(b) Submission of offers. Submit signed and dated offers to the office specified in this solicitation at or before the exact time specified in this solicitation. Offers may be submitted on the SF 1449, letterhead stationery, or as otherwise specified in the solicitation. As a minimum, offers must show--

(1) The solicitation number;

(2) The time specified in the solicitation for receipt of offers;

(3) The name, address, and telephone number of the offeror;

(4) A technical description of the items being offered in sufficient detail to evaluate compliance with the requirements in the solicitation. This may include product literature, or other documents, if necessary;

(9) Acknowledgment of Solicitation Amendments;

(10) Past performance information, when included as an evaluation factor, to include recent and relevant contracts for the same or similar items and other references (including contract numbers, points of contact with telephone numbers and other relevant information); and

(11) If the offer is not submitted on the SF 1449, include a statement specifying the extent of agreement with all terms, conditions, and provisions included in the solicitation. Offers that fail to furnish required representations or information, or reject the terms and conditions of the solicitation may be excluded from consideration.

(c) Period for acceptance of offers. The offeror agrees to hold the prices in its offer firm until 31 October 2018 from the date specified for receipt of offers, unless another time period is specified in an addendum to the solicitation.

(d) Product samples. When required by the solicitation, product samples shall be submitted at or prior to the time specified for receipt of offers. Unless otherwise specified in this solicitation, these samples shall be submitted at no expense to the Government, and returned at the sender's request and expense, unless they are destroyed during preaward testing.

(e) Multiple offers. Offerors are encouraged to submit multiple offers presenting alternative terms and conditions, including alternative line items (provided that the alternative line items are consistent with subpart 4.10 of the

Federal Acquisition Regulation), or alternative commercial items for satisfying the requirements of this solicitation.

Each offer submitted will be evaluated separately.

(f) Late submissions, modifications, revisions, and withdrawals of offers:

(1) Offerors are responsible for submitting offers, and any modifications, revisions, or withdrawals, so as to reach the Government office designated in the solicitation by the time specified in the solicitation. If no time is specified in the solicitation, the time for receipt is 4:30 p.m., local time, for the designated Government office on the date that offers or revisions are due.

(2)(i) Any offer, modification, revision, or withdrawal of an offer received at the Government office designated in the solicitation after the exact time specified for receipt of offers is “late” and will not be considered unless it is received before award is made, the Contracting Officer determines that accepting the late offer would not unduly delay the acquisition; and--

(A) If it was transmitted through an electronic commerce method authorized by the solicitation, it was received at the initial point of entry to the Government infrastructure not later than 5:00 p.m. one working day prior to the date specified for receipt of offers; or

(B) There is acceptable evidence to establish that it was received at the Government installation designated for receipt of offers and was under the Government's control prior to the time set for receipt of offers; or

(C) If this solicitation is a request for proposals, it was the only proposal received.

(ii) However, a late modification of an otherwise successful offer, that makes its terms more favorable to the

Government, will be considered at any time it is received and may be accepted.

(3) Acceptable evidence to establish the time of receipt at the Government installation includes the time/date stamp of that installation on the offer wrapper, other documentary evidence of receipt maintained by the installation, or oral testimony or statements of Government personnel.

(4) If an emergency or unanticipated event interrupts normal Government processes so that offers cannot be received at the Government office designated for receipt of offers by the exact time specified in the solicitation, and urgent

Government requirements preclude amendment of the solicitation or other notice of an extension of the closing date, the time specified for receipt of offers will be deemed to be extended to the same time of day specified in the solicitation on the first work day on which normal Government processes resume.

(5) Offers may be withdrawn by written notice received at any time before the exact time set for receipt of offers.

Oral offers in response to oral solicitations may be withdrawn orally. If the solicitation authorizes facsimile offers, offers may be withdrawn via facsimile received at any time before the exact time set for receipt of offers, subject to the conditions specified in the solicitation concerning facsimile offers. An offer may be withdrawn in person by an offeror or its authorized representative if, before the exact time set for receipt of offers, the identity of the person requesting withdrawal is established and the person signs a receipt for the offer.

(g) Contract award (not applicable to Invitation for Bids). The Government intends to evaluate offers and award a contract without discussions with offerors. Therefore, the offeror's initial offer should contain the offeror's best terms from a price and technical standpoint. However, the Government reserves the right to conduct discussions if later determined by the Contracting Officer to be necessary. The Government may reject any or all offers if such action is in the public interest; accept other than the lowest offer; and waive informalities and minor irregularities in offers received.

(h) Multiple awards. The Government may accept any item or group of items of an offer, unless the offeror qualifies the offer by specific limitations. Unless otherwise provided in the Schedule, offers may not be submitted for quantities less than those specified. The Government reserves the right to make an award on any item for a quantity less than the quantity offered, at the unit prices offered, unless the offeror specifies otherwise in the offer.

52.212-2 EVALUATION

52.212-2 EVALUATION--COMMERCIAL ITEMS (OCT 2014)

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered.

1. The following factors shall be used to evaluate offers:

Factor 1 – Recent, Relevant Experience of the Firm

Factor 2 – Management Approach Factor 3 – Safety Factor 4 – Past Performance on Recent, Relevant Projects http://www.sam.gov/ https://www.acquisition.gov/

Note: The distinction between experience and past performance is that experience pertains to the volume of work completed by a offeror that are comparable to the types of work described under the definition of recent, relevant projects, in terms of size, scope, and complexity. Past performance pertains to both the relevance of recent efforts and how well a offeror has performed on the contracts.

2. The relative order of importance of the non- price evaluation factors is the technical factors (Factor 1, 2, and 3) are of equal importance to each other and, when combined are equal in importance to the past performance evaluation/performance confidence assessment factor (Factor 4). When the proposal is evaluated as a whole, the technical factors and past performance/performance confidence assessment factor combined (i.e., the non-price evaluation factors) are approximately equal to price.

The importance of price will increase if the offerors’ non-price proposals are considered essentially equal in terms of overall quality, or if price is so high as to significantly diminish the value of a non-price proposal’s superiority to the Government. Award will be made to the responsible offeror(s) whose offer conforms to the solicitation and represents the Best Value (BV) to the Government, price and non-price factors considered.

3. Basis of Evaluation and Submittal Requirements for Each Factor. Proposals submitted in response to this solicitation shall be formatted as follows, in the number of copies stated:

Submit original, and four (4) copies, and one CD Rom for each of the Price Proposal and Technical Proposal. The proposal shall be submitted in two separate volumes (Volume 1-Price and Volume 2- Technical) with content as specified below:

VETS has a legislative requirement to collect, and make available to OFCCP, reported data contained on the VETS-4212 report for compliance enforcement.

http://www.dol.gov/vets/vets4212.htm.

(2) Basis of Evaluation: The Government will evaluate price based on the total price for Firm-Fixed Price (FFP) recurring services and IDIQ (non-recurring service work). Total price consists of all requirements and all option items for the PTO 0001/seed project. The Government intends to evaluate all options and has included the provision FAR 52.217-5, Evaluation of Options (JUL 1990) in the solicitation. In accordance with FAR 52.217-5, evaluation of options will not obligate the Government to exercise the option(s). Analysis will be performed by one or more of the following techniques to ensure a fair and reasonable price:

(i) Comparison of proposed prices received in response to the RFP.

(ii) Comparison of proposed prices with the IGCE.

(iii) Comparison of proposed prices with available historical information.

(iv) Comparison of market survey results.

(3) A price that is found to be either unreasonably high or unrealistically low in relation to the proposed work may result in the overall proposal being considered unacceptable. Any inconsistency, whether real or apparent, between proposed performance and price must be clearly explained in the price proposal. For example, if unique and innovative approaches are the basis for an apparently unbalanced/ inconsistently priced proposal, the nature of these approaches and their impact on price must be completely documented. The burden of proof of price reasonableness rests solely with the offeror. If a price realism analysis is required, the analysis may address whether prices are realistic in relation to the work to be performed, reflect a clear understanding of the requirements, and are consistent with other portions of the offeror’s proposal. Proposals may be analyzed for unbalanced pricing. An offer may be rejected if the Contracting Officer (KO) determines that a lack of balanced pricing poses an unacceptable risk to the Government.

(b) Non-price Factors (Volume 2 – Submit Original & four (4) copies):

(1) Solicitation Submittal Requirements: Submit original & four (4) copies, plus one CD (with documents in Microsoft Word). Technical proposal copies shall be submitted in three ring binders separate from price proposals, and clearly marked: “Volume 2- Technical Proposal.” The technical proposal shall address each evaluation factor in accordance with the criteria shown below under Factors 1 through 4. Provide a separate tab within Volume 2 for each factor shown below:

TAB #1: Factor 1 – Recent, Relevant Experience of the Firm TAB #2: Factor 2 – Management Approach TAB #3: Factor 3 – Safety TAB #4: Factor 4 – Past Performance on Recent, Relevant Projects

(2) A copy of the Technical Proposal shall be placed on one (1) CD-ROM and inserted in the original Technical Proposal Binder – Volume 2.

TAB #1: Factor 1 - Recent, Relevant Experience of the Firm:

(1) Solicitation Submittal Requirements: Submit Exhibit “A” (Recent, Relevant Experience of Firm Project Data Sheets) for each project under Tab “1”. Exhibit A is MANDATORY. For purposes of this evaluation, relevant projects are further defined as Government or commercial projects similar in size, scope, and complexity to the projects that may be ordered under this contract with a total award value of $2 million or more (at the date of contract award).

(b) Project experience is defined as a project performed under a single task order (TO) or contract. For multiple award contracts and IDIQ type contracts, the contract as a whole shall not be submitted as a project; rather offeror shall submit the work performed under a task order project.

(ii) At least 50% complete within the last five (5) years prior to the RFP issuing date;

(iii) A total award value of $2 million or more (at the date of contract award);

(iv) Services related to recurring maintenance and minor repairs similar to the scope requirements in the solicitation technical annexes.

(d) The Government will not consider any project submitted for experience that was performed by a firm other than the offeror, except that:

(i) If the Offeror is a Joint Venture (JV), relevant project experience shall be submitted for project(s) completed by the JV entity. If the JV does not have shared experience, relevant projects shall be submitted for each JV member provided the JV offeror’s proposal includes a copy of the supporting JV agreement identifying the firm in question as a member of the JV for this procurement in the Price Proposal under Tab #5.

(ii) The Government will consider otherwise relevant projects that were performed by the offeror’s proposed key personnel; however, experience of proposed subcontractor employees, key or otherwise, will not be considered; and,

(iii) The Government will consider otherwise relevant projects performed by affiliates/subsidiaries/parent/LLC/LTD member companies (i.e. any office(s) of the Offeror other than the one submitting the current proposal as stated on the SF1449), provided the proposal clearly explains that the affiliates/subsidiaries/parent/LLC/LTD firm will have meaningful involvement in the performance of this contract.

Regarding such submitted project(s), if the Offeror fails to demonstrate the affiliate/subsidiary/parent/ LLC/LTD meaningful involvement in the performance of this contract, the project may not be considered relevant and may not be evaluated. The Government will not consider the experience of proposed subcontractors.

(iv) Exhibit A, Offeror Recent, Relevant Experience of Firm Project Data Sheets submitted that exceed the maximum, three single-sided 8.5” x 11” page limit will be removed prior to evaluation.

Exhibit A, Project Data Sheets submitted for multiple award contracts and/or IDIQ type contracts as a whole will be removed prior to evaluation.

Exhibit A, Project Data Sheets submitted for projects that are not at least 50% complete within five (5) years prior to the RFP issuing date will be deemed not similar in scope and not relevant.

(2) Basis of Evaluation: The basis of evaluation will include the offeror’s demonstrated experience in performing relevant recurring service maintenance projects as defined in the solicitation technical annexes. The assessment of the offeror’s relevant experience will be used as a means of evaluating the ability of the Offeror to successfully meet the requirements of the solicitation. The Government will only review five (5) projects; any projects submitted in excess of the limitation will not be considered.

(a) Offeror who proposes to self-perform more than 75% percent of the cost of contract performance may be rated higher.

(b) Relevant projects submitted that demonstrate experience in all of the technical annexes described in the solicitation under a single project may be rated higher.

(c) Projects submitted with award value of $5 million or more (i.e. contract price), may be rated higher.

(d) Offerors that fail to properly complete Exhibit A, Project Data Sheets and do not provide all requested data, with a point of contact that is accessible, (e.g. incorrect contact information number and/or email address) may be rated lower. Note: the Government may contact references for the submitted projects to verify information presented in Exhibit A, Project Data Sheets.

(e) For JV offerors – Proposals that fail to provide relevant experience for the JV entity or relevant experience for each JV member may be rated lower. Offeror’s are still limited to a total of five (5) projects combined.

(f) Offeror’s submitting less than the minimum requirement of three (3) relevant projects will be rated unacceptable.

(g) Projects submitted using other than the mandatory Exhibit A, Project Data Sheet form as included in the RFP will not be evaluated.

(h) Information submitted that exceed the three (3) page limitation on the mandatory Exhibit A, Project Data Sheet will be removed and will not be evaluated.

Note: For a partnership or joint venture, the submittal requirements (above) are required for each offeror who is part of the partnership or joint venture; however, only one technical approach for safety narrative is required.

(2) Basis of Evaluation: The safety factor evaluation will collectively consider the following three submittal requirements:

EMR – For the three previous complete calendar years (2014, 2015 and 2016) the offeror will submit EMR. If no EMR exists, the offeror may submit an insurance company-provided equivalent rate explaining why not. If an insurance company-provided equivalent rate is provided, it will be treated the same as an EMR. Any extenuating circumstances that affected the EMR and negative trends shall be addressed as part of this selection factor. The board will evaluate the EMR to determine if the Offeror has demonstrated a history of safe work practices taking into account any negative trends and extenuating circumstances that impact the rating.

OSHA DART and TRC rates – For the three previous complete calendar years (2014, 2015 and 2016), the offeror will submit their OSHA DART and TRC, as defined by the U.S. Department of Labor, Occupational Safety and Health Administration. If unable to submit OSHA DART and TRC rates, affirmatively state so, and an explanation shall be provided.

Offeror Technical Approach to Safety – The offeror will describe their plan to evaluate their safety performance and that of potential subcontractors. Also, describe any innovative methods that the Offeror will employ to ensure and monitor safe work practices at all subcontractor levels. The Safety Narrative shall be limited to two 8” x 11”pages. The board will evaluate the narrative to determine the degree to which subcontractor safety performance will be considered in the selection of all levels of subcontractors on the upcoming project. The board will evaluate the narrative to determine the degree to which innovations are being proposed that may enhance safety on this procurement and validate the contractor has addressed methodology to be used in the execution of an effective program that facilitates sound mishap prevention techniques/processes, employee reporting of unsafe conditions, unsafe activities, and near-miss mishaps. Those Offerors whose plan demonstrates a commitment to hire subcontractors with a culture of safety and who propose innovative methods to enhance a safe working environment may be given greater weight in the evaluation.

Other sources of information available to the Government – Other sources for safety may include but are not limited to OSHA data, NAVFAC’s Contractor Incident Reporting System (CIRS) in Enterprise Safety Applications Management System (ESAMS), Contractor Performance Assessment Reporting System (CPARS) and other related databases.
