3.2 Solid

Waste Disposal

Escambia County has a strict franchise fee that is paid per CY collected. On the previous contract(s), all of the front loads, roll-offs, and compactors were subject to this charge. This was paid monthly over the past 5 years in excess of $1.4 million dollars for the term of the contract to Escambia County. No exceptions were given by the County to any business or offeror. Please confirm that the contractor is responsible for these costs under this FFP portion of the contract and that no agreement has been reached between the Navy and the County to negate the contractor paying the franchise fee.

Yes, the contractor is responsible for these costs. All associated costs and/or projected costs required for completion of the PWS within the RFQ shall be included in the offeror’s quote.

Escambia County has strict flow control of the garbage where all waste in Escambia County must go to either the Escambia County Landfill or the Escambia County Palafox Transfer Station. No MSW may leave the county, this includes all front loads, roll-offs, and compactors. All non MSW rolloffs are also subject to the franchise because they are deemed to be from a commercial location.

Please clarify if this "flow control" should be adhered to in this contract.

The Contractor shall comply with all applicable Federal, State, and Local laws, regulations, and executive orders, and with base-wide instructions, standards, and permit requirements.

54-59) n/a

I do not see any requirements for the NASP Air Show that is held in November of each year. This is a fairly large effort and the contractor needs over 30 additional containers and several trucks to service the Air Show. Is the contractor responsible for this work? If so, how does the contractor go about billing for the services? Do we use the ELIN IDIQ pricing, or do we negotiate a price with contracting upon request since this work is outside of normal IDIQ pricing?

Any Integrated Solid Waste Management work not identified in Recurring Work will be provided via Non-Recurring Work. Additional containers for NASP Air Show may require a Non-Recurring Task Order or the utilization of FedMall.

COMMERCIAL

SERVICES

(NOV 2021)

Relevant Project

Will the Government please confirm that the capability that an offeror provides must be from a contract of $750,000 with the DoD or DHS with an equivalent amount of front load and Rolloff collections?

Relevant projects must have a contract value of $750,000 or greater as stated in the RFQ.

There is no requirement for the projects to be completed with the DoD nor is there a requirement for DHS projects with an equivalent amount of front load and Rolloff collections.

19 1/9/2024 Pg 19

b. Non-cost/price Factors (1)(i)

Can an Offeror can provide Corporate experience for a contract on which the prime was Non-populated Joint Venture of which they are a member?

Yes.

20 1/9/2024 Pg 20/21

b. Non-cost/price Factors (2)(i)

Factor 2 Safety states “The offeror shall submit the following information: The Days Away from Work, Restricted Duty, or Job Transfer (DART) Rate; and Total Case Rate (TCR) for the specified five (5) Calendar Years (CY), as well as a safety narrative, as described further below.” There is no description of what is desired in the Safety Narrative. Can the Government please provide this information.

A Safety Narrative is not required for Factor 2, Safety. See Amendment 0003 for correction.

N6945024Q0002 GOVERNMENT PRE AWARD INQUIRY FORM

21 1/9/2024 ELINS J-0200000-06 ALL

Please confirm if the ELIN submittal/breakout is an evaluation factor for fair and reasonable pricing, and not a billing mechanism for the Government.

Please elaborate in great detail on how the ELINS will be used over the next 5 years, as the previous 5 were a bit challenging to figure out their true purpose.

As stated in the solicitation, offerors shall submit a completed CLIN section of the solicitation and a completed ELIN Pricing Attachment in Microsoft Excel format. The Government will evaluate price based on total price of the basic requirements and all the option items. Price analysis will be performed on the basis of price reasonableness in accordance with FAR 13.106-3.

NAVFAC SE also utilizes the ELIN attachment to request funding and for invoicing purposes. Proposed ELIN pricing should reflect the intrinsic value of the work for each ELIN.

N6945024Q0002 GOVERNMENT PRE AWARD INQUIRY FORM

22 1/9/2024

b) If the ELINS are to be charged to each specific customer exactly how the contractor proposes them in the bid, and they are used to bill the customer directly, please answer the following: If a command that is tied to an ELIN is deleted/vacated, please elaborate in great detail how the contractor is to recoup their fixed costs that remain after the command leaves.

This has happened over the past contracts and each time was extremely challenging to get a clear answer from Contracting.

This needs to be laid out very clearly before any contractor can bid. Several times we did not receive full monies due from a command leaving during the middle of an option year even though our commitment to these large fixed costs remained. The most fair and logical approach would be for the contractor to submit a deduct MOD and be able to recoup the remaining fixed costs monies over the rest of the term of the contract. Please advise.

For this requirement, a commitment of funds has already been received from all Supported Commands. Any changes to scope within the firm fixed-price requirements will be addressed via post award modification.

N6945024Q0002 GOVERNMENT PRE AWARD INQUIRY FORM

23 1/9/2024

c) Would the Government consider creating a fixed costs line item for equipment costs, salaries, rents, insurance, taxes etc., or instructing the contractor to bid these large fixed costs under the CNIC and NASWF Elins since they are the ones driving the requirement and the ones that have the smallest chance of dissolving?

The Government has considered this; however, new CLINs/ELINs will not be created. The ELINs identified in J-0200000-11 will remain unchanged.

24 1/9/2024

d) Over the past contracts, we have had commands simply not fund for months on end, and sometimes even 6 months or a year late. We inquired each time to the KO about whether or not to continue service, and were often met with no response. Several times the response was there were "promises to pay" or "funding hasn’t cleared LANT" or "funding document error". All while we are performing service, incurring expenses and not getting paid.

Please elaborate in great detail if a command hasn't funded how the contractor is to receive its money, does it continue servicing the customer? If the customer never funds or funds late or doesn't pay at all who is responsible for paying the contractor? When does service stop/continue?

See GPI Response #22. Due to the variability of specifics during administration and the limited details provided in GPIs, the exact scenario cannot be addressed.

N6945024Q0002 GOVERNMENT PRE AWARD INQUIRY FORM

25 1/9/2024 d.1) In continuance with the above, if the answer is do not service until the command funds, what if CNIC or NASWF funds late (This example is occurring as we speak, CNIC and NASWF haven't funded for October yet).

Do we cut the entire base off from service? There needs to be a better solution than constantly checking to see who and who hasn't paid or funded. The contractors submitting on this procurement are bidding the cost that they need to be paid in order to successfully perform this contract. The contractor doesn't care who pays us, just that we get paid what we submitted in our successful bid. Please elaborate in great detail how this will be fixed in the future to ensure that the successful contractor gets paid for what they bid with no shortfalls. If there is no solution, and we must bill by ELIN, please strongly consider changing this process and having the successful contractor bill one line item and the Navy figure out who owes what on the backend.

See GPI Response #22. Due to the variability of specifics during administration, the exact scenario cannot be addressed.

26 1/9/2024 13 Sec C 1503030 2.4.2

Please confirm contractor trucks, Connex box, mobile office trailer, etc. are not allowed to park on post.

Correct. No parking of any connex box, mobile office trailer, etc. is allowed on the base.

34 1/9/2024 53 52.212-3

Transition Period - with over 200 NEW containers to place in FEW outlining areas for a new contractor can the transition period be extended to 60 days?
