The Prime (Joint Venture) shall submit a JB‐1 & 2 Pricing Schedule for the Joint Venture's proposed total.

Subcontractors are not required to provide individual rates.

QUESTION IN REFERENCE TO: Volume 1, Price Proposal Page 116/128 Under part (3) Authorized Personnel RFP: Section L.5, Proposal Requirements, Volume I‐ Price Proposal

The RFP states: Under part (3) Authorized personnel, offerors shall provide name, title, email address, phone and facsimile number of the person or persons authorized to negotiate and bind your firm and points of contact within the company should proposal clarifications be required. Offerors shall provide phone numbers and points of contact at the cognizant Defense Contract Management Command Office responsible for contract administration functions (e.g. DCMA Office) and the cognizant Government audit office (e.g. Defense Contract Audit Agency).

Would authorized personnel be required only from the managing partner of a Joint Venture firm or from each of the firms that are a part of the joint venture?

Please clarify if each individual joint venture team member needs to provide Reps and Certs given the requirement of price compliance (overhead disclosure), or if the info is just needed from the JV's managing partner.

If a subcontractor provides a binding agreement would the subcontractor also be required to provide individual Reps and Certs?

In accordance with the RFP, Section L.5 Proposal Requirements, Under part (4) Representations & Certifications, offerors shall complete this information for the established Joint Venture.

Subcontractors are not required to provide individual Representations & Certifications.

QUESTION IN REFERENCE TO: Volume I, Price Proposal PWS: Page 116/128, Under part (5) Financial Capability RFP: Section L.5, Proposal Requirements, Volume I‐ Price Proposal

The RFP states: Under part (5) Financial Capability, offerors shall provide evidence of financial capability. In accordance with FAR 9.104‐1 responsibility determination, a contractor must have adequate financial resources to perform the contract. Offerors shall submit the company's Dun & Bradstreet number (DUNS) and provide the latest three (3) years complete fiscal year financial statements for the prime contractor , certified by an independent accounting firm, if practicable or at least by an authorized officer of the organization. In addition to the above, submit evidence of availability of working/operating capital, which will be used for the performance of the resultant contract. For Joint Venture arrangements discuss the financial responsibilities among the companies. If the Joint Venture has been in existence for less than three years, also provide the latest three years complete fiscal year financial statements for each member of the Joint Venture.

If a subcontractor provides a binding agreement would the subcontractor also be required to provide individual Financial Capabilities?

Subcontractors are not required to provide evidence of financial capability.

QUESTION IN REFERENCE TO: Volume I, Price Proposal Page 117 of 128, Under part (7) Supporting Cost Data RFP: Section L.5, Proposal Requirements, Volume I‐ Price Proposal

Under part (7) Supporting Cost Data, the Price Proposal shall contain a complete detailed cost breakdown for each contract period by Labor Classification and by cost element to support the Section B CLIN amounts. Typical cost elements might include, but are not limited to: direct labor (fully burdened with fringe), other direct cost (ODC), overhead, general and administrative, and profit.

Provide supporting worksheets and narrative explanations to fully explain the basis and rationale for the proposed amounts including backup details that can be related to the various segments of your price proposal.

Would other direct costs such as employee housing, home trips, site office, computers for employees, cell phones, software, camera, printers/scanners, vehicles, etc., be negotiated at the individual task order level?

Burdening the initial unit cost with direct cost that may be spread across multiple resources (such as field office cost) may portray a distorted picture of the desired unit cost to be used in the cost evaluation.

Other direct costs directly related to the labor category shall be proposed at the contract level. However, any ODCs that are dependent on the scope of work and/or location shall be proposed at the individual task order level.

QUESTION IN REFERENCE TO: Volume II Non‐Cost/Price Proposal Page 121 or 128 Factor B Occupational Safety RFP: Section L.5 Volume II‐ Non Cost/Price Proposal

Will DART rates be required from subcontractors if the subcontractor provides a binding agreement?

Also, if the offeror elects to appoint safety personnel to the project staff from a subcontractor's staff would the subcontractor be required to provide DART rates?

Yes to both questions.

JL‐5 Questions and Answers

QUESTION IN REFERENCE TO: Performance Work Statement‐ Contract Procurement Objective and Overview PWS: Page 7 of 128 RFP: h. Contractor provided work space

The RFP states: “The contractor is to provide work spaces to include utilities, phone and internet services, furniture, and facility maintenance for the contracted staff on Government property as designated by the Contracting Officer’s (KO) designated representatives. The Government MAY require in a Task Order that the contractor provide a field office. Contractor provided shall meet the requirements of the UFGS 01 50 00 for temporary office space. Field offices shall be a minimum of 1600 sq. ft. All field offices provided by the contractor shall reserve therein 150

sq. ft. of lockable private office space with two workstations complete with telephone and hard‐lined internet service for use by Government personnel. It is anticipated that the contractor will be required to provide field offices for contracted staff in the following locations (Naval Base Guam, Andersen Air Force Base, Marine Corps Base Finegayan, Regional Officer in Charge of Construction (ROICC) Aviation project(s) (future), ROICC Barracks project(s) (future) ROICC Tinian project(s) (future), ROICC Australia project(s) (future)) unless it is in the best interest of the Government to provide the facilities at these locations. Contractor may elect to house its supervisory staff at one or more of the on‐site work places.”

Are we to price a Field Office at each of the designated locations as part of the Proposal?

a) Naval Base Guam

b) Andersen AFB

c) Marine Corps Base Finegayan

d) ROICC Aviation Projects (location?)

e) ROICC Barracks Projects (location?)

f) ROICC Tinian Projects

g) ROICC Australia Projects (Darwin?)

No, do not price field offices at each of the designated locations as part of your proposal. If the government determines it is in its the best interest, the government will advise the contractor to provide a proposal for the field office as part of a task order.

QUESTION IN REFERENCE TO: Performance Work Statement‐ Positions Required PWS: Page 12‐78 of 128 RFP: Positions Required

As described in the RFP, most positions state that they "Be a United States citizen. The government may approve the assignment of foreign nationals to select positions on a particular task order."

Can we assume the government will approve the use of foreign nationals on a task order basis? Can the government provide more specific guidance regarding the use and pricing of foreign nationals, for example should we assume that a percentage of our staff could be foreign nationals?

No. Price the RFP using United States Citizens ONLY. Task orders will specify at that time which positions and which projects will allow the assignment of foreign nationals based on the security restrictions of each construction project.

QUESTION IN REFERENCE TO: Performance Work Statement‐ Positions Required PWS: Page 25 of 128 RFP: 3. Scheduler Services. CERTIFICATIONS, LICENSE, PHYSICAL REQUIREMENTS OR

OTHER EXPERTISE REQUIRED.

While the Scheduler is required to be able to obtain security clearance, the requirements do not mention that the individual needs to be a US citizen, which is a requirement for obtaining clearance. Please clarify that the Scheduler would be required to be a US citizen.

Yes the Scheduler shall be able to travel and possess a passport and shall be a United States citizen. The Government may approve the assignment of foreign nationals to select positions on a particular task order. Revisions will be made in Amd 0002.

QUESTION IN REFERENCE TO: Performance Work Statement‐ Positions Required PWS: Page 57 of 128 RFP: 14. Information Technology/ Communications Project Coordination Services.

CERTIFICATIONS, LICENSE, PHYSICAL REQUIREMENTS OR OTHER EXPERTISE REQUIRED.

While the first bullet specifies that this position requires a Top Secret (TS) Special Compartmental Information (SCI) clearance, the last bullet states that "The Government may approve the assignment of foreign nationals to select positions on a particular task order." These two requirements seem to be in conflict‐ please clarify.

RFP is revised to reflect only the Top Secret (TS) Special Compartmental Information (SCI) clearance. Allowance to approve the assignment of a foreign national is removed. See revisions in Amd 0002.

QUESTION IN REFERENCE TO: L.5 Proposal Requirements RFP: Proposal Requirements

Under heading Section L.5 Proposal Requirements the volume and sections described do not follow the sections covered in the RFP. Please clarify the content of Volume II‐ Non Cost/Price Proposal, which the RFP states will include Factors A, B, C, and D.

What is Factor D? It seems to be missing from the RFP.

There is no Factor D. Section L is corrected in Amd 0002 to remove any reference to Factor D.

QUESTION IN REFERENCE TO: Section M Evaluation Factors for Award RFP: SELECTION FACTORS/ BEST VALUE SELECTION, A. Selection Factors/Best Value Selection, Item 3

Will there be an interview as part of the selection process? Item 3 implies there will be no interview. No interview.

QUESTION IN REFERENCE TO: Volume II, Non‐Cost/Price Proposal Page 119 of 128 Factor A Past Performance, Notes for Factor A (1) RFP: Section L.5, Proposal Requirements, Volume II‐ Non‐Cost/Price Proposal

The RFP states: Projects submitted for the Offeror must have been completed or in progress within five (5) years of the proposal due date of this solicitation.

What is the minimum completion level of a project in progress to be considered as a relevant example?

Per Factor A: Projects submitted for the offeror must have been completed or substantially complete within five (5) years of the proposal due date of this solicitation. “Substantially Complete” is defined as the project being at least 80% complete.

QUESTION IN REFERENCE TO: Volume II Non‐Cost/Price Proposal Page 119 of 128 Notes for Factor A, subparagraphs (1), (2), and (3) RFP: Section L.5 Proposal Requirements, Volume II‐ Non‐Cost/Price Proposal, Factor A Past Performance

The RFP identifies 21 distinct services that may be included in a task order to demonstrate offeror experience. Recent relevant projects should ideally include cumulatively demonstrate all 21 distinct services. Note 3 for Factor A states that a project must be a stand‐alone contract or single task order under an IDIQ contract. Considering the unlikely situation where a single project will include all 21 distinct services. Please consider increasing the allowable number of project examples to 10 projects so that offerors have a greater chance of presenting projects that cover the broad services that are considered relevant.

No. Number of project examples will remain at 5. Requirement is to prove that the company proposing has employed many construction service experts on large projects to demonstrate that it has the capacity and the contractual relationships in place to acquire the range of expertise the Government is looking for.

JL‐5 Questions and Answers

QUESTION IN REFERENCE TO: Volume II Non‐Cost/Price Proposal Page 119 of 128 Factor A Past Performance, Notes for Factor A (3) RFP: Section L.5 Proposal Requirements, Volume II‐ Non‐Cost/Price Proposal

The RFP states: (3) Projects must be stand‐alone contracts or task orders, performed within the past five (5) years preceding the closing date for receipt of proposals. Projects must demonstrate the ability to perform the proposed effort. The Offeror must demonstrate the type and number of required specialized oversight services it has performed. Establishing that an Offeror held a basic IDIQ contract for construction support services alone does not establish the ability to perform the particular types of construction support services required under this solicitation.

Each past IDIQ contract can be procured differently. For example some may award large task orders, while some will issue their task orders under a dollar threshold that matches the warrant of their individual contracting officer. Setting a $3M to $5M minimum limit to task orders that can be cited as example may limit our ability to feature similar IDIQs that in totality exceeded $100M in fee but had no individual task orders that exceeded $3M.

Further given the one year funding limitation many of our task orders such as Scheduling were renewed on a yearly basis where the scope remained identical, was performed by the same staff for the same program and the same client but none of the yearly task orders exceed $3M while the totality of the scope exceeded $10M in aggregate.

Please consider allowing multiple task orders that make up a large program be submitted as one project description, as long as all tasks performed under the Program IDIQ was performed at the same location for the same program for the same client.

Those proposing must prove that they are able to handle the magnitude of this program.

IDIQ contracts may be considered, providing the contractor proposing is able to prove the scope of work is relavent to this RFP. IDIQs with an aggregate contract value at or over the $3‐5M range will be considered.

QUESTION IN REFERENCE TO: Volume II Non‐Cost/Price Proposal PWS: Page 122 of 128 Factor C‐ Staffing and Resources RFP: Factor C‐ Staffing and Resources, c. Program Manager Resume

The RFP states: c. Provide a resume and letter of intent for the Program Manager. The Program Manager is considered Key Personnel. If an Offeror is proposing to hire a Program Manager(s), Offeror must explain how it plans to acquire such specialized individual(s) including such things as incentives to encourage the move to a remote location. If Offeror has acquired program management personnel on past projects at remote locations please explain the methods used to successfully acquire the personnel that will be applied under this solicitation.

The RFP instructs the offeror to provide a resume for a Program Manager. However in the paragraphs following this individual is referred to as the Project Manager. What is the correct title and role for this individual?

Is this a priced position?

Please clarify how this position is different from the description of position #16 (page 63 of 128) Senior Program Manager.

Correct title is Program Manager. See revisions in Amd 0002.

QUESTION IN REFERENCE TO: Volume II Non‐Cost/Price Proposal PWS: Page 122 of 128 Factor C‐ Staffing and Resources RFP: Factor C‐ Staffing and Resources, c. Program Manager Resume

The RFP does not have any requirements for featuring resumes for anyone else but the "Program Manager". The RFP refers to the identification of "Key Personnel" [section H.4 Key Personnel RFP page 90 of 128] however it does not allow for submission of resumes or identification of any other personnel but the "Program Manager".

In H4 Key Personnel, the RFP also indicates "Prior to replacing any of these key personnel, the contractor shall obtain written consent of the contracting officer. In order to obtain this consent, the contractor must provide advance notice of the proposed changes and must demonstrate that the qualifications of the proposed substitute personnel are generally equivalent to or better than the qualifications of the personnel being replaced within 15 days in advance of the substitution." However, the RFP does not specify where to feature or evaluate the qualification of our proposed staff.

Are any additional resumes required as part of the proposal submission to address the capabilities of team members described in the Task Order Performance Work Statement (starting on page 12 of 128)?

No additional resumes beyond the one required for the Program Manager need to be submitted with the proposal. Offerors were provided detailed Performance Work Statements for the other positions in order to inform as to the capabilities and experience expected of personnel that the government may seek in its task orders and to assist you in determining how to price the cost of such services.

QUESTION IN REFERENCE TO: Volume II Non‐Cost/Price Proposal PWS: Page 120 of 128 Factor A Past Performance, Notes for Factor A (5) RFP: Section L.5 Volume II‐ Non‐Cost/Price Proposal

Under Volume II Non‐Price Proposal, under Factor A Past Performance, Notes for Factor A(5) [RFP page 120] stipulates that "The Government will ONLY consider the Prime Contractor's past performance as a subcontractor where the Prime Contractor provides, in its proposal, evidence of a binding teaming agreement or other contractual agreement which creates legal responsibility such as a teaming agreement with another qualified contractor."

Please define what would represent an acceptable "binding agreement." What documentation would constitute a subcontractor's commitment to the project and legal accountability?

Would an executed subcontract (with the stipulation if the Prime is awarded with the contract) represent an acceptable "binding agreement" or a signed Teaming Agreement is sufficient to demonstrate the required commitment. This is important given the subjective nature of the current requirement for the consideration of a subcontractor's qualification.

In order to receive credit for past performance on a project by a company that is not the prime contractor (or a part of a joint venture acting as the prime contractor), the company must demonstrate it was legally bound to perform the services for which it seeks credit for past performance. Sub contractors must establish legal responsibility through a written agreement executed by representatives of the prime and subcontractor companies that specifically states the services the subcontractor agrees to perform for the prime. Note that the subcontractor will only be given credit for past performance of the particular services set out in the agreement. The agreement must be dated prior to completion of the execution of the project.

QUESTION IN REFERENCE TO: Volume II Non‐Cost/Price Proposal PWS: Page 121 of 128 Factor C‐ Staffing and Resources RFP: Factor C‐ Staffing and Resources‐ General

Can the services of Design Support and BIM be performed from home offices in the continental US or with limited staff in Guam and use of reach back capacity and capability from main land US?

The Government requires that the offeror have employees working on location near the construction. Response time for Design Support Services is critical. Should an offeror decide to perform the BIM services in the continental US with limited staff in Guam, the response of on‐site staff is expected to be within a 2 hour window based on Guam's working hours. NOTE: if the service is required in Australia, the response time must occur within a 2 hour window during Australia's working hours.

File details come from the government source that posted it.
