About this file
This is a Traffic Control/Roadway Work Permit form issued by the New Mexico Department of Transportation (NMDOT) that establishes the regulatory framework and requirements for contractors conducting roadway work within NMDOT jurisdiction. The permit applies to various types of roadwork including construction, rehabilitation, shoulder work, signal and lighting installation, utility work, drainage and excavation, soil testing, and signing and striping projects. Contractors must submit a completed permit application that includes project-specific information such as the work location (route and mile post or intersection), road classification (2-lane through 8-lane roads, divided or undivided), existing and proposed speed limits, working duration with specific start and end dates and daily work hours, and the purpose of the permit. The permit cannot be processed without an enclosed Traffic Control Plan (TCP). The permit approval is conditioned on contractor compliance with the Manual on Uniform Traffic Control Devices (MUTCD) and requires that contractors and their traffic control firms contact the NMDOT District Office to confirm actual start dates before commencing operations.
The permit establishes mandatory insurance and indemnification requirements, including contractor obligation to provide NMDOT with a certified copy of its insurance policy and certificate of insurance naming NMDOT as an additional insured with primary coverage over other valid insurance. Contractors must indemnify and hold harmless NMDOT and its employees from all liability, claims, damages, losses, or expenses resulting from negligent acts by the contractor, its employees, agents, or any other parties engaged to work under the permit. The NMDOT District Office Traffic Section reviews and approves permits, with approval options including full approval, approval as amended, or denial. Approved permits receive a permit number and are subsequently submitted to the District Public Information Officer. The form itself serves as a standardized application document with fields for contractor contact information, traffic control firm details, certified traffic control supervisor information, and space for additional conditions or notes as determined necessary by the NMDOT District Office.
