Liquidated Damages

(a) General

In accordance with DFARS clause 252.217-7009 "Default" paragraph (f), if the Contractor fails to complete the work within the time specified, or any extension, in the contract, the Government will suffer damages. These damages include, but are not limited to, extended lodging, meals, and incidental expenses for Government personnel required to remain at the OCONUS performance location. These actual damages would be difficult to estimate accurately or prove. Therefore, in lieu of actual damages, the Contractor shall pay the Government liquidated damages for each calendar day of delay. The current liquidated damages for each calendar day of delay is $16,386.92 which uses a blended average per diem rate of possible place of performance locations within the 7th Fleet AOR.

(b) Establishment of Final Rate at Award

This solicitation does not contain a final liquidated damages daily rate. The Contracting Officer will establish the final, fixed daily rate at the time of contract award using the per diem rate of the awarded place of performance. Prior to award, the Contracting Officer will calculate the liquidated damages daily rate based on the official per diem rate for Place of Performance in effect on the date of award, as published by the U.S. Department of State in the Department of State Standardized Regulations (DSSR), Section 925. The official source for these rates is the Department of State website, currently located at https://allowances.state.gov/web920/per_diem.asp.

(c) Incorporation into the Contract

The final, calculated daily liquidated damages rate will be referenced in the explanatory note of Section I regarding the liquidated damages rate applicable to the clause DFARS 252.217-7009, Default, in the awarded contract. By submitting an offer, the offeror acknowledges and agrees to this methodology for establishing the liquidated damages rate.
