NO Reference Question Government Response
SF1449, Page 20 of 60, 2.(c)(d)
Does the employee of the prime contractor need to be a qualified person? If a subcontractor's employee is a qualifier, does the subcontractor need to have completed SAM registration at the time of bid submission? Is it possible to change the qualifications after the bid has been awarded?
Key personnel have to meet the required qualifications stated in the PWS and they must be direct employees of the Prime contractor.
Qualified personnel other than Key personnel can be from the subcontractor.
See PWS Annex 2, 2.7.1 Key Personnel.
Subcontractors do not have to be registered in SAM.
All qualified personnel must be approved by the KO. See PWS Annex 2, 2.7.2.1 Employee Certification and training.
SF1449, Page 20 of 60 2.(c)(d)
If I get the bid, could an employee who is not a qualified primary bidder get a Base access pass?
Or is it only for qualified employees?
All of the Prime’s workers, including all of the Prime and subcontractors workers, can request the base access passes.
SF1449, Page 20 of 60 2.(c)(d)
At the time of bidding, the subcontractor is registered with SAM system.
Could we add subcontractors after bidding?
Could I add more qualified person?
See response to question 1.

A project with an annual value of at least ¥50,000,000, is the total amount par year? or for one project? We must submit 5 projects of at least ¥50,000,000?
For example, the amount of one project is ¥30,000,000. And we have 5 projects for ¥30,000,000. Is it acceptable or not?
See amendment 01.

Recurring work limits of liability
It is referenced in some locations as "recurring liability limits", "liability limits", or "recurring work limits". All the references I can find in the PWS of this limit just point to other locations in the PWS that also point to another location to find the limit. Therefore, it just creates a circle of references without ever stating what the limit is."
Recurring work limits of liability only apply to recurring work described in 1502000 Spec Item 3.1.1 Emergency Service Orders and are priced in Attachment J-0200000-11 ELIN X001AA. The description in ELIN X001AA (Base and all Option years) is changed as "Emergency Service Order Work for Split Type A/C (1502000, Spec Item 3.1.1). See RFP Attachment (2) ELIN-MFH-Revised Amend 0005.
AC Units Are the lists of units currently in use accurate? If following the ICAP training, there will be many AC units that may need to be replaced soon.
When large orders for replacements are made, is there a short deadline for accomplishing all the replacements or would they need to be accomplished in a specific short period? This decides manning requirements and use of sub-contractors.
The list of units currently in use is accurate. Customer intends to use end-of-life/obsolete equipment until breakdown, there is no lifecycle replacement strategy, see Sub-Annex 1502000 Spec Items
4.2.30 through 4.2.56 for replacement instructions. See Attachment J-1502000- 08, Section 23 00 00, Part 2 - Products, Para 2.1.2 - Compatibility.
Inventory Management System
Will the awarded contractor be able to use a US Government provided inventory management system, such as is described in the ICAP training? If so, will there be training provided during the transition phase to ensure everyone is up to speed on the system before contract performance begins?
Refer to Sub-Annex 0200000, Spec Items
2.6.8 and 2.6.8.1.
No additional training will be forwarded.
Recurring Work Service Order Limits of Liability
(LOL)
According to the current wording in the PWS, a recurring work order would include all services to bring a system up to fully functional and normal condition. These services should be a part of a defined Service Order and Other Recurring Service Program developed, implemented, and executed by the Contractor but issued by the Government. The Government can combine requirements in the same building or structure into one service order as long as the service order threshold is not exceeded. Being as there is a 200 order limit for recurring service orders during a one-year performance period, the ability to combine like services allows the Government to conserve recurring service order numbers will ensuring necessary maintenance is performed while reducing the number of service orders made. On the other hand, LOL are set to ensure that the Contractor is not required to perform unlimited hours of labor or cost of parts for a service order. In the example given above, when the unit is determined to need replacement a non-recurring work order should be issued.
The decision is made by the Contractor notifying

the COR of the service order exceeding the liability limits and requesting additional guidance. The Contractor cannot make the determination of when to contact the COR if there are no limitations set. The Contractor uses these limits to determine what their maximum liability would be and then fix their price.
Recurring service orders are separated into three classifications: routine, urgent, and emergency.
There are many references to liability limitations for service orders. The only classification that has limitations set is emergency. The purpose of these categories is to provide the Government with a means of issuing work up to a defined liability limit for requirements occurring outside of the specified recurring work. This is done based on the respective liability limit for the service order's classification.
Our greatest concern is with the Recurring Service Order Work (i.e. ELIN A001A). The majority of recurring work will be routine service orders to maintain full functionality of the AC units according to the Service Program.
Routine service orders are defined as any work requirement within the defined LOL that does not qualify as emergency or urgent. Without having a set LOL, it is not possible to set a competitive price for this ELIN as the Contractor would not properly understand their liability related to this work. Currently, it would seem unlimited other than a total number of service orders.
We propose that appropriate LOL be set for each of the three recurring work classifications, routine, urgent, and emergency. This ensures that the Contractor can more clearly determine their liability. Also, we propose that it would benefit the Government to separate the recurring work ELINs in to three. With each of these service orders having differing liabilities, the price for the different classifications would be different. By giving the Contractor a better idea of their liability the Government will receive more competitive offers.
