SUMMARY OF CHANGES
SECTION A - SOLICITATION/CONTRACT FORM
The following have been added by full text:
AMENDMENT 2
The purpose of Amendment 2 of Solicitation N68335-11-R-0123 is to provide responses to Industry questions as shown below:
1. QUESTION: On Pages 18 and 27 of the solicitation, the minimum and maximum orders are defined. We note the minimum order is defined as being only CLIN 0001, the pilot production units. Strictly read, it would be possible for the Government to issue an order for only CLIN 0001 and NOT for any other CLINs. In view of the Statements of Work and other contractual requirements contained in the Solicitation, including Schedules and the order of precedence for conduct of the work, submittal of documentation and granting of approvals, it would seem unlikely that this procurement could proceed on this basis. Our questions are:
a. Is there a mistake here?
b. If so, what is the correct list of the minimum CLINs?
c. If not, and in consideration of the schedule for delivery and approval process described in the Solicitation, the Contractor could wait up to 1 full year before receiving Government acceptance and payment for the CLIN 0001 items. Under these circumstances, would it be possible for the Government to authorize progress payments for the CLIN 0001 items?
ANSWER: The Government’s guaranteed minimum order, as stated on pages 18 and 27 of the solicitation, is CLIN 0001 – four (4) Pilot Production Units. No change is made to the Government’s guaranteed minimum order. However, the Government reserves the right to place delivery orders for pilot production units and data item (CLINs 006-0026) from the date of award through the Government Release for Production, as specified on page 2, Section A, paragraph 4. Progress payments are not authorized by this solicitation and will not be authorized at any point in contract performance.
2. QUESTION: Clause 5252.232-9504 on Page 29 of the Solicitation leaves open the possibility to negotiate progress payments. At what point in the process should the Contractor provide a request for progress payments:
a. In the Price Proposal?
b. After Contract Award?
ANSWER: Clause 5252.232-9504 provides special instructions for the payment office. Progress payments are not authorized by this solicitation and will not be authorized at any point in contract performance.
3. QUESTION: The subject of Paragraph 3.1.1 in the Statement of Work is data duplication. The second sentence requests the Contractor identify all redundant data requirements within the statement of work. Our questions are:
a. Would the Government please clarify this requirement? As an example, at what point should the contractor identify requirements that are redundant? Proposal? Post-award?
b. Is the Government aware of any area(s) within the SOW where the possibility of a redundant requirement exists?
ANSWER: Redundant data could be data that already exists and requires no development. If a part/assembly of the proposed HAWT consists of already developed components that have existing drawings and/or data, the proposal should not reflect excessive hours charged for the development of said data. Redundancy could also occur if an assembly or subassembly was used in more than one part of the HAWT. If that were the case, the Government should not be charged twice (or more) for the same data. This data should be part of the offeror’s proposal. The Government does not provide possible redundant requirements, as this is reliant on what is proposed by the contractor.
4. QUESTION: In section 52.209-4 of the solicitation, Page 40, the first sentence is: (a) The Contractor shall deliver __four (4)_____ units(s) of Lot/Item _0001______ within __15____ calendar days after successful completion of Pilot Production Qualification Test to the
Government at __Patuxent River, MD (Specific address will be given at a later date),___for Government first article tests.
In paragraph 3.2.7.1 of the Statement of Work, page 7, the first sentence is: Not more than four weeks after successful completion of PQT, the Contractor shall provide to the Government four HAWT units for Government DT that meet the requirements of the SPS.
There appears to be a conflict between these statements. Our question is:
a. Which statement is correct?
ANSWER: Clause 52.209-4 and paragraph 3.2.7.1 of the Statement of Work have been revised in Amendment 2 to reflect “no more than 30 calendar days after successful completion of PPQT.” See Attachment 001, Statement of Work, Rev. A, dated 14 July 2011 (see Section J). Clause 52.211-8, Time of Delivery, has also been updated in Amendment 2 to reflect the change from 15 calendar days to no more than 30 calendar days after successful completion of PPQT.
5. QUESTION: Can we bill for progress? Can we break the meetings as bill points etc. Please let us know how you envisioned paying for the costs leading up to the final production and delivery points.
ANSWER: Progress payments are not authorized by this solicitation and will not be authorized at any point in contract performance.
6. QUESTION: ALSSOW paragraph 4.2.2 (LSA/SUPPORTABILITY ANALYSIS SUMMARY (SAS) WORKSHEETS) cite MIL-PRF-49506 as a reference and paragraph 4.3 (LSA DATABASE) indicates that the "contractor shall develop an LSA database utilizing approved LSA electronic database software compatible with the Government legacy system (SLICwave)". Per paragraph 4.2.2 we interpret the "legacy system" to be MIL-PRF-49506 compliant. However, CDRLs L001, L003, L004, and L006 all cite DI-SESS-81758 as the referenced document. DI-SESS-81758 states that all data products need to be in accordance with GEIA-STD-0007. L007 specifically states that all LSA products must be in accordance with MIL-PRF-49506. Request clarification on whether the logistics products and analysis will be performed in accordance with MIL-PRF-49506 or GEIA-STD-0007.
ANSWER: Logistics products and analysis will be performed in accordance with GEIA-STD-0007. As a result of this change, revisions have been made to the ALSSOW, PSOW, and CDRLS L001-L007. Amendment 2 incorporates revised Attachment 3, Acquisition Logistics Support Statement of Work for the HAWT, Revision A, dated 14 July 2011 (see Section J). Amendment 2 incorporates revised Exhibit L, Contract Data Requirements List, Revision A, dated 14 July 2011. Amendment 2 incorportates Attachment 6, GEIA-HB-0007 Data Elements (see Section J).
The summary of changes to the ALSSOW, PSOW, and CDRLs L001-L007 is shown below:

The Government will evaluate equally, as regards time of delivery, offers that propose delivery of each quantity within the applicable delivery period specified above. Offers that propose delivery that will not clearly fall within the applicable required delivery period specified above will be considered nonresponsive and rejected. The Government reserves the right to award under either the required delivery schedule or the proposed delivery schedule, when an offeror offers an earlier delivery schedule than required above. If the offeror proposes no other delivery schedule, the required delivery schedule above will apply.

DATE OF CONTRACT
(b) Attention is directed to the Contract Award provision of the solicitation that provides that a written award or acceptance of offer mailed or otherwise furnished to the successful offeror, results in a binding contract. The Government will mail or otherwise furnish to the offeror an award not later than the day award is dated. Therefore, the offeror should compute the time available for performance beginning with the actual date of award, rather than the date the written notice of award is received from the Contracting Officer through the ordinary mails. However, the Government will evaluate an offer that proposes delivery based on the Contractor’s date of receipt of the contract or notice of award by adding (1) five calendar days for delivery of the award through the ordinary mails, or (2) one working day if the solicitation states that the contract or notice of award will be transmitted electronically. (The term “working day” excludes weekends and U.S. Federal holidays.) If, as so computed, the offered delivery date is later than the required delivery date, the offer will be considered nonresponsive and rejected.
