About this file

This is Amendment 002 to Request for Proposal (RFP) N69450-26-RP-00201 for Title Services in Tarrant County, Texas, issued by Naval Facilities Engineering Systems Command Southeast on September 4, 2026. The amendment contains a Questions and Answers section clarifying subcontracting policy and operational requirements for the solicitation.

The amendment addresses eleven key questions regarding contractor qualifications and service delivery. Primary findings include: (1) no subcontracting will be approved prior to contract award, with approval for any subcontracting services extremely limited and not guaranteed; licensed title services and escrow services will not be approved for subcontracting; (2) all technical experience and past performance references must reflect work performed directly by the offeror, not by proposed subcontractors; (3) the contractor must independently hold all required professional liability insurance ($2,000,000) and not rely on subcontractor coverage; (4) issuance of title insurance policies in accordance with Department of Justice Title Standards 2016 is a required service; (5) a physical office location in Tarrant County, Texas suitable for in-person closings is mandatory, though coworking or shared-office spaces are acceptable if they meet specified closing requirements; and (6) specific Texas licensing requirements should be verified with the Texas Department of Insurance. Offerors must acknowledge receipt of this amendment prior to proposal submission, with acknowledgment required either in the submitted offer or via electronic mail to michelle.l.ross59.civ@us.navy.mil and/or michael.p.bailey.civ@us.navy.mil to avoid rejection.

Continued from page 1:

Answer 1: No subcontracting will be approved prior to contract award. Approval for subcontracting services under this contract would be extremely limited and is not guaranteed.

Licensed title services and escrow services will not be approved for subcontracting.

Question 2: If we intend to subcontract the licensed title/escrow work, should we disclose the proposed subcontractor's identity, Texas licensure, and experience within our technical proposal?

Answer 2: See answer to Question 1.

Question 3: For Technical Factors 1-3 (Title Evidence Capability and Texas Licensure, Capacity to

Support Government Real Property Acquisitions, and Escrow Service Capability), can a proposed subcontractor's Texas licensure, staffing, and experience be credited toward our technical evaluation, or must the Offeror itself independently hold the licensure and demonstrate the experience described in these factors?

Answer 3: See answer to Question 1. The technical experience must reflect work performed by the Offeror.

Question 4: For Exhibit E, may we submit past performance references for the proposed subcontractor's title/escrow work, or must the references reflect work performed directly by our company?

Answer 4: See answer to Question 1. The past performance reference must reflect the quality of work performed by the Offeror.

Question 5: Would the Government's consent to subcontract, if granted, cover all of the title evidence, title insurance, closing, and escrow functions described in Exhibit B, or would consent need to be requested separately for different categories of work (for example, escrow account agent duties versus title search and closing services)?

Answer 5: See answer to Question 1.

Question 6: If subcontracting is approved, would our company remain the sole Contractor of record and signatory on the contract, with the subcontractor performing under our direction, or would the Government expect the subcontractor to be identified as a party to the agreement in some other capacity?

Answer 6: See answer to Question 1.

N69450-26-RP-00201

Question 7: If the subcontractor holds the required $2,000,000 professional liability insurance and any additional escrow-related bonding, would that satisfy the requirement in Exhibit B, Paragraph 12, or must our company independently carry that coverage as well?

Answer 7: See answer to Question 1. The contractor is expected to hold the required professional liability insurance.

Question 8: Will the contractor be required to issue a Title Insurance Policy?

Answer 8: Yes. In accordance with Exhibit B, issuing title insurance policies is a required service under this contract, in accordance with the Department of Justice Title Standards 2016.

Question 9: Is a physical business location in Texas required?

Answer 9: The contractor must be able to provide an office suitable to conduct in-person closings within Tarrant County, Texas as described in the Closing Requirements of Exhibit B.

Question 10: If so, would a coworking or shared-office location in Texas satisfy this requirement?

Answer 10: Yes, provided the location meets the Closing Requirements described in Exhibit B.

Question 11: What specific Texas license or licenses are required under the “Title Evidence

Capability and Texas Licensure” evaluation criterion?

Answer 11: Please refer to Texas Department of Insurance.
