About this file
This document is an Amendment (0001) to Solicitation N66604-25-R-0330 for the Naval Undersea Warfare Center Division, Newport (NUWCDIVNPT), addressing a single Indefinite Delivery Indefinite Quantity (IDIQ) contract for Propulsion Test Facility (PTF) Complex Operations & Maintenance. The contract will support the Undersea Warfare Weapons, Vehicles, and Defensive Systems Department, with an ordering period of 60 months from award date. Task orders will be issued on either Firm Fixed Price (FFP) or Cost Plus Fixed Fee (CPFF) bases.
The amendment addresses multiple technical and procedural clarifications, including: correcting labor hour calculations, updating key personnel degree requirements, resolving conflicting contract language, adding FAR clauses related to taxes and pricing adjustments, and providing guidance on NIST assessment requirements for offerors. Specifically, the government added FAR clauses 52.222-42 (Statement of Equivalent Rates for Federal Hires), 52.229-3 (addressing tariff volatility), and 52.216-4 (economic price adjustment), and clarified NIST assessment eligibility criteria for contract award consideration.

Q&A
| Number | Solcitation Background | Contractor Question | Government Response | |
| 1 | 10 USC § 3322 addresses limitations on the fees that may be paid under Cost Plus Fixed Fee (CPFF) contracts. The statute sets specific caps on the fixed fee that can be negotiated for CPFF contracts. The general limitation is that the fee must not exceed 10% of the estimated cost of the contract, excluding the fee itself. These limitations are designed to ensure that the government maintains control over costs while still providing enough incentive for contractors to enter into CPFF contracts. FAR 15.404-4(c)(4)(i)(C) implements these statutory requirements. Section 5.1 of Attachment 8, Section L, includes a maximum fee fill in table in which offerors must fill-in a proposed maximum fee percentage for CLIN 0001, CPFF Services. | IAW with 10 USC § 3322 and FAR 15.404-4(c)(4)(i)(C), the fee cannot exceed 10% of the estimated costs of the contract. Please confirm that for the purposes of this solicitation, CLINs 0001, 0002, and 0004 account for all costs on this contract, and the proposed maximum fee fill-in for section 5.1 on Attachment 8_Section L will be calculated as a percentage of the sum of costs from CLINs 0001, 0002, and 0004. | Offerors shall propose a maximum fee percentage for CPFF Services CLIN 0001, not to exceed 10%. The proposed fee percentage will apply only to the estimated cost of CPFF CLIN 0001. CLIN 0002 (Travel and Other Direct Costs ODCs)) is a non-fee bearing CLIN and CLIN 0004 (Contract Data Requirements List (CDRLs)) is not separately priced. | |
| 2 | Section B of N6660425R0330 (pg. 3 of 82) includes a table of CLINs as follows: 0001, 0002, 0003, 0004, 0005. Attachment 10, NUWCDIVNP Cost Proposal Spreadsheet includes a summary tab which identifies the following CLINs in column "B": 2100, 3100, 6100-6400, 7100-7400, 1100, 5100-5400. | Can the Government please confirm the correct CLIN structure for Attachment 10? | The CLIN numbers listed on the “Summary” Tab of Attachment 10 “NUWCDIVNPT Cost Proposal Sheet” are part of the template language for this document. Please update the “Summary” tab with the CLIN structure provided in Section B of N6660425R0330. | |
| 3 | The Government’s estimated labor mix and hours for all SOW tasks for the full five (5) year ordering | |||
| period is provided in a table in Attachment 8, Section L, 3.2.3, Labor Mix. Offerors must propose the full number of labor hours of 904,800 for the CPFF tasking. The table provides hours per year and total hours for each labor category by SOW task. The SOW Task 4.2 items have a sub total of 64,480 hours per year , and a total of 312,000 for the full PoP. When adding the information, the hours per year add up to 62,400, and the total adds up to 312,000. | Can the Government please review the hours per year and total hours for SOW task 4.2 items and provide a corrected table? | In Attachment ‘Section L’, the table provided in paragraph 3.2.3 “Labor Mix” has a typo. The Hour per Year total for SOW Task 4.2 should be 62,400. This error has been corrected in the attached Section L of this solicitation amendment. | ||
| 4 | While FAR clause 52.222-41 (Service Contract Labor Standards) has been included in the solicitation, FAR clause 52.222-42 (Statement of Equivalent Rates for Federal Hires) appears to be absent. FAR clause 52.222-42, "Statement of Equivalent Rates for Federal Hires," is critical when FAR clause 52.222-41 is included because it provides potential contractors and subcontractors with necessary information about the equivalent rates, they must pay service employees in line with federal standards. The purpose of FAR 52.222-41, "Service Contract Labor Standards," is to ensure that service employees working under federal contracts are compensated fairly and equitably according to the prevailing wage determinations by the Department of Labor. FAR clause 52.222-42 supports this by detailing equivalent rates of pay for service employees, which helps in maintaining consistency and fairness in compensation. | Can the Government incorporate FAR clause 52.222-42 to provide the necessary information about the equivalent rates that must be paid to service employees in line with federal standards? | Clause 52.222-42 ‘Statement of Equivalent Rates for Federal Hires’ has been added in Section I of this solicitation amendment. | |
| 5 | Section M describes how the Government will evaluate Key Personnel resumes based on the alignment of their qualifications and experience with the Statement of Work (SOW) tasks, the typical qualifications of the labor category, and the requirements specified in Section L. For the Engineer, Computer I & II labor category, the typical qualification requirements, as defined in the eCraft Professional Labor Categories, include a “Bachelor’s level degree”. However, Section L of the solicitation prescribes the minimum qualification for the Engineer, Computer I & II labor category as a “BS degree in engineering or computer science”. | Please confirm that a Bachelor of Arts degree in computer science meets the requirement for the Engineer, Computer I & II labor category. | In Section L, paragraph 3.2.2 “Key Personnel”, the degree requirements for Computer Engineer in SOW task 4.1 have been updated. | |
| 6 | Section L of the solicitation includes FAR clause 52.215-1 Alternate I, which requires that the first page of a proposal must contain a statement specifying the extent of agreement with all terms, conditions, and provisions included in the solicitation (see (c)(2)(iii)). In contrast, Attachment 8, Section L, Instructions for Submission of Offers, requires that the proposal's cover letter include a statement specifying unconditional acceptance of all terms, conditions, and provisions included in the solicitation (see 1.4 (3)). This creates a conflict, as the FAR clause allows the contractor to propose deviations from the solicitation terms, conditions, and provisions, while the cover letter instructions mandate unconditional acceptance of all such terms, conditions, and provisions. | Can the Government please resolve the conflict in the solicitation regarding the cover letter statement on terms, conditions, and provisions? Specifically, could the Government revise the instructions in Attachment 8, Section L, 1.4 (3) to align with the requirement stated in FAR clause 52.215-1(c)(2)(iii)? | In Attachment 8, Section L, paragraph 1.4(3), the language regarding the cover letter statement on terms, conditions, and provisions has been updated to align with requirements in FAR 52.215-1(c)(2)(iii). | |
| 7 | FAR Clause 52.211-9, "Desired and Required Time of Delivery" permits partial and early delivery of quantities under the fixed price Contract Line Items Numbers (CLINs). Allowing partial and early deliveries will enable the contractor to optimize production schedules, reduce storage costs, and expedite the overall project timeline. Moreover, this flexibility ensures that the Government can begin utilizing the delivered items sooner, potentially improving operational readiness and reducing the risk of supply chain disruptions. FAR 52.246-2, "Inspection of Supplies—Fixed-Price.“ is Incorporated in Section E by Reference. This clause allows the government to inspect and accept supplies as delivered. By including this clause, the contract accommodates the possibility of early and partial deliveries, as each delivery can be inspected and accepted independently. | Can the Government amend the solicitation to include FAR Clause 52.211-9 and also include the following language: "The Contractor is authorized to make early and partial deliveries of the ordered goods. Each partial delivery must meet the contract specifications and be separately invoiced. The Government will inspect and accept each partial delivery in accordance with FAR 52.246-2, "Inspection of Supplies—Fixed-Price.” | No, specific delivery schedules will be identified in the orders. | |
| 8 | FAR Clause 52.229-3 can address tariff volatility by allowing for price adjustments due to newly imposed or increased federal excise taxes or duties, including tariffs, that the contractor is required to pay. | Can the Government amend the solicitation to include FAR clause 52.229-3 to address tariffs imposed after the contract/task order is awarded which were not foreseeable at the time of contract/task order award? | Yes, the Government can amend the solicitation to include FAR clause 52.229-3. | |
| 9 | The ongoing nature of tariff policies and potential retaliatory measures creates uncertainty for businesses. An economic price adjustment clause tailored to address tariffs ensures that the contract remains fair and equitable by allowing for price adjustments in response to fluctuating tariff rates, thus protecting both the government and contractors from unforeseen financial impacts. This clause enhances the attractiveness of the solicitation to potential bidders, fostering a more competitive environment and potentially leading to better value for the government. | |||
| Can the Government amend the solicitation to include FAR 52.216-4, tailored to specifically address the following concerns regarding tariffs? |
a) Indirect Cost Increases from Tariffs: The clause should account for indirect cost increases resulting from tariffs or increased costs due to tariffs on foreign goods. For example, if a tariff on foreign steel causes the price of domestic steel to rise, the contract price should be adjustable to reflect these changes.
| b) Changes to Labor Rates or Material Unit Prices: The clause should address changes to labor rates or material unit prices listed in the contract schedule. If these changes result in a net increase of at least 3% of the total contract price, an economic price adjustment should be allowable. This ensures that the contract remains fair and equitable despite significant economic changes. | Yes, the Government can amend the solicitaiton to include FAR clause 52.216-4. | |||
| 10 | None | My NIST assessment is current (i.e. not more than 3 years old) but will expire prior to the anticipated award date. Will my proposal be considered for award? | In accordance with DFARS 252.204-7019, in order to be considered for award, the Offeror shall have a current assessment (i.e., not more than three (3) years old unless a lesser time is specified in the solicitation) (see 252.204-7020) for each covered contractor information system that is relevant to the offer, contract, task order, or delivery order. If the Offeror does not have summary level scores of a current NIST SP 800-171 DoD Assessment posted in SPRS, the Offeror may conduct and submit a Basic Assessment for posting to SPRS in the format identified in paragraph (d) of 252.204-7019. Summary level scores for all assessments will be posted 30 days post-assessment in SPRS to provide DoD Components visibility into the summary level scores of strategic assessments. It is incumbent upon the offeror to ensure timely submittals to avoid a lapse in assessments. A NIST assessment that is more than 3 years old renders the offeror ineligible for award consideration. |
