QUESTIONS AND ANSWERS
SOLICITATION P16PS01390, AMENDMENT 0004 (UPDATED AMENDMENT 0005)
1. What is the material type to be used by CLIN 15?
Use Briar Hill Sandstone as the basis for design.
2. What is the size to be used for CLIN 16? Per stone? Per CF? As is, it is very vague.
The unit of measure is per each stone repair.
3. Sheet 9 of 53 shows a 23” caliper tree to remain in the northeast corner of the staging area. Removal of the ex-waterline and stone monument as well as installation of the 1” waterline with 2” steel sleeve, 6” PVC storm line and brick walk could cause enough damage to severely impact the tree. Can this tree be removed as well?
It is the intent of NPS to save this tree. Contractor shall protect the existing tree in accordance with specification Section 311000 – Site Clearing, Section 3.1
PROTECTION AND RESTORATION.
4. Section 1 shown on sheet S302 shows the 10” Concrete Foundation Mat. Is this the area that receives the stamped and colored concrete finish? Please detail all locations this treatment is required.
Extents of stamped and color finish are shown on S314. Stamp and color finish is to be located between the lock walls.
5. Section 061900 – Timber Miter Gates. 1.1 A - Please confirm last sentence is correct.
The last sentence is correct.
6. Lock 3, Sheet S310, Section 3 – Please provide bottom of footing elevations and offset dimensions from the existing concrete curb for the Cast in Place Retaining wall.
From Lock 3, Sheet S103, offset dimension from the existing concrete curb is approx. 5 feet. Based on slope and existing ground elevations from Lock 3, Sheet C110, bottom of footing elevation is approx. 26.5 (at min. depth). All elevations shall be field verified based on finished ground elevations.
7. Lock 3, Sheet C104 – Please confirm sediment and existing vegetation located in the “Construction Staging & Storage” area is to be removed. Please indicate which pay item this is to be priced under.
The existing vegetation/grass area proposed for construction staging and storage does not require the removal of the grass; however, the contractor is required to restore the staging area back to its original condition. During construction, the typical section located on sheet C301 can be placed on the existing grass area. Staging and storage within Level 3 will require only the HDPE liner on top of the sediment. The sediment is not required to be removed; however, the contractor may remove material at his/her discretion to optimize construction operations. The level 3 area will require post-construction restoration to the satisfaction of the Contracting Officer.
8. Lock 3, Sheet C106 – Please confirm tree trimming is allowed along the construction access road located along the west side of the Construction staging area.
Trimming of overhanging trees is allowed but shall be coordinated with NPS and will be conducted in such a manner to minimize trimming and to not damage the overall health of the tree per Section 311000 – Site Clearing, Section 3.1 PROTECTION AND
RESTORATION.
9. Lock 3, Sheet C107 & C110 – Please consider removing and replacing the brick pavers located at the southeast corner of the plaza in the area where the 3 each 12” trees and bench are being removed.
The brick pavers on the south side shall be removed and replaced up to the Limits of Disturbance indicated.
10. Lock 3, sheet C114 – Please confirm 6” Solid PVC Pipe can be installed as shown with the proposed Cast in Place retaining wall located adjacent to the lower lock gate.
The 6” solid PVC Pipe will go underneath the foundation of the retaining wall. A steel sleeve is required to distribute any bearing pressure from the wall off of the PVC in this location.
11. Lock 3, Sheet C301 – Construction Access Road and Staging Area Typical Section. Please clarify where the HDPE Geomembrane is to be used.
The HDPE Geomembrane is to be provided underneath the entire footprint of the Construction Access Road and Staging Area within the existing grass area. The HDPE Geomembrane is required to be placed on the sediment within the Level 3 staging and storage area, but without the addition of gravel base and surface.
12. If Option A is awarded, will additional access (Limit of Disturbance) be provided so equipment will be able to get closer to the upstream gate?
Access should be provided on the south side of Lock 4 to the west from the proposed Staging and Storage area indicated on Civil Plan sheet C101 of Lock 4.
13. S302-sheet 35, detail 4-Please provide amount of bedrock that needs to be removed to place concrete mat for estimate purposes. (#24 from RFI Log) Approximately 2 cubic yards.
14. C403-sheet 23 - Please provide layout of the perforated PVC pipe included in the open joint pavement detail. We assume this perforated PVC pipe is different than the PVC underdrain shown on sheet 21. (#25 from RFI Log) The detail on C403 is a typical detail section. The pipe on this detail is the same as the PVC underdrains indicated on plan and profiles on C114-C116. Contractor should install pipes at location and elevation indicated on the plan and profile sheets, with the assistance of the typical detail and installation notes indicated on sheet C403.
15. S103 and S301 - Drawing S103 calls for concrete gutter, TYP. 4 corners under bridge. Drawing S301 calls for removal and replacement of existing 8" concrete SOG under bridge (#26 from RFI Log) Remove the slab on grade per 1/S301. Place 6” crushed stone per detail 1/S311. Note requiring replacement of 8” SOG will be removed from 1/S301.
16. Spec 01 31 00 – 7 - RE: Environmental Coordination. What scope is there that would require the Contractor develop an Indoor Air Quality Management Plan?
(#32 from RFI Log) An Indoor Air Quality Management Plan is not required.
17. Spec 01 31 00 – 9 - Who pays the fees to the issuing authorities for the Permits cited under paragraph B? (#33 from RFI Log) Permit fee related to permits being provided by the government as stated in 01 31 00 1.9 B are paid by the government.
18. Spec 01 50 00 -2-Other than providing 2 phone lines, who is responsible for any renovation and improvements to the existing National Park Service Visitor center for use as a contracting Officers office? (#34 from RFI Log) NPS is responsible for installing and paying usage fees for phone lines for Contracting Officer’s and CMR’s use in the Visitor Center. Renovation/improvements of the existing facility are the responsibility of NPS.
19. Spec 01 50 00 – 3-Who pays the useage fees for the two Contracting Officers phones? (#35 from RFI Log) Spec 01 50 00, Paragraph 3.2.G.1 is a typo. Shall read: “1. Make arrangements with the telephone company to install 2 lines for the Contractor’s use and pay the installation and usage costs.”
20. Ref: GeoCapitol Engr Environmental Services Report dtd 5/17/2016 & GeoCapitol Engr Sediment and Canal Surface Water Sampling Results dtd 3/16/2016. If the discharge from the in-canal sump pits is pumped downstream of the work area and back into the canal, does the flow need to be treated with a carbon filtration system? The referenced contract documents seem to differ on the need for a carbon filtration system. (#36 from RFI Log) Water collected from the in-canal sump pits shall be disposed of in accordance with the discharge requirements of the permit received by the GC. Details are in the CSMP.
21. In the Materials specification, item G reads as follows: ‘G. Timber furnished by the Contractor shall be of sound, square edge grade, rough, and unseasoned, double end trimmed unless otherwise shown. Six inch and thicker timbers shall have three edges free from wane. The other edge may have wane not to exceed two inches. All timbers as cut and shaped shall be free from wane, rot, shakes, cracks, and checks, and splits. Timbers that have splits, checks, or shakes shall be replaced at no cost to the government.’
Checking is a natural part of the curing and drying process for large section timbers and is generally acceptable in any heavy timber construction work. It would be practically impossible to obtain timbers of the required sizes for this job which are perfectly free of checks, and would be completely impossible to ensure that no checks develop during the cutting and joinery process as the existing stresses within the timbers are altered and released by cutting wood fibers and by changes in humidity as the timbers are stored and moved across various locations.
What standard will NPS use to determine what amount (size, length, depth, quantity?) of checking makes a timber unacceptable for use and, once fabricated and assembled, what standard of required replacement would be applied as the timbers continue to age and change after assembly and installation?
In other words:
a) What size and quantity of checking would require the Contractor to reject a timber for use in construction? And,
b) What size and/or quantity of checking which propagates after assembly and/or installation would prompt the NPS to require the Contractor to perform the extremely costly task of removing and replacing that timber?
The referenced specification section will be revised as follows:
G. Timber furnished by the Contractor shall be of sound, square edge grade, rough, and unseasoned, double end trimmed unless otherwise shown. Six inch and thicker timbers shall have three edges free from wane. The other edge may have wane not to exceed two inches. All timbers as cut and shaped shall be free from wane, rot, shakes, cracks, and checks, and splits that exceed SPIB limits. Timbers that have excessive splits, checks, or shakes shall be replaced at no cost to the government..
22. Addendum 3 included the Contaminated Soil Management Plan generated by GeoCapitol Engineering LLC which requires the installation of dewatering wells to be installed to lower the existing ground water table below the limits of excavation prior to excavating any material. This plan also requires the GC to obtain a DCRA and/or DC Water Permit to install the wells. Must the successful bidder follow this plan or will other soil management plans be considered? (email 8/1/8/16) Alternate plan can be proposed but contractor is responsible for obtaining approval of the plan from the DOEE and authority having jurisdiction.
23. Is the water that is collected at the 2 sump pit locations shown in the erosion control plans to be tested for contamination prior to discharge? (email 8/1/8/16) Water collected from the in-canal sump pits shall be disposed of in accordance with the discharge requirements of the permit received by the GC. Details are in the CSMP.

Unlisted classifications needed for work not included within the scope of the classifications listed may be added after award only as provided in the labor standards contract clauses (29CFR 5.5 (a) (1) (ii)).
The body of each wage determination lists the classification and wage rates that have been found to be prevailing for the cited type(s) of construction in the area covered by the wage determination. The classifications are listed in alphabetical order of "identifiers" that indicate whether the particular rate is a union rate (current union negotiated rate for local), a survey rate (weighted average rate) or a union average rate (weighted union average rate).
Union Rate Identifiers
A four letter classification abbreviation identifier enclosed in dotted lines beginning with characters other than "SU" or "UAVG" denotes that the union classification and rate were prevailing for that classification in the survey. Example:
PLUM0198-005 07/01/2014. PLUM is an abbreviation identifier of the union which prevailed in the survey for this classification, which in this example would be Plumbers. 0198 indicates the local union number or district council number where applicable, i.e., Plumbers Local 0198. The next number, 005 in the example, is an internal number used in processing the wage determination. 07/01/2014 is the effective date of the most current negotiated rate, which in this example is July 1, 2014.
Union prevailing wage rates are updated to reflect all rate changes in the collective bargaining agreement (CBA) governing this classification and rate.
Survey Rate Identifiers
Classifications listed under the "SU" identifier indicate that no one rate prevailed for this classification in the survey and the published rate is derived by computing a weighted average rate based on all the rates reported in the survey for that classification. As this weighted average rate includes all rates reported in the survey, it may include both union and non-union rates. Example: SULA2012-007 5/13/2014. SU indicates the rates are survey rates based on a weighted average calculation of rates and are not majority rates. LA indicates the State of Louisiana. 2012 is the year of survey on which these classifications and rates are based. The next number, 007 in the example, is an internal number used in producing the wage determination. 5/13/2014 indicates the survey completion date for the classifications and rates under that identifier.
Survey wage rates are not updated and remain in effect until a new survey is conducted.
Union Average Rate Identifiers
Classification(s) listed under the UAVG identifier indicate that no single majority rate prevailed for those classifications; however, 100% of the data reported for the classifications was union data. EXAMPLE: UAVG-OH-0010 08/29/2014. UAVG indicates that the rate is a weighted union average rate. OH indicates the state. The next number, 0010 in the example, is an internal number used in producing the wage determination. 08/29/2014 indicates the survey completion date for the classifications and rates under that identifier.
A UAVG rate will be updated once a year, usually in January of each year, to reflect a weighted average of the current negotiated/CBA rate of the union locals from which the rate is based.
WAGE DETERMINATION APPEALS PROCESS
1.) Has there been an initial decision in the matter? This can be:
* an existing published wage determination
* a survey underlying a wage determination
* a Wage and Hour Division letter setting forth a position on a wage determination matter
* a conformance (additional classification and rate) ruling
On survey related matters, initial contact, including requests for summaries of surveys, should be with the Wage and Hour Regional Office for the area in which the survey was conducted because those Regional Offices have responsibility for the Davis-Bacon survey program. If the response from this initial contact is not satisfactory, then the process described in 2.)
and 3.) should be followed.
With regard to any other matter not yet ripe for the formal process described here, initial contact should be with the Branch of Construction Wage Determinations. Write to:
Branch of Construction Wage Determinations Wage and Hour Division U.S. Department of Labor 200 Constitution Avenue, N.W.
Washington, DC 20210
2.) If the answer to the question in 1.) is yes, then an interested party (those affected by the action) can request review and reconsideration from the Wage and Hour Administrator (See 29 CFR Part 1.8 and 29 CFR Part 7). Write to:
Wage and Hour Administrator U.S. Department of Labor 200 Constitution Avenue, N.W.
Washington, DC 20210
The request should be accompanied by a full statement of the interested party's position and by any information (wage payment data, project description, area practice material, etc.) that the requestor considers relevant to the issue.
3.) If the decision of the Administrator is not favorable, an interested party may appeal directly to the Administrative Review Board (formerly the Wage Appeals Board). Write to:
Administrative Review Board U.S. Department of Labor 200 Constitution Avenue, N.W.
Washington, DC 20210
4.) All decisions by the Administrative Review Board are final.
