SECTION SF 30 BLOCK 14 CONTINUATION PAGE
SUMMARY OF CHANGES
SECTION A - SOLICITATION/CONTRACT FORM
The following have been added by full text:
AMENDMENT 3
The purpose of Amendment 3 of Solicitation N68335-11-R-0123 is to provide responses to Industry questions as shown below:
1. QUESTION: This question relates to an apparent conflict between requirements.
a. Page 71 of 85 of the Solicitation, Paragraph I.B requires the offeror to describe the maintenance philosophy. We assume this instruction solicits the Contractor’s recommendation on selecting a maintenance philosophy.
b. CDRL L001 requires the development of an ISIL at both the Organizational and Intermediate levels. It appears the maintenance philosophy is already specified.
c. Paragraph 4.1 of the TMCR requires that the Tech Manual be developed to support
Operations and Maintenance at the Intermediate maintenance level only.
d. Paragraph 4.2 of the TMCR describes a requirement for the tech manual supplement reflect information in accordance with the approved Maintenance Concept.
In view of the above, please clarify the apparent ambiguities in the above requirements. At what point in the HAWT program is the Maintenance Concept approved?
ANSWER:
a. That assumption is incorrect – Paragraph 1.B. DOES NOT solicit the Contractor’s recommendation on selecting a maintenance philosophy. The Government determines the maintenance philosophy, not the contractor. This requirement means that the contractor needs to describe their understanding of the Government's maintenance philosophy and explain how they will support it. The Support Equipment Recommendation Data (SERD) identifies the maintenance philosophy. The SERD SM&R Code for the HAWT is PEOGG.
b. The maintenance philosophy is already specified by the Government. As stated above, the SERD SM&R Code for the HAWT is PEOGG. The word "supplement" can be removed from the second sentence. The approved Maintenance Concept has already been specified.
c. That is correct. The Tech Manual is to be developed to support Operations and Maintenance at the Intermediate maintenance level only
d. Amendment 3 hereby removes the word “supplement” from paragraph 4.2 of the TMCR. Amendment 3 incorporates revised Attachment 3, Acquisition Logistics Support Statement of Work for the HAWT, Revision A, dated 22 July 2011 (see Section J). No other changes are made to Attachment 3 by this amendment.
The Maintenance Concept was approved by the LKE AWSEC Team prior to the solicitation being released, and is SERD SM&R Code PEOGG for the HAWT.
2. QUESTION: In accordance Clause 52.209-3(b) on Page 40 of 85 of the Solicitation, we conclude that the Government will have 30 days to notify the Contractor of the result of DT following submission of the first article test report; this would correspond to 44 days after completion of the last FAT procedure per the same clause requiring submittal of the FAT Report within 14 days after completion of the last FAT procedure. Note that CDRL A004 states this same requirement to submit the PQT Report 14 days after completion of the last FAT procedure.
However, Clause 52.209-4(b) states that the Government will have 45 days to notify the
Contractor of the result of DT following submission of the first article; this requirement appears to represent a conflict, in that 44 days cumulative days referenced in Clause 52.209-3(b) are tied to completion of the last FAT procedure, while the 45 days referenced in Clause 52.209-4(b) are tied to submission of the first articles. Thus, there would be no time allotted to submit the first articles after completion of the last FAT procedure. To add to the ambiguity, Clause 52.209-4(a) requires that the Contractor to submit the first articles within 15 days after successful completion of PQT, rather than referencing to 14 days after completion of the last FAT procedure, as cited above. Finally, commencement of GT is described in Paragraph 3.2.3.2 of the Statement of Work, and is predicated upon successful completion of the PQT, acceptance of the PQT Report (as further defined by the process described in Paragraph 3.2.3.1.2.), and successful completion of TRR.
a. Please clarify the time available for the Contractor and the Government to complete prerequisite documentation and reviews prior to the commencement of GT.
b. Please clarify the time available for the Government to notify the Contractor of the result of DT.
ANSWER: Clause 52.209-3 describes the First Article Approval process for Contractor Testing. Clause 52.209-4 describes the First Article Approval process for Government Testing. Amendment 2 to this solicitation, issued on 18 July 2011, revised clause 52.209-4 to clarify that the Contractor is required to submit four units(s) of Lot/Item 0001 no more than 30 calendar days after successful completion of Pilot Production Qualification Test. No further changes are made to this clause.
In accordance with clause 52.209-3, the Contractor shall submit the first article test report within 14 calendar days after completion of last FAT. Within 30 calendar days after the Government receives the test report, the Contracting Officer shall notify the Contractor, in writing, of the conditional approval, approval, or disapproval of the first article.
In accordance with clause 52.209-4, within 45 calendar days after the Government receives the first article units, the Contracting Officer shall notify the Contractor, in writing, of the conditional approval, approval, or disapproval of the first article.
3. QUESTION: Paragraph 3.2.4.1 of the SPS requires an MTBF of 1,000 hours. To complete the logistics supportability analysis, we will require that the Annual Operational Requirement be established for each HAWT. At what point in the HAWT program is the Annual Operational Requirement established?
ANSWER: The Annual Operational Requirement (AOR) has been established by the LKE AWSEC Team. We estimate that on average, the sites will use the HAWT about 2 hours a day. This results in approx. 750 hours per year for the AOR.
4. QUESTION: For CLINS 0002 through 0005, under Clause 52.211-8, Time of Delivery on Page 25 of 85 of the Solicitation, each Production Year period is tied to a period of time following Government Release or Production rather than a specific date or calendar year. Further, under this description, Purchase Year One is defined as 1 calendar year in length, Purchase Year Two is 2 calendar years in length, etc.
a. Is it is possible for the Government to combine purchasing years in a manner that could result in the demand to purchase up to 1,200 HAWT units during the first calendar year following Government release, 900 HAWT units during the second calendar year following Government release, and so forth?
b. If so, is this the Government’s intention under the IDIQ?
ANSWER: The Government reserves the right to execute production years one through four after the Government release for production. This could result in the Government executing production years one through four in the first calendar year following release for production. The maximum quantity for each production year is 300 units. The total maximum quantity for this contract is 1,200 units and the contract shall not exceed 1460 days after release for production.
