COMMENTS:

SCHEDULE / TIMELINESS OF PERFORMANCE: Rating: _________________________ Assess the timeliness of the Contractor against the completion of the contract, TOs, milestones, delivery schedules, and administrative requirements (e.g., efforts that contribute to or effect the schedule variance). This assessment of adherence to the required delivery schedule should include the Contractor's efforts during the performance period evaluated that contributes to or effects the schedule variance. This applies to contract/order closeout activities as well as contract performance. Instances of adverse actions such as the assessment of liquidated damages, or issuance of Cure Notices, Show Cause Notices, and Delinquency Notices are indicators of problems which may have resulted in variance to the contract/order schedule and should therefore be noted in the evaluation.

SUPPORTING COMMENTS:

BUSINESS RELATIONS: Rating: _________________________ Assess the integration and coordination of all activity needed to execute the contract/order, specifically the timeliness, completeness and quality of problem identification, corrective action plans, proposal submittals, the Contractor's history of reasonable and cooperative behavior (to include timely identification of issues in controversy), customer satisfaction, timely award and management of subcontracts considering aspects such as:

· Contractor oriented toward the customer,

· Effective management, excluding subcontracts,

· Satisfaction with interaction between the Contractor and the Government,

· Responsive to contract requirements,

· Notification of problems,

· Flexibility,

· Pro-active vs. reactive,

· Adequacy of the Contractor's management of Government Property (GFP) if a substantial amount of GFP has been provided to the Contractor under the contract/order,

· Timeliness of awards to subcontractors and management of subcontractors, including subcontract costs. Consider efforts taken to ensure early identification of subcontract problems and the timely application of corporate resources to preclude subcontract problems from impacting overall prime Contractor performance, and

· Prime Contractor's effort devoted to managing subcontracts where subcontractors were an integral part of the Contractor's team:

MANAGEMENT OF KEY PERSONNEL: Rating: _________________________ Assess the Contractor's performance in selecting, retaining, supporting, and replacing, when necessary, key personnel. Assess the Contractor’s match of the qualifications of the key position, as described in the contract/order, with the person who filled the key position.

Rating

Exceptional
Performance meets contractual requirements and exceeds many to the Government’s benefit. The contractual performance of the area being assessed was accomplished with few minor problems for which corrective actions taken by the contractor were highly effective.

There are multiple significant events identified relating to the area being assessed with detail as to how they were of benefit to the Government. A singular benefit, however, could be of such magnitude that it alone constitutes an Exceptional rating. Also, there have been no significant weaknesses identified.

Very Good
Performance under the area being assessed meets contractual requirements and exceeds some to the Government’s benefit. The contractual performance of the area being assessed was accomplished with some minor problems for which corrective actions taken by the contractor was effective.

There is a significant event identified relating to the area being assessed with detail as to how it was a benefit to the Government. There have been no significant weaknesses identified.

Satisfactory
Performance under the element being assessed meets contractual requirements. The contractual performance of the element or sub-element contains some minor problems for which corrective actions taken by the contractor appear or were satisfactory.

For the element being assessed, there have been only minor problems, or major problems the contractor recovered from without impact to the contract/order. There have been NO significant weaknesses related to the element being assessed. The contractor has not been assessed a rating lower than Satisfactory solely for not performing beyond the requirements of the contract/order.

Marginal
Performance under the element being assessed does not meet some contractual requirements. The contractual performance of the element or sub-element being assessed reflects a serious problem for which the contractor has not yet identified corrective actions. The contractor’s proposed actions appear only marginally effective or were not fully implemented.

For the element being assessed, a significant event has been identified in each category that the contractor had trouble overcoming and details provided as to how it impacted the Government. A reference to the management tool that notified the contractor of the contractual deficiency (e.g., management, quality, safety, or environmental deficiency report or letter) should also be provided.

Unsatisfactory
Performance does not meet most contractual requirements and recovery is not likely in a timely manner. The contractual performance of the element or sub-element contains a serious problem(s) for which the contractor’s corrective actions appear or were ineffective.

For the element being assessed as, multiple significant events have been identified in each category that the contractor had trouble overcoming and details provided as to how it impacted the Government. A singular problem, however, could be of such serious magnitude that it alone constitutes an unsatisfactory rating. A reference to the management tools used to notify the contractor of the contractual deficiencies (e.g., management, quality, safety, or environmental deficiency reports, or letters) should also be provided.

ATTACHMENT J-10 -- POST-AWARD INSTRUCTIONS REGARDING SECURITY REQUIREMENTS FOR NON-CLASSIFIED CONTRACTS/TASK ORDERS

1. The procedures outlined below shall be followed for the DHS Office of the Chief Security Officer (OCSO), Personnel Security Division (PSD) to process background investigations, Entry on Duty determinations, and Fitness determinations, as required, in a timely and efficient manner.

2. Carefully read the security clauses in the contract. Compliance with the security clauses in the contract is not optional.

3. Contractor employees (to include applicants, temporaries, part-time and replacement employees) under the contract, requiring access to sensitive information, shall undergo a position-sensitivity analysis based on the duties each individual will perform on the contract. The results of the position sensitivity analysis shall identify the appropriate background investigation to be conducted. All background investigations will be processed through the DHS OCSO/PSD. Prospective contractor employees shall submit the below completed forms to the DHS OCSO/PSD. The Standard Form (SF) 85-P must be completed electronically through the Office of Personnel Management’s e-QIP SYSTEM. The SF-85Psignature pages and other completed forms must be given to the OSCO/PSD no less than thirty (30) days before the start date of the contract or thirty (30) days prior to the requested entry on duty date, for all contractor employees whether a replacement, addition, subcontractor employee, or vendor:

Only complete packages will be accepted by the DHS OCSO/PSD. Specific instructions on submission of packages will be provided upon award of the contract.

4. The DHS OCSO/PSD may, as it deems appropriate, authorize and grant a favorable Entry on Duty (EOD) decision based on preliminary checks. A favorable EOD decision allows a contractor employee to commence work temporarily prior to the completion of the full background investigation. The granting of a favorable EOD decision shall not be considered as assurance that a favorable Fitness determination will follow. In addition, a favorable EOD or Fitness determination shall in no way prevent, preclude, or bar DHS from withdrawing or terminating access to government facilities or information, at any time during the term of the contract. No employee of the Contractor shall be allowed unescorted access to a Government facility without a favorable EOD or Fitness determination by the DHSOCSO/PSD.

Limited access to Government buildings is allowable without an EOD decision if the Contractor is escorted by a Government employee and the purpose of the visit is to attend a limited number of required briefings or nonrecurring meetings in order to facilitate the transition of a contract The intent of this statement is to allow a minimum amount of meeting / transition attendances to prepare for the new contract.

5. The DHS OCSO/PSD shall be notified of all terminations/resignations within five (5) days of occurrence. The Contractor shall return to the Contracting Officer’s Technical Representative (COTR) all DHS issued identification cards and building passes that have either expired or have been collected from terminated employees. If an identification card or building pass is not available to be returned, a report shall be submitted to the COTR, referencing the pass or card number, name of individual to whom it was issued and the last known location and disposition of the pass or card.

Contractors who fail to comply with Department security policy are subject to having their access to Department IT systems and facilities terminated, whether or not the failure results in criminal prosecution.
