1 54 M The solicitation is unrestricted and open for large businesses however the Small Business Subcontracting plan states that the minimum subcontracting target for this solicitation is 66.8% small business. Normally the small business requirement is below 40%. It is virtually impossible for a large business contractor bidding as Prime (and expected to assume 100% liability for contract performance) to effectively manage a contract when they are only allowed 33.2% of the contract. Would the government consider reducing the small business requirement to allow large businesses to maintain at least 60% of the contract?
The targets provided in the solicitation are the NAVFAC Prime Contracting targets for Large Business firms who will be required to submit an acceptable subcontracting plan in the event they are the prospective awardee. The small business subcontracting targets apply to the dollars your company intends to subcontract, not the entire contract dollar value, see Sample Subcontracting Plan paragraph 1. B in the RFP. For example, if the prime contractor performs 75% of the work with in-house forces and subcontracts the other 25%, then it is anticipated that 66.8% of the (25%) subcontracted work should be subcontracted to small business including the various socio-economic targets identified in the
RFP.
2 54 M The Small Business Subcontracting plan lists an overall small business requirement of 66.8%. A portion of the 66.8% is specifically allotted to four set-asides: Hubzone (8.94%);
SDB (17.27%); WOSB (15.3%); and SDVOSB (3.03%). Is it a requirement for the Offeror to meet the percentages for each of those four set-asides, or, will the government allow the 66.8% to be met through one small business category (for instance a WOSB small business contractor receiving 66.8%)?
The prospective awardee is highly encouraged to submit a plan that meets or exceeds the specified small business socio-economic targets (Small Business including HUBZone ;
Small Disadvantaged Business; Woman-Owned Small Business and Service-Disabled Veteran- Owned Small Business.)
The plan must consider each of the various small business socio-economic targets for the work that it intends to subcontract. The Large Business, in its subcontracting plan, is required to state how the goals were developed, see paragraph 4 of the sample subcontracting plan in the RFP. Goal development shall address any limited opportunities for small businesses including any small business socio-economic targets where a target was not met. The subcontracting plan is reviewed for acceptability by both NAVFAC and the Small Business Administration and the plan must be found to be acceptable to be considered eligible for contract award.

SECTION I - CONTRACT CLAUSES
The following have been added by full text:
52.222-99 ESTABLISHING A MINIMUM WAGE FOR CONTRACTORS (DEVIATION 2014-O0017) (JUNE 2014) This clause implements Executive Order 13658, Establishing a Minimum Wage for Contractors, dated February 12, 2014, and OMB Policy Memorandum M-14-09, dated June 12, 2014.
(a) Each service employee, laborer, or mechanic employed in the United States (the 50 States and the District of Columbia) in the performance of this contract by the prime Contractor or any subcontractor, regardless of any contractual relationship which may be alleged to exist between the Contractor and service employee, laborer, or mechanic, shall be paid not less than the applicable minimum wage under Executive Order 13658. The minimum wage required to be paid to each service employee, laborer, or mechanic performing work on this contract between January 1, 2015, and December 31, 2015, shall be $10.10 per hour.
(b) The Contractor shall adjust the minimum wage paid under this contract each time the Secretary of Labor’s annual determination of the applicable minimum wage under section 2(a)(ii) of Executive Order 13658 results in a higher minimum wage. Adjustments to the Executive Order minimum wage under section 2(a)(ii) of Executive Order 13658 will be effective for all service employees, laborers, or mechanics subject to the Executive Order beginning January 1 of the following year. The Secretary of Labor will publish annual determinations in the Federal Register no later than 90 days before such new wage is to take effect. The Secretary will also publish the applicable minimum wage on www.wdol.gov (or any successor website). The applicable published minimum wage is incorporated by reference into this contract.
(c) The Contracting Officer will adjust the contract price or contract unit price under this clause only for the increase in labor costs resulting from the annual inflation increases in the Executive Order 13658 minimum wage beginning on January 1, 2016. The Contracting Officer shall consider documentation as to the specific costs and workers impacted in determining the amount of the adjustment.
(d) The Contractor Officer will not adjust the contract price under this clause for any costs other than those identified in paragraph (c) of this clause, and will not provide price adjustments under this clause that result in duplicate price adjustments with the respective clause of this contract implementing the Service Contract Labor Standards statute (formerly known as the Service Contract Act) or the Wage Rate Requirements (Construction) statute (formerly known as the Davis Bacon Act).
(e) The Contractor shall include the substance of this clause, including this paragraph (e) in all subcontracts.
