Page Section Para.

Drawin g C‐101

Please provide the “property lines” as they pertain to the Building 712 site.

Do the “proposed site limits” shown on sheet C‐101 constitute the property lines?

Building 712 has no real property lines. However, a Building Code Site plan shall be provided as required by FC 1‐300‐09N,§7‐6.1. The site plan shall be prepared by the fire protection designer of record and must show the line of encroachment identifying minimum separation distances from adjacent buildings and assumed property lines (movable imaginary lines for the purpose of fire separation between buildings) of the new construction and of the adjacent structures."

The existing plant has a propane tank used for the oil burner pilots prior to the introduction of gas to the site.

Does the Government desire to maintain the propane service for use during gas interruptions?

Refer to “1374726_Steam B_Amendment 0001”

The existing gas meter appears that it will be too close to the building to meet AT/FP requirements. Does the Government anticipate or expect Contractor action to correct the location?

Per 2.3.6 Antiterrorism Criteria This Facility will have an occupancy designated as low occupancy and UFC 4‐010‐01, (19 August 20), does not apply.

MEP‐602

The truck loading and unloading stations show the use of “self priming centrifugal pumps”. Fuel pumps are typically positive displacement. Are centrifugal pumps an absolute requirement, or can positive displacement pumps be used?

Refer to “1374726_Steam B_Amendment 0001”

The RFP makes specific references to code editions. Please clarify if the stated sections are to be used, or if versions are selected based on the current version per UFC 1‐200‐01, Change 1, dated 24 Feb 2023.

Refer to 1374726_Steam B_Amendment 0001”

Attachment K, para2.3.5 Accessibility Requirements, p. 333 of

Part 3, Paragraph 2.3.5 has a statement that the plant does not need to be accessible. This overlooks the possibility of supervisory or regulatory personnel who are mobility impaired visiting the plant.

Previous DoD plants have been built with limited accessibility to the firing floor, office, and toilet rooms. Please clarify the accessibility requirements.

Agree that ABA compliance is not required given the understanding that this is a temporarily occupied building for occasional monitoring of equipment. The RFP notes the user’s invoking of the able bodied exclusion under Article 3 of the SECDEF memo. Note that using this requirement does have a memo component that needs to be filled out and signed off on by the Installation Commander. ‐That said, the conceptual plan in the RFP appears to show an accessible path to the Control Room and the Toilet. I do think we could get the ABA 5’‐0” diameter turning radius in both spaces as well. So where it is not required, if we can provide accessibility with minimal effort, we should do so. The SECDEF Memo does state in Article 3 Exclusions:

“Nevertheless, since the intended use of such excluded facilities may change with time or in emergencies, compliance with these DoD Standards is recommended to the maximum extent that is reasonable and practicable without degrading the military utility.”

Attachment K, para 2.3.6 Antiterrorism Criteria, p.

Part 3, Paragraph 2.3.5 Is ATFP required? There are conflicting paragraphs. Please clarify project intent.

Per 2.3.6 Antiterrorism Criteria This Facility will have an occupancy designated as low occupancy and UFC 4‐010‐01, (19 August 20), does not apply.

Attachment K, para 2.4.2 Civil/Site, p. 337 of 1730

Part 3, Paragraph 2.4.2 has a requirement for double wall tanks located inside the containment area.

Use of double wall tanks in conjunction with a containment basin is not required per COMAR. Please clarify project intent.

Storage Tanks shall be in complience with NFPA 30. Stored #2 fuel is classified aws Class II liquid. Provide tanks as specified in the RFP.

Question # 1

Please confirm the government period of performance as Amendment # 1 states 1022 calendar days and Amendment # 2 ‐ Phase II states 1037 calendar days.

1037 calendar days is correct. 1022 calendar days is the Construction Duration, the additional 15 days includes time permitted for bonds approvals

Attachment K, Part 3, Section 5, 101, #11 sizes the deaerator for an 80,000 PPH load and requires 30 minutes of storage at full load. However, the deaerator schedule on drawing MEP‐ 701 specifies a rating of 75,000 PPH, a storage volume of 1,850 gallons, and a storage capacity of 10 minutes.

D3020 further specifies full plant capacity deaerators with common 30 minute capacity storage tank. If the load is 75,000 PPH (~150 GPM), 10 mins of storage would be 1500 GPM.

For 80,000 PPH (~160 GPM), 10 mins of storage would be 1,600 gallons. If the boilers are rated for 34,526 pph, full plant capacity would be ~69,000 PPH (~138 GPM) and 30 minutes of storage would be ~4,141 gallons. We are requesting clarification on the desired rated capacity of the deaerator and the required storage in minutes for that rating.

Provide deaerator based on RFP Part 3 D3020 requirements.

14 6 D302001 1.7

What is the basis for providing a blowdown tank of a minimum of 1,200 gallons? This tank seems larger than should be required for the boiler plant size.

Provide a 1200 gallon blowdown tank.

Boiler;

Paragr aph 1

The boiler schedule on drawing MEP‐ 701 specifies a "Nominal HP" of 1,000 for each boiler with an output of 33,500 MBH and 34,526 PPH. This contradicts D3020 which requires a capacity of 34,600 MBH at 200 psig operating pressure. Boiler ratings are from and at 212 °F and 0 psig. The output capacity of a 1,000 HP boiler at 200 psig will only be 33,475 MBH and 33,304 PPH. Is the intent to receive 1,000 HP boilers or 1,100 HP boilers? An 1,1100 HP boiler will provide a capacity of 36,822 MBH and 36,635 PPH.

Provide boilers based on RFP Part 3 D3020 requirements.

The requirement for Attachment F states in part: "Small Business utilization will be evaluated on past performance projects that required the use of a Small Business Subcontracting Plan (SBSP)" and ."Attachment F shall be provided for each project submitted under Factor 2, Experience". None of our projects featured in Factor 2, Experience required SBSPs as the projects were set aside for small businesses already. As this is the case, Small Business goals and data were not tracked. Please advise if Attachment F is only to be completed for projects that required SBSPs and goals, or if it is to be completed for every project submitted under Factor 2, regardless of required SBSPs and goals. Also, please advise if Attachment F is just to be completed for the projects pertaining only to the Offeror, or for projects pertaining to both the Offeror and the Offeror's chosen Design Firm. If the latter, there could be as many as 10 projects for which the Offeror has to provide this data in Factor 6.

Attachment F is required for all projects that required Small Business Subcontracting Plan (SBSP).

If a SBSP was not required due to the project being a small business set‐aside please indicate that.

2.a & 2.b

Attachment G ‐ 2.a asks for the total contract value (the offeror's proposed price for the project, as we understand it). We are not accustomed to providing our "price" in the technical proposal. Please advise that the offeror is to provide their proposed price in 2.a. If not, please confirm it is acceptable to leave this section blank. (Normally for this type of form, we are used to providing percentages for each of the Small Business categories, but not dollar values.)

There are no changes, please complete Attachment G as indicated.

Site Visit | After contract award and during the Design Period will the contractor be responsible for existing government assets and temporary equipment? If yes, provide the governments expectations.

Contractor shall strictly follow NSF Indian Head safety and security regulations, protecting of Government assests during entire project process, from the early stages of site visits in pre‐contract award phase, to design phase after Contract award, and during construction phase. Protection of Government assets is a primary Contractor's duty.

Please confirm that the new Liquid Fuel Oil Tanks shall be UL 2085 rated.

Refer to RFP Part 3 for tanks requirements.

Page 367/1730

Marlo Dealkalizer/softener | Based on the overall condition of the existing Marlow system could the government amend scope to replace the existing with a new. This would allow the government and contractor to manage the warranty of all new assets. If replacement is not an option, will any maintenance, repairs and salt be provided by the government?

The dealkilizer will be a government furnished equipment. From the 101‐ Boiler Room Data sheet: "Relocate existing Marlo dealkalyzer in its entirety from shelter northeast of existing Building 712, temporarily store and protect, service and place into operation in approximate location indicated on concept plans."

Page 743/1730

DX HVAC Units | Please confirm that the government is requiring copper/copper air cooled condensers or a 2000 hour salt spray coating.

Per RFP Part 3 D30 General System Requirements. From the B101 Boiler room data sheet: "Provide all mechanical equipment HVAC cooling/heating and condenser coils with a manufacturer approved coating system. The heat transfer rating must be as installed".

Page 463/1730

Non‐Potable Water | RO water extension from existing PNP to new Building 712R is just under 0.9 miles.

Providing electric heat trace will be difficult due to the lack of power in the proposed routing system. Would the government consider changing scope to have the contractor install a RO Skid sized for the new B‐712R boiler plant?

A packaged RO skid may be proposed as a design solution post award.

Site Visit | Will the new Steam Plant HVAC systems be required to integrate into a BAS system or will these assets be controlled stand‐ alone. If yes, please provide the preferred BAS vendor and contact information that services NSF.

Part 3 D302001 1.10.1 Boiler Controls details the plant control system requirements.

** Workers in this classification may be entitled to a higher minimum wage under Executive Order 14026 ($16.20) or 13658 ($12.15). Please see the Note at the top of the wage determination for more information.

Note: Executive Order (EO) 13706, Establishing Paid Sick Leave for Federal Contractors applies to all contracts subject to the Davis-Bacon Act for which the contract is awarded (and any solicitation was issued) on or after January 1, 2017. If this contract is covered by the EO, the contractor must provide employees with 1 hour of paid sick leave for every 30 hours they work, up to 56 hours of paid sick leave each year.

Employees must be permitted to use paid sick leave for their own illness, injury or other health-related needs, including preventive care; to assist a family member (or person who is like family to the employee) who is ill, injured, or has other health-related needs, including preventive care; or for reasons resulting from, or to assist a family member (or person who is like family to the employee) who is a victim of, domestic violence, sexual assault, or stalking. Additional information on contractor requirements and worker protections under the EO is available at https://www.dol.gov/agencies/whd/government-contracts.

Unlisted classifications needed for work not included within the scope of the classifications listed may be added after award only as provided in the labor standards contract clauses (29CFR 5.5 (a) (1) (ii)).

The body of each wage determination lists the classification and wage rates that have been found to be prevailing for the cited type(s) of construction in the area covered by the wage determination. The classifications are listed in alphabetical order of ""identifiers"" that indicate whether the particular rate is a union rate (current union negotiated rate for local), a survey rate (weighted average rate) or a union average rate (weighted union average rate).

Union Rate Identifiers

A four letter classification abbreviation identifier enclosed in dotted lines beginning with characters other than ""SU"" or ""UAVG"" denotes that the union classification and rate were prevailing for that classification in the survey. Example:

PLUM0198-005 07/01/2014. PLUM is an abbreviation identifier of the union which prevailed in the survey for this classification, which in this example would be Plumbers. 0198 indicates the local union number or district council number where applicable, i.e., Plumbers Local 0198. The next number, 005 in the example, is an internal number used in processing the wage determination. 07/01/2014 is the effective date of the most current negotiated rate, which in this example is July 1, 2014.

Union prevailing wage rates are updated to reflect all rate changes in the collective bargaining agreement (CBA) governing this classification and rate.

Survey Rate Identifiers

Classifications listed under the ""SU"" identifier indicate that no one rate prevailed for this classification in the survey and the published rate is derived by computing a weighted average rate based on all the rates reported in the survey for that classification. As this weighted average rate includes all rates reported in the survey, it may include both union and non-union rates. Example: SULA2012-007 5/13/2014. SU indicates the rates are survey rates based on a weighted average calculation of rates and are not majority rates. LA indicates the State of Louisiana. 2012 is the year of survey on which these classifications and rates are based. The next number, 007 in the example, is an internal number used in producing the wage determination. 5/13/2014 indicates the survey completion date for the classifications and rates under that identifier.

Survey wage rates are not updated and remain in effect until a new survey is conducted.

Union Average Rate Identifiers

Classification(s) listed under the UAVG identifier indicate that no single majority rate prevailed for those classifications; however, 100% of the data reported for the classifications was union data. EXAMPLE: UAVG-OH-0010 08/29/2014. UAVG indicates that the rate is a weighted union average rate. OH indicates the state. The next number, 0010 in the example, is an internal number used in producing the wage determination. 08/29/2014 indicates the survey completion date for the classifications and rates under that identifier.

A UAVG rate will be updated once a year, usually in January of each year, to reflect a weighted average of the current negotiated/CBA rate of the union locals from which the rate is based.

WAGE DETERMINATION APPEALS PROCESS

1.) Has there been an initial decision in the matter? This can be:

* an existing published wage determination

* a survey underlying a wage determination

* a Wage and Hour Division letter setting forth a position on a wage determination matter

* a conformance (additional classification and rate) ruling

On survey related matters, initial contact, including requests for summaries of surveys, should be with the Wage and Hour National Office because National Office has responsibility for the Davis-Bacon survey program. If the response from this initial contact is not satisfactory, then the process described in 2.) and 3.) should be followed.

With regard to any other matter not yet ripe for the formal process described here, initial contact should be with the Branch of Construction Wage Determinations. Write to:

Branch of Construction Wage Determinations Wage and Hour Division U.S. Department of Labor 200 Constitution Avenue, N.W.

Washington, DC 20210

2.) If the answer to the question in 1.) is yes, then an interested party (those affected by the action) can request review and reconsideration from the Wage and Hour Administrator (See 29 CFR Part 1.8 and 29 CFR Part 7). Write to:

Wage and Hour Administrator U.S. Department of Labor 200 Constitution Avenue, N.W.

Washington, DC 20210

The request should be accompanied by a full statement of the interested party's position and by any information (wage payment data, project description, area practice material, etc.) that the requestor considers relevant to the issue.

3.) If the decision of the Administrator is not favorable, an interested party may appeal directly to the Administrative Review Board (formerly the Wage Appeals Board). Write to:

Administrative Review Board U.S. Department of Labor 200 Constitution Avenue, N.W.

Washington, DC 20210

4.) All decisions by the Administrative Review Board are final.

Covered application means the social networking service TikTok or any successor application or service developed or provided by ByteDance Limited or an entity owned by ByteDance Limited.

Information technology, as defined in 40 U.S.C. 11101(6)—

(1) Means any equipment or interconnected system or subsystem of equipment, used in the automatic acquisition, storage, analysis, evaluation, manipulation, management, movement, control, display, switching, interchange, transmission, or reception of data or information by the executive agency, if the equipment is used by the executive agency directly or is used by a contractor under a contract with the executive agency that requires the use—

(i) Of that equipment; or

(ii) Of that equipment to a significant extent in the performance of a service or the furnishing of a product;

(2) Includes computers, ancillary equipment (including imaging peripherals, input, output, and storage devices necessary for security and surveillance), peripheral equipment designed to be controlled by the central processing unit of a computer, software, firmware and similar procedures, services (including support services), and related resources; but

(3) Does not include any equipment acquired by a Federal contractor incidental to a Federal contract.

(b) Prohibition. Section 102 of Division R of the Consolidated Appropriations Act, 2023 (Pub. The Contractor is prohibited from having or using a covered application on any information technology owned or managed by the Government, or on any information technology used or provided by the Contractor under this contract, including equipment provided by the Contractor’s employees; however, this prohibition does not apply if the Contracting Officer provides written notification to the Contractor that an exception has been granted in accordance with OMB Memorandum M–23–13.

(c) Subcontracts. The Contractor shall insert the substance of this clause, including this paragraph (c), in all subcontracts, including subcontracts for the acquisition of commercial products or commercial services.
