About this file

This is Amendment 0003 to Solicitation N40085-26-R-0228, a Design-Build (DB) contract for repair of Building 291 (King Hall) at Naval Station Newport, Rhode Island. The amendment was issued by NAVFAC Mid Atlantic Contracting Core on October 22, 2026, and is effective immediately. The amendment incorporates four key elements: a revised Price Proposal Form, a revised RFP Part 3 Chapter 1 dated October 20, 2026, a continuation sheet addressing changes to the Design Build RFP scope, and Pre-Proposal Inquiry (PPI) responses.

The continuation sheet specifies that any PPI responses included in amendments will supersede the original scope in the Design Build RFP dated November 2025. A critical change replaces the entire Design Build RFP Part 3, Chapter 1, Section 1.0 Project Description with the revised version included in this amendment. The amendment provides detailed responses to 172 pre-proposal inquiries addressing technical and administrative questions regarding radon mitigation systems, electrical panels, structural walls, PCB abatement procedures, fire protection and life safety analysis, acoustic requirements, hazardous materials handling, utility costs ($.30 per kWh), liquidated damages ($17,115.93 per day), existing conditions assessments, swing space operations, and FF&E relocation. Contractors are required to acknowledge receipt of this amendment prior to proposal submission. The contract point of contact is Catharine Keeling at catharine.a.keeling.civ@us.navy.mil. All terms and conditions of the original solicitation remain in effect except as modified by this amendment.

Inquiry: Part 3, Chapter 2 requires radon mitigation and identifies slab crack sealing, radon pits, piping to the roof, radon fans, and positive pressure in occupied spaces. However, ESR D20 and the plumbing drawing notes state that a certified radon mitigation specialist will determine the system approach after a pre-diagnostic site visit. Attachment P also recommends further diagnostics and mitigation recommendations.

The RFP does not establish a common quantity or configuration for bidders to price, and it is unclear whether an active system is required or a passive system could be accepted.

Please confirm whether bidders must include an active radon mitigation system in the base bid. To establish a consistent pricing basis, please define the minimum base-bid scope, including the number and locations of radon pits and fans, extent of piping and roof penetrations, slab sealing, HVAC pressurization requirements, and required post-mitigation testing and acceptance criteria. If the final system is intended to be determined solely from the post-award specialist assessment, please provide a common bid allowance or other defined pricing basis and clarify how work beyond that basis will be addressed.

Chapter 6.

D40

Part 3. Chapter 6. D40. What is the existing fire alarm and mass notification system and the current communication method.

Fire Alarm – Existing The building is currently provided with an antiquated fire alarm and detection system. The main control panel is a conventional fire alarm control panel manufactured by Kidde Automated Systems, Inc., and is located in the basement adjacent to the wing 1 stair enclosure near the main entrance. The panel is estimated to have been installed in the 1980’s but is well beyond the expected useful life a fire alarm panel. There was an annunciator located behind the watch desk at the main entrance. The annunciator appeared to be off and no longer functional. Manual Fire Alarm: Manual fire alarm pull stations are primarily located throughout the building near the entrances to the exit stair enclosures. They are installed at a height of approximately 5-feet, which is not compliant with current codes, but was compliant at the time of installation. Smoke Detection: Smoke detection is provided in the corridors, common areas, lounges, and at the top of each stair. Notification Appliances: The only general building notification provided by the fire alarm system is via the alarm bells located throughout the wings and in the basement. Single station smoke alarms are surface mounted to the ceilings of the berthing units and hardwired to a 120VAC receptacle. They are not interconnected to other smoke alarms or the existing facility fire alarm system. Smoke alarms were observed to be missing/removed from several of the sleeping rooms. The majority of smoke alarms appeared to be older than the 10-years typically associated with smoke alarms. FOLLOW

In our assessment, the first deck is the story of exit discharge for this facility; therefore, there are only three stories above the story of exit discharge. Based on this configuration, our interpretation is that an elevator is not required as part of the accessible means of egress.

Section 02 84 33, Paragraph 3.4(g), requires repeated cleaning of PCB-impacted adjacent building surfaces until post-remediation results are less than 1 ppm. If this result cannot be achieved, the Contractor must develop an encapsulation plan for EPA approval.

Section 2.2 identifies Sikagard 62, Sikagard 670W, Sikadur 35, BASF Sonoguard, or EPA-approved equivalents. Please confirm: (1) the required EPA approval pathway and anticipated review duration; (2) whether the listed encapsulants are preapproved or require project-specific EPA approval; (3) the required sampling method, frequency, and acceptance criteria;

(4) whether a contingency encapsulation plan may be submitted in advance to protect the mid-May through mid-September PCB work window; and (5) whether Government approval of the PCB Removal Work Plan is separate from EPA approval of the encapsulation plan.

Structural General Note 3 states: Do not remove all walls on the same deck at once. Vertical stacks of walls may be removed and replaced one stack at a time. That favors working one vertical bay/stack at a time, rather than demolishing every shear-wall opening across an entire floor. Please clarify if this is means and methods or if there are calculations that support that general note.

This requirement is in place to maintain the lateral stability of the structure.
