Statement of Work (SOW)

Project: GAETA, N31 Fenders

GENERAL INFORMATION

1.0 : Scope The contractor shall procure and deliver three (3) new, foam-filled marine fenders. These fenders are intended for use at the NATO pier, located on an Italian Navy base, to support the safe mooring, harboring, and refueling of United States Navy (USN) and allied naval vessels. This procurement action is to replace the current fenders which are in poor material condition. The contractor's responsibility is limited to the purchase and delivery of the specified items. Installation will be performed by government personnel and is not within the scope of this requirement.

2.0 : Background The current foam-filled fenders on the NATO pier fingers were purchased in 2015. Over the last decade, the fenders have worked well, but now show heavy signs of wear and tear, to include delaminating of the elastomer skins and deformation of the fender cylinder shape. To prevent any damage to harbor assets or the NATO pier, replacement of the fenders is needed.

Quoted prices must exclude Value Added Tax (VAT) but must include all other applicable costs, including manufacturing, packaging, transit insurance, and freight shipping to the designated Intermediate FOB Point in Naples, Italy. Quoters shall not include any costs for offloading crane equipment, rigging labor, or onward transportation to Gaeta in their pricing, as these services will be provided by the Government.

B. Reasonableness: Prices are fully justified, supported and considered fair and reasonable under current market conditions.

Factor 3 - Past Performance

The Government will conduct an independent assessment of the quoter's past performance to evaluate the Government's confidence in the quoter's ability to successfully perform the work required. The evaluation will be based on relevant information found in Government-wide databases, including but not limited to, the Supplier Performance Risk System (SPRS) and SAM Responsibility and Qualification to evaluate the quoter's past performance. The Government reserves the right to use other source of information, as deemed necessary. Evaluation may be limited to those quoters who are more likely to receive an award based on Price and Technical Factors.

(b) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

(c) Contractor Responsibility: To be eligible for award of a contract hereunder, a Quoter must be determined by the Contracting Officer to be a responsible prospective contractor in accordance with FAR 9.1. and DFARS 209.105-1.
