OCT 2018
52.212-1 ADDENDUM
52.212-1 INSTRUCTIONS TO OFFERORS--COMMERCIAL ITEMS (APR 2014) - ADDENDUM
A. BASIS FOR AWARD
1. The Government reserves the right to eliminate from consideration for award any or all offers at any time prior to award of the contract; to negotiate with offerors in the competitive range; and to award the contract to the offeror submitting the lowest price technically acceptable (LPTA) proposal.
2. As stated in the solicitation, the Government intends to evaluate proposals and award a contract without discussions with offerors (except clarifications). Therefore, the offeror’s initial offer should contain the offeror’s best terms from a price and technical standpoint. However, the Government reserves the right to conduct discussions if later determined by the Contracting Officer to be necessary. The Government may reject any or all offers if such action is in the public interest; accept other than the lowest offer; and waive informalities and minor irregularities in offers received.
3. The number of proposals to be evaluated for technical acceptability may be limited to the lowest priced offer at the discretion of the contracting officer. If the number of proposals to be evaluated is limited, the technical proposal shall be provided to the evaluator(s) without any identification of price. If the lowest priced proposal is not found to be technically acceptable then the next lowest price proposal shall be evaluated. If that proposal is also not found to be technically acceptable, then the process described will be conducted again as many times as necessary, until such time as the Government identifies a technically acceptable proposal.
4. The LPTA process is selected as appropriate for this acquisition because the best value is expected to result from selection of the technically acceptable proposal with the lowest evaluated price.
5. An overall non-price factors rating must be at least “ACCEPTABLE” in order to be eligible for award.
An “UNACCEPTABLE” rating in any factor results in the overall non-price factors proposal being rated “UNACCEPTABLE” unless corrected through discussions. An overall non-price factors rating of “UNACCEPTABLE” makes a proposal ineligible for award.
6. Ensure current registration on the System for Award (SAM) website. Contractors may obtain information on registration or annual confirmation requirements via SAM accessed through http://www.acquisition.gov or by calling 866-606-8220, or 334-206-7828 for international calls.
7. Ensure that you have completed/updated your Online Annual Representations and Certifications on the SAM Website, https:///www.sam.gov
8. Inquiries regarding this Request for Proposal (RFP) shall be submitted electronically using the Pre- Proposal Inquiry Form (PPI) form provided as Addendum (5). Point of Contact (POC) for inquiries is Angela M.
Santos, email at angela.santos@fe.navy.mil. The Government does not intend to respond to inquiries submitted less than 10 days before the proposal receipt date. NOTE: The offeror is advised to request a confirmation of receipt to ensure the mail recipient receives the electronic submission.
B. EVALUATION FACTORS FOR AWARD
The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation is the lowest price technically acceptable offer, price and other factors considered. The price proposal and the non-cost/price proposal shall be submitted in separated volumes. Each volume, as described below, shall be appropriately tabbed and present a clear, concise offer.
Volume I – Price Proposal Volume II – Non-Cost/Price Proposal (Factors 1, 2, and 3)
VOLUME I – PRICE PROPOSAL
(a) Submittal Requirement: Submit an original paper copy and one (1) electronic copy with editable documents (e.g. Excel files) of the CLINs & ELINs copies compatible with Windows 10 and Word 2013-2016, Excel 2013-2016, and Adobe Acrobat software.
At a minimum, Volume I shall be provided in six (6) parts and tabbed as follows:
1. Standard Form 1449 with 30a through 30c completed;
2. Submit prices for each for each Contract Line Item Number (CLIN) in the Schedule (see pages 5-7 of SF1449) and each contract period ELIN, and by Sub-ELIN (see Appendix 3) to support the amounts specified;
3. Name title, e-mail address, phone, and facsimile number of the person or persons authorized to negotiate and bind your firm and/or address proposal clarifications;
4. SAM Registration to include Offeror Representation and Certification;
5. Evidence of financial capability, certified by an independent accounting firm, if practicable, or at least by an authorized officer of the organization.
6. Signed copy of a joint venture agreement, partnership agreement, teaming agreement, or letter of commitment for each member of the Offeror’s team identified above (e.g., joint venture partner, partner, team member, subcontractor, parent company, subsidiary, or other affiliated company, etc.).
(b) Basis of Evaluation: The Government will evaluate price based on the total price. Total price consists of the basic requirements and all option items. Analysis of price will be performed to ensure a fair and reasonable price. Contractor’s failure to submit all documents required in this volume will be considered non-responsive and will result in an “Unacceptable” rating. Analysis will be performed by one or more of the following techniques to ensure a fair and reasonable price:
• Comparison of proposed prices received in response to the RFP.
• Comparison of proposed prices with the Independent Government Estimate.
• Comparison of proposed prices with available historical information.
• Comparison of market survey results.
VOLUME II – NON-PRICE/TECHNICAL PROPOSAL
Factor 1 – Company and/or Personnel Experience/Capability;
Factor 2 – Safety; and Factor 3 – Past Performance.
Factor 1 – Company and/or Personnel Experience/Capability
(a) Submittal Requirement: The offeror shall provide a narrative that demonstrates their ability to meet the service requirements set forth in the performance objectives and standards of the Performance Work Statement (PWS). The narrative shall be limited to three (3) single pages in length (or one and a half pages double-sided). Pages that exceed the maximum number will be removed and will not be considered. Experience and capability refers to the Offeror’s overall plan, method, and procedure that clearly satisfy the requirement of the PWS. This includes:
1. Delivery capability to meet the schedule as set forth in the PWS. The offeror must demonstrate capability to deliver during inclement weather.
2. Approach to replace equipment or correct deficiencies after written government notice given.
3. Provide catalog cuts that illustrate individual leased equipment contained in the PWS (this does not count towards the 3 page limitation).
(b) Basis of Evaluation: The assessment of the technical approach for the Offeror will be used as a means of evaluating the capability of the Offeror to successfully meet the requirement of this solicitation. Evaluators will determine the Offeror’s compliance with the requirements of this RFP.
The rating shall be either acceptable or unacceptable.
Factor 2 – Safety
(a) Submittal Requirement: (For a partnership or joint venture, the following submittal requirements are required for each contractor who is part of the partnership or joint venture; however, only one safety narrative is required. EMR, DART and TRC Rates shall not be submitted for subcontractors.)
i. Experience Modification Rate (EMR): Include three previous complete calendar years’ (2017, 2018, 2019) worth of data. This rate compares company’s annual losses in insurance claims against its policy premiums. The offeror may submit an insurance company-provided equivalent rate if no EMR exists. If the offeror has no EMR or premium, for any year, affirmatively state so and explain why. Any extenuating circumstances that affect the EMR and negative trends should be addressed as part of the factor submission.
ii. OSHA Days Away from Work, Restricted Duty, or Job Transfer (DART) Rate and Total Recordable Case (TRC) Rate: Submit three previous complete calendar years’ (2017, 2018, 2019) worth of data. If an offeror cannot submit an OSHA DART and TRC rates, for any year, affirmatively state so and an explanation must be provided. Any extenuating circumstances that affected the OSHA, DART, and TRC rate data negatively must be addressed as part of this factor submission.
iii. Technical Approach for Safety: Describe the plan for safety that will be implemented to evaluate safety performance of potential subcontractors as part of the selection process for all levels of subcontractors. The offeror shall submit a narrative that fully describes the safety management system that they will use to oversee the safety compliance and performance of self-performed and subcontractor performed work. The offeror will describe any innovative methods that will be employed to ensure and monitor safe work practices at self-performed and/or all subcontractor levels. Additionally, the contactor will describe their methodology to execute an effective program that facilitates sound mishap prevention techniques and processes, employee reporting of unsafe conditions, unsafe activities, and near-miss mishaps. The technical approach for safety shall be limited to two pages.
(b) Basis of Evaluation: The evaluation will collectively consider the following:
- Experience Modification Rate (EMR)
- OSHA Days Away from Work, Restricted Duty, or Job Transfer (DART) and Total Recordable Case
(TRC) Rates
- Offeror Technical Approach to Safety
- Other sources of information available to the Government
i. Experience Modification Rate (EMR): For the three previous complete calendar years 2017, 2018, and 2019, the offeror will submit EMR. If no EMR exists, the offeror may submit an insurance company-provided equivalent rate explaining why not. If an insurance company-provided equivalent rate is provided, it will be treated the same as an EMR. Any extenuating circumstances that affected the EMR and negative trends should be addressed as part of this selection factor. The board will evaluate the EMR to determine if the Offeror has demonstrated a history of safe work practices taking into account any negative trends and extenuating circumstances that impact the rating.
ii. OSHA Days Away from Work, Restricted Duty, or Job Transfer (DART) and Total Recordable Case (TRC) Rates: For the three previous complete calendar years, the offeror will submit their OSHA DART and TRC, as defined by the U.S. Department of Labor, Occupational Safety and Health Administration. If unable to submit OSHA DART and TRC rates, affirmatively state so, and an explanation must be provided. Any extenuating circumstances that affected the OSHA DART and TRC rate data and negative trends should be addressed as part of this element. The board will evaluate the OSHA DART and TRC rates to determine if the Offeror has demonstrated a history of safe work practices taking into account any upward trends and extenuating circumstances that impact rates.
iii. Technical Approach to Safety: The offeror will describe their plan to evaluate their safety performance and that of potential subcontractors. Also, describe any innovative methods that the Offeror will employ to ensure and monitor safe work practices at all subcontractor levels. The Safety Narrative shall be limited to two (2) single pages in length. (Note: Do NOT submit narratives of more than one page in length; only two (2) single pages will be evaluated). The Government will evaluate the narrative to determine the degree to which safety performance will be considered in the selection of subcontractors. The Government will evaluate the narrative to determine the degree to which innovations are being proposed that may enhance safety on this procurement and validate the contractor has addressed methodology to be used in the execution of an effective program that facilitates sound mishap prevention techniques/processes, employee reporting of unsafe conditions, unsafe activities, and near-miss mishaps.
iv. Other Sources of Information Available to the Government: Other sources for safety may include but are not limited to OSHA data, NAVFAC’s Contractor Incident Reporting System (CIRS) in Enterprise Safety Applications Management System (ESAMS), Contractor Performance Assessment Reporting System (CPARS) and other related databases.
Factor 3 – Past Performance
(a) Submittal Requirements: The offeror shall submit a finalized Contractor Performance Appraisal Report (CPAR) evaluation or a completed Past Performance Questionnaire (PPQ) [minimum of three (3), maximum of five (5)], Appendix 4.
This factor involves an evaluation of how relevant a recent contract effort was in regards to the RFP requirement in terms of scope size and complexity, and how well the Offerors performed as a prime contractor on the projects / contract effort. Recent and relevant projects entail Lease and Maintenance of High Industrial Equipment with approximate values of $500,000 or more completed within the past 5 years before the date of issuance of this RFP, or ongoing projects more than 80% complete.
IF A COMPLETED CPARS EVALUATION IS AVAILABLE, IT SHALL BE SUBMITTED WITH
THE PROPOSAL. IF THERE IS NOT A COMPLETED CPARS EVALUATION, the Past
Performance Questionnaire (PPQ) included in the solicitation as Attachment 3 is provided for the offeror to include in its proposal. AN OFFEROR SHALL NOT SUBMIT A PPQ WHEN A
COMPLETED CPARS IS AVAILABLE.
IF A CPARS EVALUATION IS NOT AVAILABLE, ensure correct phone numbers and email addresses are provided for the client point of contact. No more than three completed PPQs should be submitted with your proposal. If the offeror is unable to obtain a completed PPQ from a client for a project(s) before proposal closing date, the offeror should complete and submit with the proposal the first page of the PPQ, which will provide contract and client information for the respective project(s).
Offerors should follow-up with clients/references to ensure timely submittal of questionnaires.
