Source Selection Factor 4

Factor 4 – Small Business Utilization

Subfactor 4A – Past Performance in Utilizing Small Business Concerns

Subfactor 4B – Small Business Participation Management

Subfactors 4A and 4B are of equal importance to the determination of the Factor 4 Rating.

Small Business Evaluation Factor

•The SB evaluation factor is comprised of two subfactors

1. Past Performance in utilizing SB concerns

a. Past performance evaluations pertaining to SB subcontracting projects must match those submitted in other technical factors

b. SB subcontracting history Individual Subcontracting Report (ISR) or Exhibit in RFP

c. Optional factor elements

i. National or Industry standard awards

ii. Mentor-Protégé agreements

iii. Use of Community Rehabilitation Program (CRP) concerns

2. Small Business Participation

• Small Business Subcontracting Plan

USE THE FORMS PROVIDED IN THE SOLICITATION

NAVFAC SB Subcontracting Targets

The minimum NAVFAC Subcontracting Targets are:

Socio-Economic Group FY 2016 FY 2017 * FY 2018 *

SB 66.94% 67.07% 67.20%

HUBZone 9.03% 9.12% 9.21%

SDB 17.44% 17.62% 17.79%

WOSB 15.45% 15.61% 15.77%

VOSB/SDVOSB 3.06% 3.09% 3.12%

Subfactor: Past Performance in Utilizing Small Businesses

Basis for evaluation: The extent to which the proposal demonstrates the proposer’s level of past performance in utilizing

-- SB concerns, -- AbilityOne, -- Mentor-Protégé Agreements, -- and other socio-economic programs (SEP) in meeting established SB subcontracting goals.

Evaluating SB Past Performance

•On the projects you submitted, did you meet your small business subcontracting goals?

• If you didn’t have small business subcontracting requirements, did you use SB/SEP concerns, to what extent?

•Did you utilize SBs in all SEPs? To what extent?

•Do you have a strong small business program within your company?

•Do you actively support and promote the use of SB/SEP concerns? (MPA, AbilityOne, CRP, etc.)

Subfactor: Small Business Participation

Submit a Small Business Subcontracting Plan (SBSP) on the template attached to the RFP.

The SBSP is reviewed TWICE.

–Once against the evaluation factor

–If you are a potential awardee, your SBSP is reviewed again for contractual acceptability

•No award will be made to a firm that does not submit a contractually acceptable SBSP, even if that firm appears to be the prospective awardee.

SBSP – Source Selection Evaluation

Basis for evaluation: The extent to which the proposal demonstrates:

1. Maximum practicable participation of SBs in terms of the total value of the acquisition, including options.

o Percent a total contract value to be subcontracted to SB/SEP concerns o Individual goals for each SB SEP (percentage of total subcontracted value)

2. Commitment to use SB concerns that are specifically identified in the proposal, including, but not limited to mentor-protégé program.

o Firm subcontracting commitments to named firms vice potential pool of subcontractors

3. SB participation in a variety of industries expected during the performance of work.

o demonstration of market research – not boilerplate

4. REALISM of the proposal to meet proposed goals.

o Does the overall SBSP indicate a reasonably sound SB program that will ensure offeror can/will meet SBSP goals.

Types of Subcontracting Plans

• Individual Plan

• Pertains to a single contract

• Valid for the life of the individual contract

• Master Plan

• Established on a plant or division-wide basis

• Contains all elements of a plan except goals

• Must be approved by Contracting Officer

• Effective for three years

• Incorporated into Individual Plans (establish goals)

• Commercial Plan

• Applies to specific product sold commercially

• Covers all elements of plan including goals

• Effective for one fiscal year

• Goals for entire year are established by first agency to negotiate plan with company

Subcontracting Plan Requirements

•FAR 19.704 -- Each subcontracting plan must include:

• Separate percentage goals for each SB socio-economic program (SEP)

• Total dollars planned to be subcontracted for each SB SEP

• Description of supplies and services to be subcontracted to each SEP

• Description of method used to develop goals

• Description of method used to identify potential sources for subcontracting

• Statement whether or not indirect costs are included in goal calculation

• Name of individual responsible for plan administration (SBLO)

• List of duties and responsibilities of SBLO

• Description of efforts made to ensure that all SB SEPs have an equitable opportunity to compete for subcontracts

• Offeror will comply with flowdown requirements

• Assurance offeror will comply with studies, submit period reports, and keep appropriate records

Common problem areas.

Additional Requirements

Cover sheet must be signed and dated by:

• authorized company official,

• agency small business administrator

• SBA

• Contracting Officer

Subcontracting Plan must identify solicitation number and title

Plan must identify what type of plan it is (Individual, Master, Commercial)

Identify whether or not the contract has option periods. If so, must include a table of dollars/percentage goals for each contract period.

1 and 2 - Small Business Goals

Determine what you will perform with in-house resources and what you will subcontract out.

-- Material purchases are considered subcontracts

NAVFAC calculates subcontracting goals as a percentage of the total amount to be subcontracted, not a percentage of the total contract value.

Socio-Economic Program (SEP) goals (HUBZone, Veteran-Owned SB, Service-Disabled Veteran-Owned SB, Woman-Owned SB, and Small Disadvantage Business), do not necessarily mathematically equate to total SB subcontracting goals.

-- A firm may have multiple SEP certifications

-- Count 100% subcontracting in each SEP and SB overall

DOUBLE CHECK YOUR MATH!

3 – Supplies, Services & Firm Commitments

•Conduct market research to determine SB subcontracting opportunities for each type of work you intend to subcontract

•Firm commitments versus potential subcontracting opportunities – BE CLEAR

•Contractors not specifically identified

• List CAGE code or DUNS number for named contractors

•Contractors not small in work identified (be specific on type of work you intend to subcontract)

•Contractors not registered in SAM or DSBS

4 - Method Used to Develop Goals

•Address all elements of requirement:

–Method used to develop goals

–How products and services to be subcontracted were established

–How SEP concerns were determined qualified / capabilities determined

•Be specific – describe in detail what you did to develop your goals for each SEP.

•Lack of specificity often results in a lower rating because it indicates a lack of planning or genuine commitment.

5 - Method Used to Identify Potential Sources

•Do not reference outdated recourses (i.e. CCR)

•List all sources used or that will be used during performance of the contract

–Few resources may indicate a lack of planning or understanding of how to find potential subcontractors

–Few resources may indicate an inability to meet SBSP commitments and objectives

•Do not include historical information

6 – Inclusion of Indirect Costs in Goal Calculations

Indirect and overhead costs have have not been included in goals specified in 1 and 2 above. If “have” …

You may include indirect and overhead costs in your goal calculations, but you must provide a detailed methodology describing how you determined the proportionate share of these costs to be

--- Allowable

--- Allocable

--- Reasonable

•Office supplies, cleaning supplies, custodial services, etc. are overhead expenses

Methodology should be able to pass a DCAA Audit.

7 – Small Business Liaison Officer (SBLO)

Identify the individual employee that will be responsible for administering the SBSP.

If you later need to change the SBLO, you need to request a contract modification.

List duties and responsibilities for the named

SBLO.

8 – Equitable Opportunity to Compete

Answer all elements of the requirement –Outreach efforts

–Sources that will be used in addition to automated databases

–Internal efforts to guide and encourage buyers

–Description of how database, source lists, and other data will be maintained, used by buyers, rotation of firms in the database, and how database will be kept current and useful.

•Be specific in your description of process

•Do not reference outdated resources (i.e. CCR)

•Do not include historical information

9 – Flowdown Requirements

Periodic Reports – ISRs

• When goals are not met, remarks are missing or inadequate

• For each goal not met, need to explain:

–What did you do to try and meet the goal

–Why was that effort unsuccessful

–What are you going to do in the next reporting period to ensure goals will be met.

• Remarks are overly general in nature and do not provide useful info

• Remarks do not pertain to specific reporting period; copied from last report.

• Good faith effort not established or documented

Current thresholds:

-- $700,000 for other than construction

-- $1,500,000 for construction

FAR 52.219-8, “Utilization of Small Business Concerns”, must be included in subcontracts to large businesses that meet the thresholds above.

LB subcontractors must submit a SBSP to you similar to the one you submitted to the government.

** You are required to monitor their SBSP performance.

9 – Flowdown Requirements

10 and 11 – Periodic Reports

• Individual Subcontracting Reports (ISRs) –Submitted every two months to Contracting Officer

•Reporting period Oct 1 – Mar 31 Report NLT Apr 30

•Reporting period Oct 1 – Sep 30 Report NLT Oct 30

•Final ISR due at contract completion

•ISRs submitted online via the Electronic Subcontracting Reporting System (eSRS)

•Flowdown requirement to LB subcontractors –Provide prime contractor DUNS number and email address to LB subcontractors

12 – Record Keeping

You must keep documentation to evidence that you are complying with ALL aspects of your SBSP

Documentation must be kept to evidence:

-- Good Faith Efforts

-- Procurement award determinations (especially if subcontract not awarded to a small business)

-- training, guidance, procedures, outreach, etc.
