STATEMENT OF WORK
Performance Work Statement for
Norfolk Naval Shipyard Shuttle Services
Section 1: General This is a contract to provide transportation services throughout Norfolk Naval Shipyard (NNSY) at the Naval Support Activity, Portsmouth (NSA Hampton Roads Portsmouth) in Portsmouth, Virginia. The Government shall not exercise any direct supervision or control over the contract service providers performing the services herein. Such contract service providers shall be accountable solely to the Contractor who, in turn is responsible to the Government.
1.1 Description of Services/Introduction: The contractor shall provide shuttle services for the transportation of all personnel throughout NNSY and NSA Hampton Roads Portsmouth. The contractor shall provide all personnel, equipment, tools, materials, supervision, other items, and non-personnel services necessary to perform as defined in this Performance Work Statement (PWS). The contractor shall perform to the standards in this contract.
1.2 Background: NNSY is a large industrial area on the NSA Hampton Roads Portsmouth installation. NNSY personnel as well as employees of the installation and other tenant commands must traverse the installation to attend functions, utilize resources, and to work on projects. The Shipyard is implementing this plan to reduce time lost from extended travel by shipyard personnel. Transportation services will also limit the amount of foot traffic and reduce personnel exposure to extreme weather.
1.3 Scope: The shuttle service will consist of four, 15-passenger vans with drivers. The drivers will operate the vans along the routes for the installation and inside the Controlled Industrial Area (CIA) which will require navigation of vehicle and pedestrian traffic and facilities. Due to the age of NNSY and the installation, there is construction of various degrees which may require traffic detours and on a rare occasion shifting a shuttle stop location. The daily shuttle schedule will be at 0500 to 1700 each weekday with the exception of federal holidays or other days NNSY is not operating. Drivers will be redirected by the Contracting Officer's Representative (COR) to alternate routes as needed to support special events and weather events. The routes are as follows:
1.3.1 Two drivers will be responsible for the Installation route (Attachment1 Blue
Route) and shall report to shuttle stop #A and #J by 0500 each workday. The route should take 30 to 40 minutes.
1.3.2 Two drivers will be responsible for the CIA route (Attachment2-Gold Route) and report to shuttle stop #1 and #7 by 0500 at the start of each workday. The route should take 15 to 20 minutes.
1.3.3 Attachments will be available upon Award.
1.4 Place of Performance: The work to be performed under this contract will be performed at NNSY on the NSA Portsmouth installation in Portsmouth, VA.
1.5 Period of Performance: The period of performance shall be for 1 base year of 12 months and one 12-month option year. Dates will be outlined in the contract.
1.6 General Information
1.6.1 Contracting Officer's Representative (COR): The COR monitors all technical aspects of the contract and assists in contract administration. The COR is authorized to perform the following functions: assure the contractor performs the technical requirements of the contract; perform inspections necessary in connection with contract performance; maintain written and oral communications with the contractor concerning technical aspects of the contract; issue written interpretations of technical requirements, including government drawings, designs, and specifications; monitor contractor's performance and notify both the Contracting Officer and contractor of any deficiencies; coordinate availability of government-furnished property; and provide site-entry of contractor personnel. A letter of designation issued to the COR, a copy of which is sent to the contractor, states the responsibilities and limitations of the COR. The COR is not authorized to change any of the terms and conditions of the resulting order.
1.6.2 Authorized changes made only by the Contracting Officer.
1.6.3 Vendor POC: Duties shall include ensuring requirements of PWS are carried out;
executing required maintenance functions on the vehicles and providing such informational maintenance records as requested by the COR; providing information as required; ensuring equitable rotation amongst drivers as far as schedule to accommodate customer requirements
Section 2: Standards of Conduct
2.1 The Contractor shall maintain satisfactory standards of employee competency, conduct, cleanliness, appearance and integrity; and shall be responsible for taking such disciplinary action with respect to employees as required. Each Contractor employee is expected to adhere to standards of conduct that reflect credit on themselves, their employer, and the United States Government. The Contractor shall immediately replace, within 24 hours, such an employee to maintain continuity of services at no additional cost to the Government.
2.2 All contractor personnel shall abide by all safety requirements while operating vans.
Appropriate footwear is required to prevent slips in an industrial environment. Contractor employees shall wear appropriate attire that fits properly. Contractor drivers shall wear their government-issued identification badge above the waist, completely visible at all times.
2.3 The Contractor shall ensure its personnel drive safely and exercise due regard when operating the motor vehicles for shuttle service. The Contractor shall report any instances of reckless driving or dangerous maneuvers the contractor becomes aware of during contract performance to the Government Project Manager. The Contractor shall investigate such instances of reckless driving or dangerous maneuvers such as, but not limited to, illegal U turns, driving above the posted speed limit, hitting/riding up curbs, striking other fixed or moving objects, performing turns with marginal space in front of oncoming traffic, etc. Upon being informed about such conduct (e.g., reported by passengers).
2.4 The contractor shall address its personnel found to be engaged in driving recklessly or performing dangerous maneuvers. If Contractor personnel are found to be involved in more than one incident of reckless driving or performing dangerous maneuvers per calendar year, the contractor shall replace the driver assigned to this contract with another qualified driver within two
(2) working days from the date of replacement. The Contractor shall remove Contractor personnel charged with driving under the influence (DUI) or equivalent charges (in either a work or personal capacity),within 24 hours from the time the Contractor knows or should’ve known of such charges.
2.5 Contractor and all employees shall abide by all local, state, and federal laws.
2.6 Legal Compliance. The vendor shall be responsible for compliance with all pertinent Department of Transportation and local laws concerning motor vehicles and have valid REAL ID compliant driver's licenses.
Section 3: Contractor-furnished items and services
The following minimum criteria shall be met at the time of the acceptance inspection.
3.1 The Contractor shall provide a driver for each vehicle it uses to provide shuttle services. The contractor shall ensure that every shuttle bus driver it provides possesses a valid state motor vehicle Driver’s license, is a U. S. Citizen and has appropriate vehicle credentials, as well as a clean driving record. The Contractor shall ensure all drivers received the required training, possess required certifications, and complete background screening within ten (10) days of award.
3.2 Vehicles. Vehicles will be delivered with drivers to the location at the time and place agreed to by the Government and Contractor throughout the contract period of performance.
3.3 Vehicle Condition. Vehicles provided in the performance of this contract must be provided in good working condition. Both the exterior and the interior of the vehicles must be free of excessive soil, rust, and damage and without excessive wear and tear. Vehicles must be clean and serviceable at time of delivery. Age of vehicles provided shall not exceed 7 years.
3.4 Safety Items. The contractor will comply with all applicable Federal, State, DoD, and local safety standards and ensure all work performed under this contract is completed in a safe manner. Each vehicle must have current registration and inspection.
3.5 Air Conditioning. Vehicles shall have fully functioning air conditioning and heat.
3.6 Mileage. The Government requires UNLIMITED mileage for each vehicle during hours of operation.
3.7 Communications. Vehicle drivers must have the capability to immediately communicate with his/her office, either radio-dispatched and/or a cell phone.
3.8 Access Requirements. All vehicles and drivers shall meet security clearance requirements for both the installation and inside the CIA.
3.9 Vehicles equipped with cameras must have the cameras disabled or all lenses physically covered in order to render images unrecognizable. Vehicles leaving the CIA for any reason must be re-inspected at Commercial Vehicle Inspection Station (CVIS) prior to reentry. This CVIS inspection to include verification the cameras are still disabled or covered.
Section 4: Tasks
Basic services. The contractor shall provide drivers, vehicles, maintenance and fuel in accordance with the tasks described below.
4.1 The contractor will be responsible for supplying fuel used in the vehicle for the remainder of the contract. Drivers are responsible to ensure the van is fueled during hours of operation.
4.2 The Contractor will be responsible for ensuring driving records are clean and without demerit point.
4.3 Drivers shall complete their routes stopping at designated shuttle stops without unnecessary stopping. Necessary stopping is defined, as stopping that is needed in direct connection with the performance of this contract. Examples of necessary stopping are stopping for to use restrooms or breaks. Drivers shall not operate the vehicles under the influence of any drugs and alcohol while performing under this contract.
4.4 Drivers must be able to communicate clearly with passengers.
4.5 Replacement Vehicles.
4.5.1 Replacements shall be provided for all vehicles that are out of service within four
(4) hour of notice. The contracting officer will contact the contractor for a replacement vehicle at no additional cost to the Government. Contractor will be contacted by phone and/or email. Replacements shall be provided for all vehicles that are not accepted by the COR or that are no longer in the condition to meet the contract requirements. The replacement vehicle will be of the same specifications as the original vehicle. If a vehicle of the same specifications is not immediately available, a vehicle with different specifications may be substituted if authorized by the Contracting Officer. Upon proper notification, the contractor will recover disabled vehicles within 24 hours. Towing is at the expense of the contractor.
4.6 Accidents.
4.6.1 In the event of a vehicular accident, the Contractor shall provide a report to the TPOC within 24 hours. Should injuries result from the vehicular accident, the Contractor shall submit the report immediately to the TPOC. Should the vehicular accident occur on Government property, Contractor personnel shall notify the security department located on the Government property prior to leaving the premises.
Section 5: Insurance, contractor liability, permits and indemnification
5.1 The Contractor, at the Contractor's expense, shall obtain vehicular liability and general public liability insurance. The Contractor shall maintain such insurance throughout the period of performance of the contract. The Contractor shall ensure all insurance required under the contract meets the minimum requirement identified by the state the motor vehicle is registered in.
5.2 Contractor Liability: The Contractor assumes responsibility for all damage or injury to persons or property occasioned through the use, maintenance, and operation of the Contractor's vehicles or other equipment by, or the action of, the Contractor or the Contractor's employees and agents. The contractor must provide a certificate of insurance as evidence of coverage upon request.
5.3 The Government shall in no event be liable or responsible for damage or injury to any person or property occasioned through the use, maintenance, or operation of any vehicle or other equipment by, or the action of, the Contractor or the Contractor's employees and agents in performing under this contract, and the government shall be indemnified and saved harmless against claims for damage or injury in such cases.
5.4 Permits. Without additional cost to the Government, the Contractor shall obtain all permits, licenses, and appointments required for the prosecution of work under this contract.
The Contractor shall obtain these permits, licenses, and appointments in compliance with applicable Federal, state and local laws.
Section 6: CDRLs
6.1 The Contractor shall maintain an accurate record and submit a Mishap Prevention Report of all vehicle accidents, incidents, hazards, and injuries to Contractor or Government personnel arising in the course of performance under this contract. The report shall describe the incident and the actions the Contractor is taking or has taken to prevent recurrence of the incident.
6.2 The contractor shall have passengers sign in/out of the shuttle log including their name, code, departing location, arriving location, and respective times. Each sheet shall have the date, driver name, and total number of passengers. The shuttle log shall be completed each day, even if there are no passengers for that day.
6.3 Further, the Contractor fully agrees to make available personnel, personnel records, vehicle records, all applicable incident/accident reports, and any equipment, damaged or undamaged, deemed necessary by the Contracting Officer.
Section 7: Government-furnished items and services
The government will provide signage for the shuttle stop locations.
Section 8: Security
a. All contractors, with the exception of permanent party (or “seated” contractors with Common Access Cards (CACs), will be required to obtain a DBIDS card to gain access to NNSY.
Procedure for receiving a DBIDS card:
1) Contractor will complete the SECNAV 5512 form(s) and forward them to their
NNSY Sponsor/Contracting Officer’s Representative (COR).
2) The sponsor will complete the CVS spreadsheet utilizing the information on the completed SECNAV5512 forms and forward all documents to Commander Navy region Mid-Atlantic (CNRMA) for vetting.
3) CNRMA will add the contractor to the “179-Day List” which is utilized by the Pass and ID office to create the DBIDS card.
4) Once on the 179-Day List, the contractor may go to Pass and ID to have their DBIDS card generated.
5) Green NAVSEA access badges can be generated at this point with contractors providing proof of U.S. Citizenship (Birth Certificate/ US Passport).
6) These identity cards are the property of the Government. The Contractor is responsible for their return at the end of the contract award.
b. Controlled Unclassified Information (CUI) associated with this contract must be protected per the guidance provided in DODI 5200.48. Legacy information from existing documents (e.g., Technical Manuals) marked For Official Use Only or FOUO, that is used to create a new document/correspondence, shall follow the minimum marking requirements of DODI 5200.48, Section 3, paragraph 3.4.a, and include the acronym ”CUI” in the banner and footer of the document. Nonfederal information systems storing and processing CUI shall be protected per NIST SP-800-171, or subsequent revisions. All transmissions to personal email accounts (AOL, Yahoo, Hotmail, Comcast, etc.) and posting on social media websites (Facebook, Instagram, Twitter, LinkedIn, etc.) are prohibited. Destroy all CUI associated with this contract by any of the following approved methods: a cross-cut shredder; a certified commercial destruction vendor; a central destruction facility; incineration; chemical decomposition; pulverizing, disintegration; or methods approved for classified destruction.
c. Portable Electronic Devices (PED) A portable electronic device (PED) is defined as any non-stationary electronic apparatus with singular or multiple capabilities of, but not limited to recording, storing, and/or transmitting data, voice, video, or photo images (e.g., cell phones, laptops, tablets and wearable devices such as fitness bands and smart watches).

In accordance with ref (1) personally owned camera enabled PED will be authorized inside of the Controlled Industrial Area (CIA) and all Security Islands.
Camera enabled PEDs will remain unauthorized within Controlled Nuclear Information Areas (CNIA), Nuclear Work Areas (NWA) and Open Storage Areas.
All PEDs, camera enabled or not, are still prohibited within NWAs and Open Storage Areas and spaces that intermittently process classified space while classified material is out.
The allowance of camera enabled PEDs inside of the CIA and Security Islands does not negate existing photography policies. Unofficial photography, filming of video, or live streaming from the camera-enabled PED remains prohibited within the CIA or any NAVSEA controlled space outside of the CIA. Audio recording is prohibited in any NAVSEA space without Security Director approval.

Section 10: Definitions
Accident repairs - Repairs required as a result of collision; regardless of whether the object collided with a vehicle, or whether the vehicle requiring repairs was the moving unit.
Contracting Officer's Representative (COR): A representative from the requiring activity appointed in writing by the KO to perform surveillance and to act as liaison to the contractor.
Criminal act: A violation of a criminal law.
Disabled vehicle: A damaged, worn out, or malfunctioning vehicle.
Defective service: A service output that does not meet the standard of performance associated with it in the PWS.
Fair wear and tear: The deterioration of items attributed to normal usage.
Government: the Government of the United States of America unless specifically stated otherwise.
Quality Assurance Surveillance Plan (QASP): A written document specifying the surveillance method used for surveillance of contractor performance.
Quality Control (QC): Actions taken by a contractor to control the performance of contracted services to meet PWS requirements.
Quality Assurance (QA): Actions taken by the government to assure contracted services meet PWS requirements.
Scheduled maintenance: Periodic manufacture prescribed inspections or servicing of equipment, accomplished on a calendar, mileage, or hours-of-operation basis.
