Justification for Single Source Awards IAW FAR 13.106-1 For
Over Micro-Purchase Threshold but Not Exceeding the SAT ($250K)
Acquisition Plan Action ID: 36C250-21-AP-2408
1. Contracting Activity: Department of Veterans Affairs, VISN 10, Cleveland VA Medical
Center, 10701 East Blvd., Cleveland OH 44106. The purchase request number is 541-21-2- 5986-0049.
2. Brief Description of Supplies/ Services required and the intended use/Estimated
Amount: The project 541-21-105, “Replace Substation A & B”, is for the replacement of the existing substations A and B in room D21. This requirement also calls for the relocation and replacement of the emergency distribution and the automatic transfer switches (ATS) currently located in D21 to a new dedicated emergency electrical room. These automatic transfer switches feed much of the emergency loads throughout the medical center.
The VISN 10 Contracting Activity Cleveland is requesting the use of brand name specification for providing three (3) new automatic transfer switches as part of a direct replacement of existing ASCO Power Technologies (ASCO) automatic transfer switches as part of the medical center emergency power network. These automatic transfer switches will be an integral component of the overall, upgraded medical center emergency power system needed to provide emergency power to the hospital, as described above. The estimated cost for this component of the project is , which is less than of the overall estimated project amount.
3. Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used: ASCO is the only responsible source for the automatic transfer switches needed for this project. The use of an ASCO automatic transfer switch in the acquisition is essential to the Government’s requirements, thereby precluding consideration of a product manufactured by another company. This project is adding automatic bypass/isolation transfer switches which allow an electrical power system to supply power from the normal utility source and a backup power source. The automatic transfer switches are equipped with automatic controls which will start the backup power source and transfer the loads to the best power source available.
The Wade Park facility has approximately (48) existing automatic transfer switches which are all manufactured by ASCO. ASCO automatic transfer switches have been selected by the successful low-bid contractors and approved by the VA in the past project to initially install the automatic transfer switch systems, and all subsequent projects to expand this system, due to pricing and compliance with the VA’s specifications. The automatic transfer switches are considered highly specialized life safety equipment and comprise a vital component for providing emergency power to the medical center’s critical patient care equipment. VHAPM Part 813.106 Page 2 of 2 Original Date: 08/30/17 Revision 02 Eff Date: 03/31/2020 operational controls for each manufacturer of transfer switches are different, we recommend selecting to sole source ASCO for this purchase. Continuing with the single prevalent manufacturer of this equipment is considered essential to enable VA technicians to operate, maintain and troubleshoot this critical, highly complex system which directly supports essential patient care equipment. Furthermore, since this project will only replace three automatic transfer switches, retaining the consistency of ASCO 7000 series automatic transfer switch equipment throughout the medical center is the common-sense approach as well.
4. Description of market research conducted and results or statement why it was not conducted: Market research was conducted IAW FAR Part 10 through VIP, SAM, and using past procurement history. These supplies will be procured under a construction contract which will be 100 percent set-aside to Service-Disabled, Veteran-Owned Small Business (SDVOSB) concerns. The VIP search identified 1,763 SDVOSB sources Nationwide and 41 SDVOSB concerns in the State of Ohio. Past procurement history has determined that this requirement can be competed amongst SDVOSB concerns at a fair and reasonable price.
Therefore, the Rule of Two can be met.
5. Contracting Officer's Certification: Purchase is approved in accordance with FAR13.106- 1(b). I certify that the foregoing justification is accurate and complete to the best of my knowledge and belief. Note: COs are required to make a determination of price reasonableness IAW FAR 13.106-3.
