About this file

This document is a Contractor's Certification on Compliance with the National Defense Authorization Act (NDAA), specifically addressing prohibited telecommunications and video surveillance equipment and services.

The certification requires contractors to represent their compliance with NDAA Section 889 prohibitions, which ban federal procurement of equipment, systems, or services using covered telecommunications equipment as substantial or essential components. Covered telecommunications equipment includes products from Huawei Technologies, ZTE Corporation, Hytera Communications, Hangzhou Hikvision Digital Technology, and Dahua Technology, or any subsidiaries or affiliates. The prohibition applies to both direct government procurement (effective August 13, 2019) and contractor use regardless of contract performance context (effective August 13, 2020). Contractors must conduct reasonable inquiries to identify any covered equipment or services within their operations and supply chains. Exceptions exist for third-party connectivity services (backhaul, roaming, interconnection arrangements) and telecommunications equipment incapable of routing, redirecting, or providing visibility into user data traffic. If covered equipment or services are identified during contract performance, contractors must report within one business day to the Contracting Officer or, for Department of Defense contracts, to https://dibnet.dod.mil, including supplier information, equipment specifications, and mitigation actions. Within ten business days, contractors must provide additional mitigation details and describe prevention efforts. The certification includes three related provisions (52.204-24, 52.204-25, and 52.204-26) with detailed disclosure requirements for contractors offering covered equipment or services.
