AMENDMENT 0004
The purpose of Amendment 0004 is to:
1. Answer the following requests for information submitted in response to N62473‐24‐R‐3204.
a. Question: We note the differentiation between Native American Monitoring ELINs for Construction and Native American Monitoring ELINs for Survey, did or would the Navy consider instead issuing separate ELINs for the “Survey-Only” and Recordation tasks to include survey with Native American Monitors and survey without Native American Monitors? The larger cost in adding Native American monitors to surveys are associated with changes to the expected survey pace and therefore accounting for this using a daily or weekly rate is more difficult.
Answer: The Navy is not considering the issuing separate ELINs for the “Survey-Only” and Recordation tasks to include survey with Native American Monitors and survey without Native American Monitors.
There is now an ELIN for Daily / Weekly Native American Survey Monitoring. The Navy intends this ELIN to cover Native American monitoring requirements on those surveys that require a Native American monitoring. Additionally, for a survey that may require Native American monitors, the Navy cannot predict how many monitors will be required from any number of Tribes that have a reason to participate in the survey. The Navy anticipates that based on the plausible variability in the number of monitors required for a proposed survey, combined with the number of individual tribes represented by those monitors, that ELINs for “Survey-Only” and Recordation tasks to include survey with Native American Monitors cannot be accurately or sustainably costed. The purpose of Daily / Weekly Native American Survey Monitoring is to allow the contractor the opportunity to account for cost and pace variables in the use of Native Americans during survey and cost that effort discretely, and for the Navy to adjust the level of effort and services procured relative to the specific requirements of any given survey.
b. Question: Is it a requirement for award to have, on file, at each establishment, affirmative action programs required by the rules and regulations of the Secretary of Labor? This is a question from Form J2.
Answer: It is not required to already have affirmative action programs in place in order to be eligible for award. However, Offerors must make a representation in Attachment J-2 Provision 52.222-25 Affirmative Action Compliance (APR 1984). In addition, during the execution of the contract, Contractors must abide by FAR 52.222-26 Equal Opportunity (SEP 2016), which is included in this contract.
c. Question: Could the Government confirm that the Subcontractor Letter of Commitment and Proposed Subcontracting Agreement should be included in Vol II: Tab C/Factor 3 Corporate Experience and that these documents should be submitted after the Project Data Sheets?
Answer: Yes, if Subcontractor Letter of Commitment and Proposed Subcontracting Agreements are applicable, they should be included in Vol II: Tab C/Factor 3 Corporate Experience after the Project Data Sheets. Section L has been updated to reflect this change.
d. Question: Although this submittal is electronic, submittal volumes are divided into separate tabs. Would the inclusion of digital “tab dividers” count against specified page totals for a given section?
Answer: No. The inclusion of digital “tab dividers” will not count against the page totals.
e. Question: Pg 39: Tab C: 1) states “Offerors shall submit the Price Proposal… in electronic spreadsheet format (Microsoft Excel) and PDF file displaying each proposed price.” However, Pg 36: Section L 1.a states “Volume 1 shall be submitted in Microsoft Word and Excel spreadsheet software formats”. Given that most of Volume 1 is comprised of PDF files (e.g., SF 33, Section B Services, ELINS PDF, and Financial Questionnaire) would the Government accept a searchable PDF submittal of Volume I to allow for sequential numbering of all volume requirements? It is understood a separate Microsoft Excel version of the ELINS would still need to be submitted.
Answer: Yes, Offerors may submit a searchable PDF for Volume I. However, the J-1 Pricing Spreadsheet must still be submitted in a separate Microsoft Excel version. Section L has been updated to reflect this change.

SECTION L - INSTRUCTIONS, CONDITIONS AND NOTICES TO BIDDERS
The following have been modified:
INSTRUCTIONS TO OFFERORS
1. General: Proposals submitted in response to the solicitation shall be formatted as follows and furnished in the number of copies stated herein. Any proposal submitted that does not conform to the proposal submission requirements will not be considered.
a. Offerors shall submit one (1) proposal electronically to the Procurement Integrated Enterprise Environment (PIEE) website in the Solicitation Module at https://piee.eb.mil/pieelanding/. The proposal shall be compatible with PDF, Microsoft Word and Excel spreadsheet software formats and be virus free. Volume 1 may be submitted in a searchable PDF, with the exception that the J-1 Price Proposal Spreadsheet Exhibit Line Items must be submitted in an Excel spreadsheet format. Volume 2 may be submitted in a searchable PDF; however, Volume 1 shall be submitted in Microsoft Word and Excel spreadsheet software formats. All Excel spreadsheet formulas must be readable.
b. Volume one (1) shall contain the offeror’s Price proposal and Volume two (2) shall contain the offeror’s Non-Cost/Price Factors proposal.
c. Table of Contents: A master table of contents for the entire proposal and a table of contents for each volume are required. The master table of contents for the entire proposal should be filed in Volume One (1) and will not count towards the page count. The table of contents page for each volume will not count towards the page count.
VOLUME ONE (1), PRICE PROPOSAL, AS FOLLOWS:
GENERAL: Cover letter: The cover letter shall include the Offeror information identified in FAR Clause 52.215-1, paragraph (c) (2) subparagraphs (i-v) – Instructions to Offerors – Competitive Acquisition (JAN 2004). The cover letter is not included in the total page count.
TAB A: Offerors shall include Standard Form (SF) 33 (Solicitation, Offer and Award), page (1) with blocks 12-18 completed. The offeror shall provide their offeror’s CAGE and UID number in block 15A of the SF33. Offerors should mark Block 12 with at least 180 calendar days; if the offeror marks the offer for a period less than 180 calendar days, then the Government reserves the option to exclude the offer from consideration for award.
TAB B: Offerors shall include Section B of the RFP, Supplies or Services and Prices, providing an overall grand total proposed price for the entire contract (includes the Base Period, Two Two Year Option Periods, One Three Year Option Period, and the six-month option period associated with 52.217-8 clause).
TAB C: Offerors shall include the Price Proposal Spreadsheet Exhibit Line Items (ELINS) (A through I) of the RFP, in electronic (Microsoft Excel) format. All of the formulas must be readable in the Excel Spreadsheet format.
TAB D: Offerors shall include their companies’ Representations and Certifications (Attachment J-2), (from Section K of the Solicitation) and their Financial Questionnaire (Attachment S-2).

d. The text size shall be no less than Times New Roman, 10-point Font, with the exception of reproduced sections of the solicitation document, charts and graphs. Use at least 1-inch margins on the top and bottom and side margins, except for charts, graphs, maps and other illustrations and Excel spreadsheets.
e. Pages shall be numbered sequentially by volume. Legible tables, charts, graphs, and figures shall be used wherever practical to depict organizations, systems and layout, implementation schedules, plans. These displays shall not exceed 11 X 17 inches in size. Foldout pages shall fold entirely within the volume, and may only be used for large tables, charts graphs, diagrams and schematics. Page limitations must be adhered to when stipulated.
f. Electronic mail (email) proposals will not be accepted. Only proposals submitted via the PIEE Solicitation Module at https://piee.eb.mil/pieelanding/ will be accepted.
g. Offerors shall ensure that proposals are virus free, and free of password protection. If access to proposal data is prohibited due to viruses, passwords, or wrong format, the proposal may be rejected.
2. Offerors are advised that the proposals are “For Official Use Only” and they are considered Source Selection Sensitive Information, see FAR 2.101 & 3.104 for further details.
3. Offerors should allow themselves sufficient time to meet the RFP delivery date/time schedule including access to the PIEE Solicitation Module website at https://piee.eb.mil/pieelanding/.
4. Requests for Information (RFI): Offerors may submit questions for answers, and requests for clarification, using the RFI Data Sheet provided as Attachment S-1, prior to March 26, 2024, by no later than 10:00 AM PDT, to the email linde.y.heinrich.civ@us.navy.mil. The offeror must delineate any RFI into clear questions / descriptions, and the RFI must indicate solicitation section, paragraph, and page number to be acceptable; the Government may decline to respond to the RFI if it is unclear for a response as submitted. Each submittal must indicate the solicitation number and purpose (“RFI”) in the email subject line, and each submittal attachment must record the offeror’s official company name, DUNS and CAGE code, and the point of contact of the company. Attachments in excess of 1MB may not be received, and so may not be reviewed. Any responses to RFI will be recorded publically in amendments to the solicitation; private RFI inquiries will not be entertained for this Government solicitation.
