In addition, if the PCO determines that the number of quotations that would otherwise be in the competitive range exceeds the number at which an efficient competition can be conducted, the PCO may limit the number of quotations in the competitive range to the greatest number that will permit an efficient competition among the most highly rated quotations.

3. T he number of proposals to be evaluated for technical acceptability may be limited to the lowest priced offer at the discretion of the Contracting Officer. If the number of proposals to be evaluated is limited, the technical proposal shall be provided to the evaluator(s) without any identification of price. If the lowest priced proposal is not found to be technically acceptable then the next lowest price proposal shall be evaluated. If that proposal is also not found to be technically acceptable, then the process described will be conducted again as many times as necessary, until such time as the Government identifies a technically acceptable proposal. The source selection method must be included in the request for proposal. If the Contracting Officer later determines that discussions are necessary, the procedures in FAR 15.306 shall be followed.

4. The LPTA process is selected as appropriate for this acquisition because the best value is expected to result from selection of the technically acceptable quotation with the lowest evaluated price.

5. An overall non-price factors rating must be at least “ACCEPTABLE” in order to be eligible for award.

An “UNACCEPTABLE” rating in any factor results in the overall non-price factors quote being rated “UNACCEPTABLE” unless corrected through discussions. An overall non-price factors rating of “UNACCEPTABLE” makes a quote ineligible for award.

6. Any quote found to have a deficiency in meeting the stated RFQ requirements or performance objectives will be considered ineligible for award, unless the deficiency is corrected through discussions. A deficiency is defined to be a material failure of a quote to meet a Government requirement or combination of significant weaknesses in a quote that increases the risk of unsuccessful contract performance to an unacceptable level.

EVALUATION FACTORS FOR AWARD

The RFQ requires the evaluation of price and the following non-price factors:

Factor 1 – Experience Factor 2 – Safety Factor 3 – Past Performance

Award will be made based on the lowest evaluated price quotation that is technically acceptable under the non-price factors.

Submittal Requirements and Basis of Evaluation for Price Factor.

1. Submittal Requirements:

Offerors shall submit 1 original, 3 hard copy and 1 CD of the proposal in three-ring binders clearly marked as “Proposal”. Each copy of the proposal shall include a separate tab for each item specified below:

(i) Although not part of the evaluation, Offerors should also include the following items if available with their proposal to assist the Government in validating eligibility to receive an award:

An informational page that contains the following information:

- Solicitation number and title

- Contractor name, address, phone number, point of contract, and email address

- DUNS number

- Cage code

(ii) Completed Standard Form 1449, RFQ /Contract/Order for Commercial. All prices shall be in Japanese Yen.

(iii) Acknowledgement of all Amendments, if applicable.

(iv) Completed Attachment J-0200000-05 Exhibit Line Item Numbers (ELINs) (CD in Microsoft Excel format)

(v) Copy of Representations/Certifications (FAR & DFARS Report)

(The Representations and Certifications may be completed ONLINE at https://sam.gov)

(vi) Joint Venture Agreement (if applicable)

(vii) Copy of current registration in the System for Award Management (SAM) website

Failure of an Offeror to complete and submit all applicable items will result in the Offeror’s quote being deemed non-responsive and ineligible for further consideration for award.

2 . Basis of Evaluation:

The Government will evaluate price based on the total price. Exhibit Line Item Numbers will be reviewed for price reasonableness. Analysis will be performed by one (1) or more of the following techniques to ensure a fair and reasonable price:

- Comparison of quoted prices received in response to the RFQ.

- Comparison of quoted prices with the Independent Government Estimate.

- Comparison of quoted prices with available historical information.

- Comparison of market survey results.

A price that is found to be unreasonably high will result in the quote not being considered for contract award.

Submittal Requirements and Basis of Evaluation for each Non-Price Factors.

Factor 1 – Experience:

1. Submittal Requirements:

Offeror shall submit a minimum of 1 and a maximum of 3 projects performed by the company that are relevant to work requirements specified in the solicitation.

For purposes of this evaluation, a relevant project is defined as follows:

(i) A project that demonstrates experience with the following type of services: Maintenance of Fire Protection

Systems and Hood & Duct Services (Annex 1502000)

(ii) A project performed in Japan;

(iii) A project with a contract completion date within the past 10 years of the issuance of this solicitation or an ongoing project with at least one year of completion;

(iv) A project with an annual value of ¥20,000,000 or greater.

Any projects submitted in excess of 3 will not be considered. If more than 3 projects are submitted, only the first 3 shall be considered.

In addition to the above, offerors may also include past experience information regarding predecessor companies, and subcontractors that will perform major or critical aspects of the requirement so long as at least 1 project has been performed by the prime contractor.

The attached Experience Form (Attachment 6) is mandatory and shall be used to submit project information. Except as specifically requested, the Government will not consider information submitted in addition to this form.

Individual blocks on this form may be expanded; however, total length for each project data sheet shall not exceed 1 double-sided or 2 single-sided pages. Any data submitted in excess of the 1 double-sided page or 2 single-sided pages will not be considered/evaluated.

For all submitted projects, the description of the project shall clearly describe the scope of work performed and the relevancy to the project requirements as described above.

Joint Ventures If the Offeror is a Joint Venture (JV), relevant project experience should be submitted for projects completed by the Joint Venture entity. If the Joint Venture does not have shared experience, at least 1 project shall be submitted for each respective Joint Venture partner. Offerors are still limited to a total of 3 projects combined.

Where an Offeror is/was a JV and would like to submit a project completed by the JV as a single entity to show the single entity's experience/capability, said JV project must clearly demonstrate the percentage of work performed by each firm in the JV and the single entity Offeror must provide a detailed description of the work the single entity self-performed.

2 . Basis of Evaluation:

The Government will evaluate Technical Experience based on relevancy of project in terms of scope, and complexity in comparison to the work being solicited. Relevant means sufficiently similar to this acquisition to provide indicators of expected performance. For example, services similarity and complexity, contract type, dollar value, major or critical subcontractors, teaming partners and joint ventures. The listing will be validated by the Government.

A quoter will be rated “Acceptable" if its submission for Factor 1 meets the definition of a relevant project as provided in the RFQ's Factor 1-Experience Submittal Requirements.

A quoter will be rated "Unacceptable" if the proposal does not meet each of the criteria of an “Acceptable” proposal defined above.

NOTE: The distinction between experience and past performance is experience pertains to the types of work and volume of work completed by a contractor that are comparable to the types of work covered by this requirement, in terms of size, scope, and complexity. Past performance pertains to both the relevance of recent efforts and how well a contractor has performed on the contracts.

Factor 2 – Safety:

1. Submittal Requirements:

The Offeror shall submit a narrative no more than 2 single-sided (1 double-sided) pages that demonstrates its commitment to safely accomplishing the requirements identified in the Performance Work Statement and will properly manage and implement safety procedures and accident prevention methods. The narrative should address each of the following topics:

(i) the offeror’s method for selecting a subcontractor with a safe performance record;

(ii) the offeror’s safety management system that they will use to oversee the safety compliance and performance of self-performed and subcontractor performed work;

(iii) the offeror’s methodology to execute an effective program that facilitates accident prevention techniques and processes, and employee reporting of unsafe conditions and unsafe activities.

2. Basis of Evaluation:

The Government is seeking to determine whether the information contained in the Offeror’s proposal demonstrates a commitment to safety and that the Offeror plans to properly manage and implement safety procedures and accident prevention methods for itself and its subcontractors.

An Offeror will be rated “Acceptable” if it demonstrates a commitment to safety and that the Offeror plans to properly manage and implement safety procedures and accident prevention methods for itself and its subcontractors.

An Offeror will be rated “Unacceptable” if it fails to meet the requirements to be rated acceptable described above.

Factor 3 - Past Performance:

1. Submittal Requirements:

Offerors shall clearly demonstrate a history of performance on contracts/projects that demonstrates experience in performing work similar to that described in the definition of a relevant project shown above. The offeror shall submit past performance information for each project included in its proposal for Factor 1, Experience. If a completed Contractor Performance Assessment Reporting System (CPARS) evaluation is available, it shall be submitted with the proposal. If there is not a completed CPARS evaluation, the Past Performance Questionnaire (PPQ) included in the solicitation is provided for the offeror or its team members to submit to the client for each project the offeror includes in its proposal for Factor 1, Experience. An offeror should not submit a PPQ when a completed CPARS evaluation is available. Ensure correct phone numbers and email addresses are provided for the client point of contact on the PPQ.

Completed PPQs should be submitted with your proposal. If the offeror is unable to obtain a completed PPQ from a client for a project(s) before proposal closing date, the offeror should complete and submit with the proposal the first page of the PPQ (Attachment 7), which will provide contract and client information for the respective project(s).

Offerors should follow-up with clients/references to ensure timely submittal of questionnaires. If the client requests, questionnaires may be submitted directly to the Government's point of contact, Ms. Chikako Yamada via email at Chikako.Yamada.JA@fe.navy.mil prior to proposal closing date. Offerors shall not incorporate by reference into their proposal PPQs or CPARS previously submitted for other RFQs. However, this does not preclude the Government from utilizing previously submitted PPQ information in the past performance evaluation.

Offerors may provide any information on problems encountered and the corrective actions taken on projects submitted under Factor 1 – Experience. Offerors may also address any adverse past performance issues.

Explanations shall not exceed 1 double-sided pages or 2 single-sided pages in total.

Performance recognition/award(s) or additional similar information submitted will not be considered.

In addition to the above, the Government may review any other sources of information for evaluating past performance. Other sources may include, but are not limited to, past performance information retrieved through the Past Performance Information Retrieval System (PPIRS) using all CAGE/DUNS numbers of team members (partnership, joint venture, teaming arrangement, or parent company/subsidiary/affiliate) identified in the offeror’s proposal, inquiries of owner representative(s), Federal Awardee Performance and Integrity Information System (FAPIIS), Electronic Subcontract Reporting System (eSRS), and any other known sources not provided by the offeror.

While the Government may elect to consider data from other sources, the burden of providing detailed, current, accurate and complete past performance information rests with the Offeror.

2. Basis of Evaluation:

The Government is seeking to determine if the quoter has relevant and recent past performance information that pertain to the products and/or services outlined in the RFQ. The past performance evaluation results is an assessment of the Quoter’s probability of meeting the RFQ requirements. The evaluation will consider how well the Quoter performed on recent and relevant projects submitted under Factor 1 and may also consider past performance on other projects currently documented in known sources. The Government will consider the recency and relevance of the information, the source of the information, context of the data, and general trends in the Quoter’s performance.

This evaluation is separate and distinct from the Quoter’s responsibility determination.

The Government will evaluate the degree to which past performance evaluations and all other past performance information reviewed by the Government (e.g., PPIRS, Federal Awardee Performance and Integrity Information System (FAPIIS), Electronic Subcontract Reporting System (eSRS), performance recognition documents, and information obtained from any other source) reflect a trend of satisfactory performance considering:

- A pattern of successful completion of tasks;

- A pattern of deliverables that are timely and of good quality;

- A pattern of cooperativeness and teamwork with the Government at all levels (task managers, contracting officers, auditors, etc.); and

- Recency of tasks performed that are identical to, similar to, or related to the task at hand”

A quoter will be rated “Acceptable” if a quoter’s “Past Performance” information demonstrates: (1) An overall rating of at least Satisfactory or better on the Past Performance Questionnaires, Attachment 7 of this RFQ, (2) An overall rating of at least Satisfactory or better in the CPARS or other DOD or Government appraisal systems, or (3) Past Performance Evaluations from telephone interviews of Satisfactory or better.

A quoter will be rated “Unacceptable” if a quoter’s “Past Performance” information fails to demonstrate: (1) An overall rating of at least Satisfactory or better on the Past Performance Questionnaires, Attachment 7 of this RFQ,

(2) An overall rating of at least Satisfactory or better in the CPARS or other DOD or Government appraisal systems, or (3) Past Performance Evaluations from telephone interviews of Satisfactory or better.

Note: In the case of a Quoter without a record of relevant past performance or for whom information on past performance is not available or is so sparse that no meaningful past performance rating can be reasonably assigned, the Quoter may not be evaluated favorably or unfavorably on past performance (see FAR 15.305 (a)(2)(iv)).

Therefore, the Quoter shall be determined to have unknown past performance. In the context of acceptability/unacceptability, “unknown” shall be considered “Acceptable.”

A quote receiving an “Unacceptable” evaluation rating for Factor 3 will be ineligible for award.

1. Responsibility Determination / Pre-Award Survey

FAR 9.103 requires that purchases shall be made from, and contracts shall be awarded to, responsible prospective contractors only. Purchase or award shall be made only after the Contracting Officer makes an affirmative determination of responsibility.

To be determined responsible, a prospective contractor must—

(a) Have adequate financial resources to perform the contract, or the ability to obtain them (see 9.104-3(a));

(b) Be able to comply with the required or proposed delivery or performance schedule, taking into consideration all existing commercial and governmental business commitments;

(c) Have a satisfactory performance record (see 9.104-3(b) and subpart 42.15). A prospective contractor shall not be determined responsible or non-responsible solely on the basis of a lack of relevant performance history, except as provided in 9.104-2;

(d) Have a satisfactory record of integrity and business ethics

(e) Have the necessary organization, experience, accounting and operational controls, and technical skills, or the ability to obtain them (including, as appropriate, such elements as production control procedures, property control systems, quality assurance measures, and safety programs applicable to materials to be produced or services to be performed by the prospective contractor and subcontractors)

(f) Have the necessary production, construction, and technical equipment and facilities, or the ability to obtain them

(g) Be otherwise qualified and eligible to receive an award under applicable laws and regulations (see also inverted domestic corporation prohibition at 9.1

AWARD OF CONTRACT

1. The Government reserves the right to eliminate from consideration from award any or all quotes at any time prior to award of the contract(s) that do not conform to the RFQ; to negotiate with offerors in the competitive range; and to award a contract to the offeror(s) submitting the lowest price technically acceptable quote(s) that conforms to the

RFQ.

2. As stated in the solicitation, the Government intends to evaluate proposals and award a contract without discussions with Offerors (except clarifications as described in FAR 15.306(a)). The Government reserves the right to conduct discussions if the Contracting Officer later determines them to be necessary. In addition, the number of proposals to be evaluated for technical acceptability may be limited to the lowest priced offer at the discretion of the Contracting Officer.

3. The Government will award a contract resulting from this solicitation to the responsible Offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered.

This is a Lowest Price Technically Acceptable (LPTA) solicitation, which is best value resulting from selection of the technically acceptable proposal with the lowest evaluated price.

This is a request for quote for commercial items prepared in accordance with the format in FAR Subpart

12.6 (Streamlined evaluation of offers). This RFQ is issued as a Request for Quotation (RFQ) in accordance with

FAR 13.106. Written quotes are required (oral offers will not be accepted). Submission of quotes must be in accordance with FAR 52.212-1, Instructions to Offerors, Commercial Items. The Government will award Contract on the basis of the lowest priced offer with acceptable past performance. Since award of the Contract will be based on initial responses, offerors are highly encouraged to quote their most advantageous pricing in their initial response.

Award of the Contract will be made using the Simplified Acquisition Procedures in accordance with FAR 13.106- 2(a)(3)(b)(1).

A written notice of award mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract once accepted by the successful contractor. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), unless a written notice of withdrawal is received before award.
