PHASE 1 / FACTOR 2: CONSTRUCTION EXPERIENCE

Paragraph 6, page 15 of 115

Would you consider changing the relevant project completion deadline for similar experience from projects completed within the past seven (7) years to projects completed within the past ten (10) years?

Other; Please specify in the next columnMore firms would be able to respond if the time frame were open to 10 years instead of the current 7 years.ContractingRelevant project completion deadline for this Solicitation will remain at seven (7) years.10/12/2110/18/21N/A

11If "Others" - include info under Column E Clarification RequestFactor 2 Construction Experience, subparagraph (b) Basis of Evaluation states that “Offerors who submit relevant construction projects that best demonstrate self-performed (see definition) experience on projects that are similar in size, scope, and complexity to projects that may be ordered under this contract may be considered more favorably than those that do not.” The definition referenced therein is in Section 00210 – Basis of Award and Evaluation Factors, Section 2 – and states “Refers to performing relevant and major construction trade work in-house without subcontractors. This does not include project administration or management functions (such as quality control or safety program) and miscellaneous work (such as housekeeping or cleanup). Relevant and major construction trade work is that which is the same or similar to the work that may be ordered under this contract.”

This definition is not consistent with the definition in FAR 36.501 which states that “To assure adequate interest in and supervision of all work involved in larger projects, the contractor shall be required to perform a significant part of the contract work with its own forces.” And which further states that “Specialties such as plumbing, heating, and electrical work are usually subcontracted, and should not normally be considered in establishing the amount of work required to be performed by the contractor.”

Will the Navy please revise the definition of self-performance to align with FAR 36.501?

Conflicting InformationContractingThere is no conflict between . The evaluation factors and evaluation of the proposal is separate from the work to be performed in the future under this contract. Factor 2, Construction Experience, is looking more favorably at past projects, where the contractor self-performed. The Government wants to see projects that the contractor performed itself, not projects on which it subcontracted out the work. This is different and distinct from the “self-performance” required under the contract to be awarded.10/17/2110/20/21N/A
12If "Others" - include info under Column E Clarification RequestEXHIBIT “A” OFFEROR TEAM COMPOSITION AND MANAGEMENT instructions state to "Modify form as necessary to include all primary construction and design team members." Would the Government please confirm that design team member information is neither requested nor desired?
Conflicting InformationContractingDesign Team member information is not requested.10/17/2110/20/21N/A
13Part 2Chapter-2FACTOR 2Page 15 of 115 of the Phase 1 Solicitation states that Construction Experience projects submitted by the Offeror shall be 100% complete within the past seven (7) years of the date of issuance of this RFP. To provide the Government with the most relevant example projects for consideration, and to best respond to the intent of this solicitation, we would like to include Naval Hospital Camp Pendleton project, a highly relevant medical facility project for NAVFAC that Clark successfully delivered six months ahead of the date specified in the government’s solicitation. The contract documents specified a completion date of 1/7/14 with a warranty extending to 1/7/15, however our early completion pulls those dates forward. Please confirm the Camp Pendleton Hospital project may be included as one of our relevant experience projects based upon the contractual completion dates noted above.Other; Please specify in the next columnEnables inclusion of highly relevant similar projectContractingPer RFP Part 2 Factor 2, Relevant projects are projects that have been completed in the past seven (7) years.10/19/2110/26/21N/A
14If "Others" - include info under Column E Clarification Requestif Others include info under Column ESection 00100, Phase One Basis of Evaluation/Submission Requirements/Criteria Description, Factor 2: Construction ExperienceThe estimated task order range for this procurement is $15M to $100M. At the same time, the Government requests that Construction Experience be demonstrated with a minimum project value of $15M and 35,000 square feet (Factor 2, Page 15). This minimum project value is difficult for small business contractors in this NAICS code ($39.5M annual revenue) to meet, potentially making this unduly restrictive of competition. If the Government has concluded that a $15M project is relevant experience for the entire range of this procurement (that is, projects up to $100M), then a project of a lower value would be equally relevant for most of the range. In order to allow small business contractors in this NAICS code a reasonable opportunity to compete, we respectfully request that the Government reduce the minimum project value to $10M.Other; Please specify in the next columnSmall Business Opportunity to CompeteOther/UnsureMinimum task order dollar value will not be revised under this MACC.10/21/2110/26/21N/A
15If "Others" - include info under Column E Clarification Requestif Others include info under Column ESection 00100, Phase One Basis of Evaluation/Submission Requirements/Criteria Description, Factor 2: Construction ExperienceThe Government requests that Construction Experience be demonstrated using at least one project with a construction cost of $50M (Factor 2, Page 15). In this NAICS code, this minimum requirement all but eliminates small business competition. One project at this level would go a long way toward eliminating a contractor's small business status in this NAICS code. In order to ensure that small businesses can fully compete for this procurement, we respectfully request that the construction cost minimum for this requirement be reduced to $25M.Other; Please specify in the next columnSmall Business Opportunity to CompeteOther/UnsureConstruction Experience requirements will not be revised under this MACC.10/21/2110/26/21N/A
16If "Others" - include info under Column E Clarification Requestif Others include info under Column ESection 00100, Phase One Basis of Evaluation/Submission Requirements/Criteria Description, Factor 2: Construction ExperienceFactor 2, Page 15 indicates that the definition of medical treatment facilities is "hospitals, ambulatory care centers, medical and dental clinics, and medical research laboratories." Please clarify that this definition includes facility support systems, and that these facilities, as part of the medical treatment facility, can be considered new construction.Intent needs clarificationOther/UnsureGovernment cannot advise on project relevancy without assessing the full scope of the project.10/21/2110/26/21N/A
17If "Others" - include info under Column E Clarification Requestif Others include info under Column ESection 00100, Phase One Basis of Evaluation/Submission Requirements/Criteria Description, Factor 2: Construction ExperienceFactor 2, Page 15, requires two projects for renovation and three projects for new construction. To enhance and increase competition, we respectfully request the Government merge the new construction and renovation requirements, due to the common traits and similar complexities/requirements of both at this dollar value, to allow offerors to present five projects that are either new construction or renovations.Other; Please specify in the next columnSmall Business Opportunity to CompeteOther/UnsureA single project may satisfy more than one of the Factor 2 minimum submission requirements. Minimum submission requirements will not be revised.10/21/2110/26/21N/A
