Responses to Inquiries on Solicitation N40085-21-R-0043

1. Question: How many of the 14 compactors are Self Contained and how many are break away?

Response: Current contractor is utilizing Self-contained compactors.

2. Question: Some of the front-loading yellow lid recycle containers had cardboard slots in the front of the containers is this a requirement for all recycle containers.

Response: As performance based contract the Government depends on the contractor to use their expertise on what type containers are used. Based on historical issues, recycling containers with slots in the front and on the top to allow easy access for customers and less likelihood of bulky items being placed on the side of dumpster.

3. Question: Some of the roll off containers had metal lids on them. How many roll offs have these special lids, is it a requirement at certain locations and if so, what are the building locations for them?

Response: As a performance based contract the Government depends on the contractor to use their expertise on what type of containers are to be used.

4. Question: Can you confirm according to J-1503030-04 Location and Frequency there are 186 front load containers, 14 compactors and 17 roll offs.

Response: All information on Section J, Attachment J-1503030-04 are based on the current inventory.

5. Question: How many of the 14 compactors are Self Contained and how many are break away?

Response: The Government estimated quantity on the Non-Recurring ELINS is based on historical data of special events and clean-ups.

6. Question: Is the proposal to be submitted electronically or mailed?

Response: All proposals shall be submitted in accordance with: Section B – Submitting Your Proposal – Amendment 0001.

Submitting Your Proposal

Proposals should be sent via a commercial carrier, such as Federal Express, and shall be addressed to:

NAVFAC SYSCOM MIDLANT

Attn: Darlene H. Tucker 9324 Virginia Avenue Building Z-140, Room 216 Norfolk, VA 23511-3095

Proposals that are hand carried and emails will NOT be accepted.

7. Question: How much of the non-recurring work are we to price and does it pertain to this solicitation? For example, do we price E718 asbestos or E720 street sweeping or E721 policing of areas or E723 E724 filling, storing and placing sand bags? Are these part of the refuse contract?

Response: All Recurring and Non-Recurring ELINS (Base and Option Years) require a unit price and extended total. See Section B – B.10 Evaluation of Proposal.

8. Question: Will the Government please confirm that Attachment J-1503030-04, Historical Data, provides the Recurring work schedules for Roll Off containers, including compactors, as well as Front Load 8 cubic yard containers?

Under this scenario the following roll off schedule would result for 30 and 40 cubic yard containers, including compactors.

Response: Section J, Attachment J-1503030-04 is based collected historical data.

9. Question: If Attachment J-1503030-04 does not include schedules for roll off containers will the Government please provide a schedule for each MSW, Single Stream, Wood and Brush container?

Response: Please review Spec Item 3, Performance Standard. This is a performance based contract, all schedules are created by the contractor to ensure performance standards are met. All schedules will be submitted to the KO/PAR per deliverable requirements.

10. Question: Attachment J-1503030-04 does not provide information for Wood or Brush roll off containers, is it correct to assume that these are on call and included in Non-recurring ?

Response: Please note Recurring and Non-Recurring ELINS. Both 30 and 40 CY (wood) (Wood, Pilings, and utility Pols) are listed.

11. Question: Will the Government please provide a minimum of 90 days from date of award to start date? The solid waste industry container manufacturers are experiencing severe delays in delivery times due to the impact of the Covid 19 pandemic. PLEASE see the 2 attached letters from major solid waste container manufacturers serving the Newport RI market area.

Response: The transition period will remain 30 days at stated in Section F – F.2 - Performance Period of Contract and Section M – Evaluation Factors for Award – Factor 1, Management Approach (i) (a), Phase-In Transition Plan.

12. Question: Some of the Non-Recurring Price Work options are out of the scope of services a traditional waste and recycling hauling company provides. Some Non-Recurring line items are janitorial in nature (A721, A731 & A741) some handle hazardous waste (A718 is for asbestos hauling), and some handle emergency site sandbags (A723, A724 & A725).

Will our proposal be penalized for not providing pricing for Non-Recurring items that are not related to servicing non-hazardous waste and recycling?

Response: All Non-Recurring ELINS are based on the Government Template and the customer requirements.

13. Question: Pricing for Recurring Services – All permanent 10-40CY container and compactor services are typically priced by a combination of three rates, which are 1.

hauling of the container, 2. disposal of the materials in the container, and 3. rental of the equipment. Which rate would you like entered in the unit pricing for those recurring services? I understand from my review of your excel calculations that the number to be entered as our “unit price” is a per unit rate that is annualized. Without being provided either an estimated or a historical quantity of hauling and disposal volumes for each line item, we are unable to provide an accurate annual amount. As such, we currently have added the rental rate of the equipment in for those unit prices, as it is the only constant figure. It also appears you may be capturing the entire disposal portion in the line item for non-recurring work A709, as that amount is for 10,000 tons of potential disposal per year.

Response: Please review Annex 1503030, Spec. Items 3 – FFP Work and 3.5 Compactors and Containers.

14. Question: In reviewing the Solicitation, we noticed that at page 72 of 126, the Solicitation incorporates by reference FAR 52.219-14 Limitations On Subcontracting MAR 2020.

However, as you will note from your review of the attached Memorandum from the Under Secretary of Defense, all DoD contracting officers are required to use “52.219-14, Limitations on Subcontracting (DEVIATION 2020-O0008), in lieu of FAR 52.219-14.”

See p. 2 of the Memorandum. Because of the very material difference in the requirements between “52.219-14 Limitations On Subcontracting MAR 2020” and “52.219-14, Limitations on Subcontracting (DEVIATION 2020-O0008)” and the impact on small business concerns compliance with regulatory requirements, would you please amend the Solicitation so that the required clause, “52.219-14, Limitations on Subcontracting (DEVIATION 2020-O0008)” is incorporated rather than “52.219-14 Limitations On Subcontracting MAR 2020.”

Response: FAR CLAUSE, “52.219-14, Limitations on Subcontracting (DEVIATION 2020-O0008) is incorporated in Amendment 0002 of this solicitation. FAR CLAUSE “52.219-14 Limitations On Subcontracting MAR 2020.” Is hereby deleted from this solicitation.
