The following have been added by full text:

AMENDMENT 0006

The following are questions that were received by this Agency and our answers:

Question 1: The RFP contains Clauses 52.209-3 and 52.209-4, each of which provides as follows: “(h)

The Government may waive the requirement for first article approval test where supplies identical or similar to those called for in the schedule have been previously furnished by the offeror/contractor and have been accepted by the Government. The offeror/contractor may request a waiver.” Please state whether an offeror may request a waiver of the first article test and approval requirements in advance of its offer or as part of the offer?

Answer 1: As noted in Clauses 52.209-3 and 52.209-4 the Government “may” waive the requirement for first article approval test where supplies identical or similar to those called for in the schedule have been previously furnished by the offeror/contractor and have been accepted by the Government. An offeror may not request a waiver of the first article test and approval requirements in advance of its offer or as part of the offer.

Waiver requests will be assessed after contract award, vetted through a risk analysis board and presented to the appropriate Government chain for approval.

Question 2: Please confirm that in the event an offeror is granted a waiver of the first article test and approval requirements, the following CLINS will not be required from that offeror:

CLIN 0001 – LMEPP Pilot Production Units (“PPUs”)

CLIN 0002 – Contractor Testing

CLIN 0003 – Contractor Test Support

CLIN 0004 – Contractor Test Training

CLIN 0005 - Refurbishment of PPUs

CLIN 0013 – Pilot Production Test Plan and Procedure

CLIN 0014 – Pilot Production Test Report

Answer 2: As stated in answer one above, waiver requests will be assessed after contract award. Therefore, offerors shall address all CLINs in accordance with the solicitation.

Question 3: Should offerors that are eligible for the waiver of the first article test and approval requirements submit pricing for those CLINs associated with the PPUs and the testing and refurbishment of the PPUs (i.e., CLINS 0001, 0002, 0003, 0004, 0005, 0013, 0014)?

Answer 3: As stated in answer one above, waiver requests will be assessed after contract award. Therefore, offerors shall provide proposed prices for all CLINs in accordance with the solicitation.

Question 4: If a waiver of the first article test and approval requirements of the RFP is requested and determined to be appropriate for a particular offeror, how will the Navy evaluate that offeror’s total evaluated price for award purposes? Will it disregard that offeror’s prices for CLINS 0001, 0002, 0003, 0004, 0005, 0013 and 0014 for purposes of the award? Otherwise, it will be evaluating CLINs pricing that is not applicable to that offeror.

Answer 4: As stated in answer one above, waiver requests will be assessed after contract award. All CLINs will be included in the total evaluated price and price will be evaluated in accordance with the solicitation.
