STEP 3: NEPA PROGRAM MANAGER RECOMMENDATION

STEP 4: COMMANDING OFFICER OR DELEGATED PUBLIC WORKS OFFICER DETERMINATION OF CATEGORICAL EXCLUSION (CATEX) APPLICABILITY AND RECORD OF CATEGORICAL EXCLUSION (RCE) I have previously reviewed the 27 August 2012 CNRMA Guidance for Implementing Categorical Exclusions Under the National Environmental Policy Act and the information within the attached Environmental Checklist supporting the use of this RCE. I find that the CATEX(s) identified below are applicable for the proposed project or activity and that even the presence of one or more of the extraordinary circumstances found in the Navy’s NEPA Implementing Regulation, 32 CFR 775, would not result in environmentally significant impacts that would preclude the use of the identified CATEX(s). I acknowledge that, should the scope or applicable environmental laws or regulations that would affect the subject project or activity change, this RCE will no longer be valid and that a new Environmental Checklist shall be submitted for compliance with NEPA. I will ensure that this signed RCE will be retained locally for six years and that a copy will be forwarded to the installation NEPA Program Manager, COMNAVREG MIDLANT Environmental Planning Office, and NRMA office of General Counsel.

Comments: The proposed project will have no direct impact on industrial stormwater discharges from the site. Ensure all appropriate BMPs and controls are implemented during construction to prevent pollutants from entering the stormwater system and/or surrounding environment. Report all unauthorized discharges/spills to RDC at (757) 433-9111 and coordinate with Environmental division as needed.

POC Tara Fisher, (757) 433-3443

WW: Any release of wastewater from the site (ex-powerwashing water) to either the storm drain or sanitary sewer must be coordinated with and approved by the Water Program Manager. Best Managements Practice implementation or collection of the water may be required.

POC: Dawn Friedrichs (757)433-3434 Comments: As written, no impact to drinking water program.

POC: Dawn Friedrichs (757)433-3434 Comments: The EC describes possible drainage improvements on exterior of building; however, no ground disturbance acreage is provided. Please see attached inclusive MS4 comments, if applicable to exterior drainage improvements.

Ensure good housekeeping on site during construction to prevent pollutants from entering the stormwater system.

POC Tara Fisher, (757) 433-3443 Comments: Based on the expired 2017 Preliminary Jurisdictional Determination for Wetlands issued by USACE there are no wetlands anticipated to occur on the project site. The Installation does not have a current wetland delineation from USACE; however, wetland surveys in 2022 to support a new USACE wetland delineation determination also did not document wetlands within the project area. Also, per site knowledge area is existing impervious surface.

For laydown areas and any other outdoor work areas, appropriate erosion and sediment control should be utilized to avoid contamination into adjacent wetlands, waterways, ditches, and other stormwater systems. No equipment nor materials should be utilized nor stored in wetlands or waterways without proper permits. Note stormwater drains and ditches immediately adjacent and within project work zone connect to waters of the U.S. that are considered linear wetlands and protected under the Clean Water Act. Inappropriate erosion and sediment control that results in a release of material into an upland section of ditch that then runs into wetland/waters of the US is considered fill of wetlands and subject to the issuance of a notice of violation under the CWA.

POC for applicable BMP’s and regulatory compliance requirements: Michael Wright, PWD Oceana Natural Resources (NR) Program Manager, michael.f.wright@navy.mil, 757-433-3461.

Comments: Not applicable
Comments: Per Scott McPeek, 12 June 2023, no trees will be removed.

POCs for applicable BMP’s and regulatory compliance requirements: Doug Lynde Shultz, PWD Oceana Natural Resources (NR) Specialist, douglas.lyndeshultz1@navy.mil, 757-635-5436.

Comments: Several protected species occur on the installation or within the influence of the installation actions (e.g., air space, etc.). Particular species of concern include several bat, reptile, insect and bird species.

Consultation completed 06 June 2023, with the issuance of a No Effects determination for the Norther long-eared bat (USFWS Consultation/Project code: 2023-0090284), if the following measures are incorporated into the scope of the project. Official Species List and Concurrence letter attached. If the below measures are not incorporated into the scope for the project and executed, then the project may have to go to formal consultation:

-If project is altered to include exterior light alterations, the lighting must all be dark sky compliant (see attached Artificial Light Source Guidance for Wildlife) -No Removal nor Pruning of Trees -No Use of Equipment Exceeding the Ambient Noise Decibel Level for the area on the Installation -Conduct outdoor/exterior demolition and/or construction work during daylight hours -All observations of protected species should be reported to the below POC, ASAP, and wait for further instruction/guidance. If possible, photograph the animal and provide a location of where the animal was observed (approx. GPS location and/or detailed physical location description with land based reference "markers"). Since the animal should not be disturbed stay a minimum of 50ft away from the animal provide a GPS location from that point or if the animal leaves you can take a GPS point at the exact location of the animal.

Justification for No Effects Determination:

Justification for No Effects Determination:

-No Trees to be removed nor altered -Project noise levels and duration not anticipated to be greater than existing Installation Noise levels -No exterior light proposed -All outdoor/exterior work should be accomplished during daylight hours -No Milkweed Present on Site. Impacted area is currently concrete/impervious surface and mowed turf grass -Is not located on or adjacent to the beach Note: There are several species under consideration for inclusion on the ESA list that occur on the Installation. If these species become listed and this project has not been awarded before these species are listed, additional regulatory consultations will be and possibly permitting & mitigation may be required required before the project may begin.

POC for applicable BMP’s and regulatory compliance requirements: Michael Wright, PWD Oceana Natural Resources (NR) Program Manager, michael.f.wright@navy.mil, 757-433-3461.

Comments: Due to proximity to aircraft air space and helicopter landing sites, avoid creating Bird/Animal Aircraft Hazard (BASH) issues:

Ensure facility, equipment and housing does not have unsecured holes that lead to the inside from the outside. Holes/ventilation should be secured with mesh or other appropriate material to exclude wildlife from entry. For planning purposes, some species of bats can enter through holes as small as 6mm.

Ensure not to utilize gravel roofing material nor living roof material (live plant) as this could attract colonial nesting birds, which pose a Human Health & Safety Concern and BASH concern. Per Scott McPeek, 12 June 2023, the project proposes to utilize 1" gravel roofing.

Per Scott McPeek, 12 June 2023: gravel bed will be placed 5ft around the building, thus removing existing shrubs/grass; no plants will be planted; shrubbery needs to be removed to replace the existing cladding system and to maintain ATFP compliance; tenant will be maintaining the gravel beds.

Avoid creating perching or nest building areas on the building, which pose a Humane Health & Safety Concern and BASH concern. If these features cannot be avoided then measures need to be installed to minimize and avoid perching/roosting and/or nesting. Open rafters, though architecturally appealing, create bird roosting and nesting issues. Some Tower designs create nesting platforms (e.g., Osprey issues). If design cannot be altered to avoid perching or nesting opportunities, the activity must plan for daily removal of bird nesting material before eggs are laid. If eggs are laid do not remove without first coordinating with one of the POCs listed below.

Any storage structures or laydown area materials should be housed in a way to minimize its attraction to wildlife that could pose a Bird/Animal Aircraft Strike Hazard (BASH) on the installation. Areas of Mounded materials (soils, pipes, etc.) are very inviting to nesting, perching and/or feeding birds and to rodents which also attract larger animals to the area (prey/predator relationship). Areas of disturbed or seeded soil may also attract wildlife. Slit/hydro-seeding of seed or planting of plugs is preferred to minimize seed loss and attraction of wildlife into airspace.

Species of plants selected for landscaping or revegetation activities should be evaluated to select species that will minimize attracting wildlife that pose an elevated BASH threat to the airfield.

All outdoor trash receptacles (particularly those where food based trash is disposed) on site must be secured (lids/doors closed) at all times to avoid the attraction of wildlife to the site.

Comments: It is illegal to possess, harm or take a migratory bird without regulatory permit authorizations (inclusive of animal, active nest, eggs, and/or parts there of). Nesting birds could be present on the project site and associated laydown area. Do not harm or remove active nests. Contact the below POC for further guidance and action if an active nest (nest with eggs or hatchlings present) is present on the project site.

BGEPA:

Eagle impacts are not anticipated in association with this project. As of Mar 2023, there are no eagle nests within 660ft of the project site. Eagles are discouraged from nesting on the airfield.

Eagles begin nesting in the late fall/early winter timeframe, check back with the below POC annually for updates regarding eagle nest locations and associated requirements if a nest is confirmed within 660ft of the project area. If an eagle nest were located within 660ft of this project site, consultations/permits/mitigation/monitoring may be warranted and outdoor work limited as specified in the associated permit.

POCs for applicable BMP’s and regulatory compliance requirements: Michael Wright, PWD Oceana Natural Resources (NR) Program Manager, michael.f.wright@navy.mil, 757-433-3461; and Doug Lynde Shultz, PWD Oceana Natural Resources (NR) Specialist, douglas.lyndeshultz1@navy.mil, 757-635-5436.

Comments: Equipment should be clean prior to arriving on base to avoid introduction of new or spread of existing non-native invasive species to the base/location. After working at this site, equipment should also be cleaned prior to working in any other location/site on or off base.

Due to the known presence of non-native invasive species & noxious weeds in the area, on base soil/sludge/organic material removed from any projects on base should be disposed of appropriately off base. Materials on base should not be relocated anywhere on base beyond its originating location.

Soil/hay/sand/plants/mulch/etc. brought on base for this project should be certified clean (contaminate and noxious weed free). At this time USDA has noxious weed certification processes associated with hay, mulch, plants, and some sizes of gravel.

If project damages Navy property that requires revegetation, utilize native vegetation and ensure the source materials a certified noxious weed free. See landscaping comments for more information.

Comments: If equipment maneuvering at project site, laydown area, or associated transit result in damage to vegetation/soil (e.g., rutting), the damage to vegetation/landscaping will require grading and replanting to bring back to "original" conditions.

ONLY Native Species should be utilized. The installation is located within the Coastal Plains (C) of VA and as such species native to this zone should be utilized for vegetation/landscaping activities on base. The installation's Official Source for native status is through a combined use of <http://vaplantatlas.org/> and the book "Flora of Virginia," 2013. The installation also utilizes the USDA website, <http://plants.usda.gov/java/>, to determine wildlife value and potential Bird/Animal Aircraft Strike Hazard (BASH) concern levels.

Utilizing seed is not recommended for re-vegetating the site due to BASH concerns associated with attracting wildlife to the seed. Whenever possible utilize live plants to repair vegetation. If seed must be utilized, to reduce BASH concerns utilize slit seeding techniques to get the seed into the ground (do not leave seed visible on the ground surface). Also, avoid seed coverings which may entangle wildlife (e.g., net like materials). Seed coverings must be USDA certified noxious weed free.

Previously approved grasses for landscaping on the Installation included: Virginia Wildrye (Elymus virginicus); Purpletop/redtop (Tridens flavus); Broomsedge (Andropogon virginicus); Axonopus furcatus (Big Carpetgrass); Setaria parviflora (Knotroot Foxtail, Knotroot Bristlegrass); Danthonia spicata (Poverty Oatgrass); and Piptochaetium avenaceum (Eastern Needlegrass/Blackseed Speargrass).

Any vegetation planting lists should be submitted to the installation Natural Resources Manager for final approvals. (CAUTION: EXISTING PLANTS FOUND ON BASE, PLANTS IDENTIFIED in the INSTALLATION APPERANCE PLAN, or PLANTS IDENTIFIED in the LOW IMPACT DEVELOPMENT PLAN may NOT be Native Species. Select Only Native Species.)

Comments: Project is not located in the Chesapeake Bay Watershed per Virginia Hydrologic Unit Code mapping.

Comments: Additional Natural Resources:

Do not approach wildlife, do not try to touch or relocate wildlife, DO NOT KILL wildlife. For on base wildlife emergency issues, contact the Installation Command Duty Officer (CDO) and they will contact Installation Natural Resources staff to address the wildlife concern (animals only, not plants).

Feeding, harboring, harassment, collecting, killing, and/or releasing of animals/wildlife (this also includes feral animals) and plants on the installation is prohibited without obtaining authorized permits. Precautions should be taken to prevent negative impacts from coming in contact with wildlife.

This base is known to have poisonous plants (i.e., poison ivy), venomous snakes (i.e., copperhead and cottonmouth), bees/wasps/hornets, ticks, mosquitoes, rabid animals, etc.

POCs for applicable BMP’s and regulatory compliance requirements: Michael Wright, PWD Oceana Natural Resources (NR) Program Manager, michael.f.wright@navy.mil, 757-433-3461; and Doug Lynde Shultz, PWD Oceana Natural Resources (NR) Specialist, douglas.lyndeshultz1@navy.mil, 757-635-5436.

Comments: The proposed project as presented for Installation EV review is located solely on the installation/Federal property and does not propose to impact Natural Resources off of the installation, as such the Natural Resources Department has determined that their program areas of responsibility do not trigger the need for a Coastal Consistency Determination (CCD) given the project description and location provided for this EC. In the event that this project is modified outside of the boundary submitted with this EC, the activity will need to submit an updated EC for review prior to implementing the proposed changes that reflects the complete modification proposal.

Comments: Project is tied to L84 eProject # 1708283, bldg 448 exterior envelope repairs. Per conversation with Anne Partamian, 27 Jun 2023, the exterior/draingage and regrading work associated with L84 eProject 1779475 is now tied to L84 eProject # 1708283. Please ensure that L84 eProject # 1708283 project/activity POC is also supplied a copy of this updated EC.
Comments: For the subject Environmental Checklist and any applicable Categorical Exclusion (CATEX) to remain valid, all Environmental Media/Program Manager comments documented in this Checklist must be followed and incorporated into activities, project designs/specifications, and contract awards. A documented NEPA decision [i.e., signed Record of Categorical Exclusion (RCE), Finding of No Significant Impact (FONSI), or Record of Decision (ROD)] must be completed prior to undertaking any action or award of any contract. Failure to follow these requirements subjects the installation to unnecessary risk for environmental violations, repeat or additional regulatory consultations/permits, and schedule and cost overruns.
