CONTRACTOR QUESTION: (ONE QUESTION PER PAGE)

On page 31, paragraph(e)(1) requires the prime to flow down FAR clause 52.222-41 Service Contract Labor Standards.

(e) (1) Notwithstanding the requirements of the clauses in paragraphs (a), (b), (c), and (d) of this clause, the Contractor is not required to flow down any FAR clause, other than those in this paragraph (e)(1)in a subcontract for commercial items. Unless otherwise indicated below, the extent of the flow down shall be as required by the clause—

(x) 52.222-41, Service Contract Labor Standards (May 2014), (41 U.S.C. chapter 67).

FAR clause 52.222-41 Service Contract Labor Standards is not listed anywhere else in the solicitation.

Will the government remove the Flow Down requirement, since FAR clause 52.222-41 Service Contract Labor Standards is not listed in the solicitation?

Answer: 52.222-41 is NOT required to be flowed down to subcontracts for this procurement. 52.222-41 does not apply to this contract and is not invoked in 52.212-5(c). 52.212-5(e)(1) would only serve to require the flow down of 52.222-41 (regardless of the requirements within 52.222-41 itself) IF 52.222-41 were invoked elsewhere. 52.212-5(e)(1) does not serve to invoke the clauses in the first instance. Thus, there is no flow down requirement to remove.
