Solicitation No. N62742‐18‐R‐1171 Construction Management Services (CMS) within the NAVFAC Pacific Area of Responsiblity

JL‐6 Questions and Answers

Ques. # Reference (page #, section #, etc.) Question Government Response

1 QUESTION IN REFERENCE TO: JL-2 Safety Data Sheet RFP: L.5 Proposal Requirements, Page 120-121, Factor B

We understand that the proposer has to include the fully burdened rate for each CLIN. If months later, the awardee gets a task order for Australia (a higher cost area), is the awardee bound by those CLIN rates? Or should the offeror provide a blended rate in each CLIN for all geographic areas? That approach might increase pricing.

The last time this question was raised, NAVFAC indicated that a task order can be negotiated with a different rate dependent on location.

Yes, the awardee is bound by the fully burdened rates (by CLIN) that are incorporated into the contract. As noted on the JB-1 & 2 Pricing Schedule, Schedule B tab, "Pricing of Task Orders will be negotiated utilizing rates accepted for the Base Period and each Option Period."

2 QUESTION IN REFERENCE TO: Contract Performance Objective and Overview PWS: Page 7 of 128, paragraph h

Is it correct to assume if NAVFAC requires the contractor to supply office space (construction trailers, etc.) for the personnel that these items would be negotiated at the Task Order level as an ODC versus adding to all labor categories and the entire performance period? See response to Question 9 of Amd 01.

3 QUESTION IN REFERENCE TO: Attachments JB-1 and JB-2 (Price Schedule)

Please consider using a CLIN for mobilization and demobilization costs of staff which would be limited to one (1) change of station to Guam or Australia. This would avoid having to build these costs into labor rates for every option year and result in NAVFAC effectively paying for these costs every year, including staff on-site for multiple years (i.e. mobilization / demobilization costs would have to be recouped for each period of performance since there are not guarantees that option periods would be awarded). Please reference NAVFAC Solicitation N40084-14-R-0090 Enclosure (1) as an example where this similarly applied.

The Government will not be adding a CLIN for mobilization and demobilization. In accordance with the RFP, Section L.5, Volume I

- Price Proposal, Under part (2) Section B, "The hourly rates shall not include travel costs. Travel costs, if required under the Task Order, will be negotiated separately."

QUESTION IN REFERENCE TO: Section J- Supporting Exhibits Clarification RFP: Section L, Page 116-117 of 128, Section L, Volume I Are Supporting Exhibits from Section J of Solicitation to be included in both Part 2 Section B and Part 7 Supporting Cost Data?

Direction is not clear as written.

See Amendment.

Offerors shall complete Schedule B under Part 2.

The JB-1 & 2 Pricing Schedule are supporting worksheets and shall be included under Part 7

QUESTION IN REFERENCE TO: Definition of Teaming Partners and Subcontractors in RFP RFP: Section L, Volume II, Factor A, Section A, Notes for Factor A, Subsection (5), Page 120 or

How does the government define or differentiate Teaming Partner and Subcontractors in the context of this solicitation?

• Typically, Teaming Partners that are not members of a JV, Mentor Protégé Partners, etc. are also subcontractors with executed Teaming Agreements in place to define their subcontractor role on the Offeror’s Team and awarded contract terms flow down to them following successful contract award to Offeror.

The government will review a teaming arrangement to determine if the written agreement involves two or more companies forming a partnership or joint venture to act as a potential prime contractor; or a potential prime contractor agreeing with one or more other companies to have them act as its subcontractors. The RFP indicates circumstances where there is more importance attributed to work performed by members of a prime contractor then to the subcontractors of the prime. Nevertheless, if a company wants to receive credit for the past performance of a subcontractor, the government requires a written agreement establishing the particulars of the agreement including what services the subcontractor would perform for the prime. See Factor A Note 6.

6 QUESTION IN REFERENCE TO: Section J Supporting Exhibits Clarification RFP Section: L, Volume I, Page 116-117/128

Section J, Attachments JB-1 and Summary include Labor and Fringe Benefits amounts from JB-2 listed by Labor Category, but ODCs, IDCs and Profit on Attachment JB-1 are listed as combined totals for all Labor Categories. Schedule B direction however is to include Direct Labor (including Fringe), ODCs, IDCs (including Overhead and G&A) and Profit in the fully burdened HOURLY RATE for each Labor Category. Since the government describes Section J Attachments as “sample format” will the accept modifications to the spreadsheets to incorporate ODCs, IDCs and Profit by individual Labor Category to support HOURLY RATES in Schedule B?

RELEVANT RFP INFO/BACKGROUND

• Under Part (2) Section B (116/128), offerors shall complete Section B and accompanying exhibits from Section J of the solicitation with all Contract Line Item Number (CLIN). Amounts will become the costs effective at contract award.

• In Schedule B, Supplies or Services and Costs/Fees, Offerors shall enter the proposed fully burdened HOURLY RATE for each labor classification listed. Note that the fully burdened hourly rate shall include cost of labor, fringe benefits, and all other costs associated with each labor classification including, but not limited to: FICA, FUTA, SUTA, Worker’s Compensation Insurance, Health Insurance, Overhead, General & Administrative (G&A) expenses, and Profit. The hourly rate shall not include travel costs. Travel costs, if required under the Task Order, will be negotiated separately.

• Under part (7) Supporting Cost Data (117/128), the Price Proposal shall contain a complete detailed cost breakdown for each contract period by Labor Classification and by cost element to support the Section B CLIN amounts. Typical cost elements might include, but are not limited to: direct labor (fully burdened with fringe), other direct cost (ODC), overhead, general and administrative, and profit. Provide supporting worksheets and narrative explanations to fully explain the basis and rationale for the proposed amounts including backup details that can be related to the various segments of your price proposal.

• The Cost Summary Worksheets (Section J, Attachment JB-1) illustrate a sample format of the type of cost breakdown detail requested. In addition to submitting a cost summary worksheet for each contract period, offerors shall submit a Cost Summary Worksheet that provides a grand total roll-up combining all contract periods. Back up details for the cost breakdown worksheets should be detailed by labor classification and cost elements that can be related to the various segments of your Non-cost/price Proposal. Provide tabs or dividers to organize the proposal and use cross-references as necessary to make the proposal easier to follow.

Yes. Offerors are free to modify the SAMPLE worksheets in accordance with their established accounting practices.

7 QUESTION IN REFERENCE TO: JB-1 & 2 Pricing Schedule Page 116 of 128, Under part (2) B and Attachment JB-2 Labor and Fringe Benefits

The development of individual labor rates can be highly dependent on the anticipated hours for that labor category. Is the Government willing to provide an estimate of the hours per labor classification that are expected or is the intent by indicating 1 FTE for proposers to assume each classification is estimated to be full time for a year? Please use 2,080 hours for each labor classification to develop your fully burdened hourly rates.

8 QUESTION IN REFERENCE TO: Staffing and Resources RFP: Page 122 of 128, Factor C- Staffing and Resources Program Manager

The last section of Factor C on page 122 refers to a Program Manager. However, the following paragraphs refer to a Project Manager. Please clarify the difference between the Program Manager and Project Manager or are they synonymous? See Amendment #0002. Correct term is "program manager"

9 QUESTION IN REFERENCE TO: JL-2 Safety Data Sheet RFP: L.5 Proposal Requirements, Page 120-121, Factor B

Attachment JL-2 Safety Data Sheet is not mentioned in Section L Proposal Requirements or Section M Evaluation Factors for Award. Please confirm that this form is required as part of the submission in Factor B, and not Factor C as indicated on Attachment JL-2.

Offeror shall follow Section L. The JL-2 is a template that may be modified for your submittal. Provide DART rates for 2017, 2016, 2015, 2014 and 2013.

10 QUESTION IN REFERENCE TO: JL-2 Safety Data Sheet RFP: L.5 Proposal Requirements, Page 120-121, Factor B

Attachment JL-2 Safety Data Sheet requests information that is not listed in Section M Evaluation Factors for Award. The evaluation criteria in Section M only refers to DART rates as part of the evaluation; it does not mention the other safety data requested in Attachment JL-2. Please confirm which safety data will be used to evaluate offerors in Factor C.

Offeror shall follow Section L. The JL-2 is a template that may be modified for your submittal. Provide DART rates for 2017, 2016, 2015, 2014 and 2013.

11 QUESTION IN REFERENCE TO: JL-2 Safety Data Sheet RFP: L.5 Proposal Requirements, Page 120-121, Factor B

Attachment JL-2 requests safety data for 2012, 2013, and 2014. Please confirm if these years are accurate. In addition, Section L requests DART rates for 2017, 2016, 2015, 2014, and 2013. Should offerors alter Attachment JL-2 to accommodate this information or should this data be provided separately?

Offeror shall follow Section L. The JL-2 is a template that may be modified for your submittal. Provide DART rates for 2017, 2016, 2015, 2014 and 2013.

12 QUESTION IN REFERENCE TO: Notes for Factor A Page 119 of 128, Factor A "Notes for Factor A"

Please confirm that the sentence stating more preference will be given to "projects valued at or over $3-5M range with an aggregate contract value totaling at minimum $36M (phased projects included)" means a project (contract / task orders) for construction management fees at or over $3-5M and that the aggregate contract value of the projects we provide for past performance (minimum 3; maximum 5) totaling at minimum $36M.

The paragraph will be revised as follows: "In addition to projects valued at or over the $3-5M range with an aggregate contract value totaling at a minimum $36M (phased projects included), the government considers past performance more relevant if gained from performing projects in which your company provided construction management services from beginning to end as the PRIME contractor. Project value is defined as the contract value of the construction management services contract, NOT the construction contract value of the projects for which your company provided oversight. Construction management services for this project should include all phases of a project from design review to pre-construction meetings to closeout.

Include scope of work to demonstrate the complexity of the projects. Projects that included the following aspects of construction are considered more relevant: site grading, concrete work, mechanical, roofing, electrical, air conditioning, LEED/sustainable design features, fire sprinkler/fire protection system, telecommunication systems and utility infrastructure (i.e. steam, potable water, electric power, sanitary sewage, storm drain, etc).

13 QUESITON IN REFERENCE TO: JL-2 Safety Data Sheet Page 120 of 128, Factor B Paragraph ai

On page 120 (Factor B) paragraph a. i) (a), cites a requirement DART rates for years 2017, 2016, 2015, 2014, and 2013. However, Attachment JLL-2 Safety Data Sheet only asks for the most recent 3 years. Please clarify. Offeror shall follow Section L. The JL-2 is a template that may be used for your submittal.

14 QUESTION IN REFERENCE TO: Factor C Page 122 of 128, Factor C, Paragraph c Please confirm the requirements cited for "project" manager are intended for the "program" manager. Correct. Factor C should read "program manager". See Amendment #0002.

15 QUESTION IN REFERENCE TO: Factor C Page 122 of 128, Factor C, Paragraph c(1)

On page 122 (Factor C), paragraph c (1) cites a preference for a Bachelor's Degree in Business Administration / Project Management. We are interpreting this to be an oversight as NAVFAC has always placed a great deal of emphasis on procuring professional services utilizing register license professionals or degree engineers and architects for IDIQ that involve facilities design or construction management. Kindly confirm this requirement is an oversight and that the Government’s preference is for a program manager with an engineering, architectural, or construction management degree/background (such as the requirements for Senior Program Manager on page 65).

The scope of this individual's duties is to manage THIS CONTRACT, and the SERVICES that are being provided. The scope of the Senior Program Manager is construction project AND DPRI program assistance/support. They are two separate individuals with different duties and therefore the Government has established different experience requirements. Amendment #0002 will be modified to correct the education requirement and to read "preferably in business administration/ program managment"

16 QUESTION IN REFERENCE TO: Labor Categories PWS: Page 12-78 of 128

Most of the labor categories require both one year experience supporting NAVFAC or USACE projects and the CQM for Contractors class. Would NAVFAC consider revising to require the CQM for Contractors class or one year experience supporting NAVFAC or USACE project?

No. The Government will not equate CQM Certification with "experience in performing the tasks identified herein for Capital Improvements related projects for the NAVFAC or Corps of Engineers." The government is looking for individuals that have worked on NAVFAC or Army Corps of Engineers projects in the past

17 QUESTION IN REFERENCE TO: Organizational conflicts of interest Page 92 of 128, paragraph H14, paragraph €

It is unclear how NAVFAC will evaluate the apparent risk to performance created by conflicts of interest described in. For example, if a small business offeror is a prime in one of the architectural engineering services contracts supporting the DPRI program that would create a higher risk to perform construction management services vs a small business offeror that is not. This risk does not seem to be reflected in the ratings on page 127 paragraph E Adjectival Ratings / Descriptions, Table 1.

Adjectival ratings apply to the assessment of each non-cost/price Factor and have no direct correlation to the evaluation of a potential Organizational Conflict of Interest (OCI). Whether an offeror has an OCI is reviewed on a case-by-case basis in accordance with FAR 9.504(e)

Solicitation No. N62742‐18‐R‐1171 Construction Management Services (CMS) within the NAVFAC Pacific Area of Responsiblity

JL‐6 Questions and Answers

18 QUESTION IN REFERENCE TO: Adjectival Ratings/ Descriptions Page 127 of 128, paragraph E, table 1

Will NAVFAC also evaluate risk associated with technical "capacity" to support the program similar to evaluating financial capacity e.g. current small business N40192- 16-C-0006 NAVFAC Marianas Construction Management Services contract holders’ ability to also prime this large contract? The Government will evaluate Factors A, B and C in accordance with the RFP.

19 QUESTION IN REFERENCE TO: Success Estimator RFP: Page 6, 9 of 128

On pages 6 and 9 of the RFP indicate use of Success Estimator, which is a US Cost estimating software; however, the PWS the Task/Services and Deliverables for each position indicates the use of Costworks, which is an RS Means software. Please confirm which estimating software will be required. Both are required for certain positions. Edits will be made in Amendment #0003. Removed some of the requirements.

QUESTION IN REFERENCE TO: Base Contract PWS- IT Equipment and Software Quantities PWS: Page 6 of 128, Section C, Paragraph D

In order to provide the itemized list of cost elements categorized as Other Direct Costs (ODC) in JB1 and Summary Pricing Schedules as required in Part (7) Supporting Cost Data, request that the government include additional detail in tabular form on which Service Categories will require what specific IT Equipment and Software from the list provided?

• RELEVANT RFP LANGUAGE: The Contractor shall provide stand-alone computers (not connected to the government network), printers, scanners, software, digital camera, web camera, cell phone and other IT equipment and software necessary to support the requirements of the individual SOW.

• Contractor personnel shall be proficient in the use of Microsoft Office and Primavera software. Contractor shall obtain all necessary software and licenses to use software in the performance of a Task Order. The Government anticipates the Contractor shall require the use of the latest versions of Primavera P6, Schedule Analyzer, US Costworks, Success Estimator, MS project, AutoCAD, REVIT, ArcGIS, CM software, and other software.

The awardee will be required to provide work stations to generate written deliverables as specified in the RFP. It is incumbent upon the offeror to determine how to provide necessary supplies and equipment for the work area. The TASK ORDER PERFORMANCE WORK STATEMENT in the RFP establishes the requirements for contractor provided equipment and or software.

QUESTION IN REFERENCE TO: Base Contract PWS- Contractor Provided Work Spaces Requirement- Potential Contradiction in RFP PWS: Page 7 of 128, Paragraph h

Can the government please clarify which direction applies in this case, as the direction provided in the first two sentences of Sub Paragraph h, indicates this “MAY” (in ALL CAPS, which we assume to mean it is significant) be a requirement, and in the remaining sentences of the same sub paragraph, the RFP/PWS states that “the contractor will be required” to provide Contractor Provided Work Space in specific locations

1) Contractors shall provide their own office supplies and equipment. 2) Contractors MAY need to provide a place where their employees are to work out of IF the Government specifically advises them they will NOT be able to fit them in the existing offices o trailers.

QUESTION IN REFERENCE TO: Base Contract PWS- Contractor Provided Work Spaces Clarification PWS: Page 7 of 128, Paragraph h

With regard to Contractor-Provided Work Space, will the government specify how many of the seven potential Field Offices are desired to be priced into the Basic Contract, so we may include in the itemized list of cost elements categorized as Other Direct Costs (ODCs) in JB1 and Summary Pricing Schedules as required in Part

(7) Supporting Cost Data?

IF required, it will be so stated in the RFP at the task order level.

QUESTION IN REFERENCE TO: Section C-Description and Specifications, Basic Contract OWS, Contract Procurement Objective and Overview- How to price common use items PWS: Page 6 of 128, Paragraph c

With regard to Contractor-Provided Vehicles, will the government specify how many vehicles per Field Office are desired to be priced into the Basic Contract, so we ma include in the itemized list of cost elements categorized as Other Direct Costs (ODC) in JB1 and Summary Pricing Schedules as required in Part (7) Supporting Cost Data?

Offeror should specifiy the rate based on a quantity of individuals anticipated. I.e. # of vehicles per employees. If it is 1 to 1, or 4 to 1, that would be the determination of the contractor. State as such when pricing. If the individuals are unable to perform their duties due to insufficient vehicles provided by their employer, the employer would then need to remedy that situation at no additional cost to the Government.

QUESTION IN REFERENCE TO: Construction Safety Overnight Position Clarification- Safety Trained Supervisor (STS) and Certified Safety Professional (CSP) Positions Task Order PWS, Section 7, Page 37/128, Paragraph 1

Can the government clarify how to price the Safety Trained Supervisor (STS) and Certified Safety Professional (CSP) positions since specific Requirements for Certifications and Experience are provided, but the two positions are not included or mentioned in the Tasks or Deliverables as unique positions; should we expect them to be priced differently from the Construction Safety Oversight individual in the Basic Contract or will prices be negotiated by Task Order?

Price the Safety Trained Supervisor (STS) separately from the Certified Safety Professional (CSP). Task Orders will specify either quantities of each or list of projects for which to provide oversight.

QUESTION IN REFERENCE TO: Contract Clearance Requirement PWS: Page 10 of 128, Section C, Security Clearance/Police Check/Driving Record Check, Paragraph 1

Please confirm that this contract is UNCLASSIFIED and it and all associated/issued Task Orders will NOT require any handling of classified information and will not require the prime to hold a Facilities Clearance at any level?

Several sections of the RFP/PWS are in conflict with this requirement and we are unable to assess our ability to prepare and submit a complaint response due to this conflict. Specific examples of conflicting requirement to this include:

• IT/Comms Project Coordinator Services positions(s) are required to have a TS/SCI clearance o (PWS Page 59/128 – Section: Certifications, License, Physical Requirements or Other Expertise Required, Bullet/Para #1)

• Program Manager is required to have SECRET clearance o (PWS Page 122/128 – Section: Factor C – Staffing Resources, Section c, Program Manager, Para #1, last sentence)

This contract is an UNCLASSIFIED contract, however certain individuals will need to work on CLASSIFIED portions of projects or buildings or facilities in order for them to perform their duties and will be required to obtain the necessary CLASSIFIED level of clearance. Information on the need for the clearence will be in the Task Order. The IT/Comms Projet Coordinator Services position must have a TS/SCI clearence at all times. The Program Manager shall possess a Secret Clearance.

26 QUESTION IN REFERENCE TO: Pre-Performance Conference Location Page 104 of 128, Paragraph 3 Please confirm the location of the Pre-Performance Conference required for this contract?
