About this file
This is Exhibit A of Request for Proposal N69450-26-RP-00201, which establishes the proposal requirements, basis of award, and evaluation factors for a contract for title evidence and escrow services.
The solicitation requires offerors to submit technical proposals addressing three equally-weighted factors: (1) Title Evidence Capability and Texas Licensure, demonstrating experience providing title evidence, title insurance, and closing services with proof of Texas licensure and TLTA title commitment and endorsement experience; (2) Capacity to Support Government Real Property Acquisitions, demonstrating sufficient office staffing and capability to perform multiple simultaneous acquisitions and conduct multiple closings in a single day; and (3) Escrow Service Capability, describing experience with escrow services, financial institution relationships, and ability to provide statements, billing, and funds transfers. Offerors must provide a cover letter or narrative limited to four pages in 12-point Times Roman or Courier New font, complete Exhibit D (Small Business Representations), and provide two non-affiliated past performance references with full contact information. Price proposals must include completed Exhibit C with fixed, unit prices for all required services (hourly rates are not acceptable) and the applicable 2026 Texas Schedule of Owner's Title Insurance Policy Rates for TLTA U.S. Policy Forms T-11 and T-12. Award will be made using Best Value/Trade-off Procedures, with technical factors combined considered approximately equal in importance to price. Technical factors receive adjectival ratings of Excellent, Satisfactory, or Poor; Past Performance is evaluated on a pass/fail/neutral basis, with a fail or poor rating in any factor rendering the proposal ineligible for award unless corrected in negotiations. Past Performance references will be evaluated on Title Search and Commitment Precision, Responsiveness, Escrow Security and Financial Fidelity, Timeliness and Agility, and Resource Availability. Price evaluation will assess completeness (all required pricing provided with correct mathematics) and reasonableness (using comparison of proposed prices to other offers, independent Government estimates, or historical information).

Your completed Exhibit C “Table of Title Evidence and Escrow Services Fixed Rates” and the Texas title insurance schedule of rates will constitute your price proposal for evaluation of price reasonableness.
BASIS OF AWARD
Award will be made using Best Value/Trade-off Procedures. Award will be based on technical factors and price, which together constitute a best value to the Government. Technical factors when combined are approximately equal in importance to price. The objective is selection of a contractor whose overall proposal demonstrates the best value to the Government based on the specified criteria. The technical factors 1, 2, and 3 are of equal importance and will be rated as either “Excellent,” “Satisfactory,” or “Poor.” Past Performance is pass/fail/neutral. All proposals shall be evaluated against the established criteria set forth below. A poor rating in any factor or a fail rating in Past Performance, unless corrected in negotiations, shall render the entire technical proposal unacceptable and therefore ineligible for award.
The following adjectival ratings will be assigned to the Technical Factors:
Excellent – offer exceeds the minimum requirements of the solicitation
Satisfactory – offer meets the minimum requirements of the solicitation
Poor – offer does not clearly meet the minimum requirements of the solicitation
TECHNICAL FACTORS:
RFP Requirement: based on the submitted proposal, the Government will evaluate the offeror’s ability to provide all required services set forth in Exhibit B, “Statement of Work: Contract for Title Evidence and Escrow Services,” to meet all conditions of the proposed contract, and to understand the contract requirements.
Factor 1: Title Evidence Capability and Texas Licensure. The Offeror shall demonstrate their capability to provide the title evidence and title insurance services described in Exhibit B by providing a cover letter or written narrative describing similar title evidence services, closing services, and title insurance policies provided to other customers. The Offeror should describe the amount of annual title and real property closing business they conduct, including what percentage of their overall work is comprised of title and closing services. The Offeror should describe the relevant experience of all personnel available to support this contract. The Offeror should describe or submit proof of its Texas Licensure and describe their experience issuing Texas TLTA title commitments and endorsements.
Factor 2: Capacity to Support Government Real Property Acquisitions. In their cover letter or written narrative, the Offeror shall describe their office staffing and demonstrate their capacity to perform title evidence and real property acquisition closings. The Offeror shall describe sufficient capacity and staffing to support multiple acquisitions simultaneously and to conduct multiple closings on a single day. The Offeror’s staffing should include sufficient personnel to perform all the services required in Exhibit B.
Factor 3: Escrow Service Capability. In their cover letter or written narrative, the Offeror should describe their experience providing escrow services, including the financial institution(s) they do business with, their capability to provide statements, billing, funds transfers, and all of the other escrow services required in Exhibit B. The Offeror should describe their escrow security, financial fidelity, and their reliability to act as an escrow agent.
PAST PERFORMANCE:
Past Performance refers to the quality of recent services performed from the customer’s perspective. The Government will evaluate past performance on a pass, fail, or neutral basis, by contacting two professional references provided by the Offeror for similar title evidence, title insurance, real property acquisition closing services, and escrow services performed. Each reference will be asked to describe and rate the Offeror’s past performance of similar work regarding these categories:
1. Title Search and Commitment Precision
2. Responsiveness – prompt reaction to requirements
3. Escrow Security and Financial Fidelity – trustworthiness with funds
4. Timeliness and Agility – adherence to schedule and resolution of title defects
5. Resource Availability – adequate personnel, equipment, and resources to support the requirement services
The Offeror should list two Past Performance references in its offer, including full name, telephone number, and electronic mail address for contact by the Government and indicate the specific project or services performed for that reference. It is the Offeror’s responsibility to ensure that all contact information provided for Past Performance references is correct. The inability of the Government to reach any of the provided references may result in an evaluation of “fail.” An offeror’s indication of no past performance of similar title evidence, acquisition closing services, and escrow services will result in a determination of a “neutral” rating.
The following adjectival ratings will be assigned to the Past Performance factor:
Pass – the Past Performance references indicate customer satisfaction across three (3) or more categories of performance listed above.
Fail – the Past Performance references indicate dissatisfaction with three (3) or more category of performance listed above.
Neutral – the Offeror indicates no past performance of similar title evidence, acquisition closing services, and escrow services.
PRICE:
Offerors are required to submit their proposed prices for each service required in Exhibit C, “Table of Title Evidence and Escrow Services Fixed Rates” and to submit an applicable Texas state schedule of title insurance rates. The Offeror’s proposed price will be evaluated by totaling the price for all contract services together, evaluating the proposed price for each individual service, and determining the completeness and reasonableness of the Offeror’s price proposal.
Completeness means all pricing information required by the solicitation has been provided, all mathematic computations are correct, and the pricing application is understood. Prices are on an “all or none” basis, and failure to submit a price on an item or a number of items may cause this factor and the entire offer to be determined unacceptable. Conditional prices and hourly rates will not be considered responsive or complete and will not be evaluated for award.
Reasonableness means price analysis comparisons indicate the offered price to be fair and reasonable. One or more of the following techniques will be used to ensure a fair and reasonable price:
1. Comparison of proposed prices received in response to the solicitation for intended services.
2. Comparison of proposed prices with the independent Government estimate for intended services.
3. Comparison of proposed prices with available historical information for intended services.
A price that is found to be unreasonably high in relation to the proposed work may indicate an inherent lack of understanding of the solicitation requirements and may result in the overall proposal being considered unacceptable.
Proposed prices of all technically acceptable offers will be evaluated. The price proposals will be evaluated separately from the technical proposals.
The contract for Title Evidence and Escrow Services will be awarded to the Offeror whose overall proposal demonstrates the best value to the Government based on the evaluation factors described in this solicitation.
