PERFORMANCE WORK STATEMENT

1.0 INTRODUCTION

1.1 The Naval Facilities Engineering Center (NAVFAC), Engineering and Expeditionary Warfare Center’s (EXWC) maintains a ready fleet of naval expeditionary equipment assets which support the mission of the United States Naval Expeditionary Forces and other Department of Defense (DoD) components worldwide.

1.1.1 Naval expeditionary equipment assets include a variety of standard commercial and militarized vehicles and equipment (refer to section 1.4 of this document).

1.1.2 EXWC equips, mobilizes, and sustains these naval expeditionary equipment assets to provide the end user with mission ready assets.

1.1.2.1 In addition, to maintain the readiness levels, EXWC retains the ability to perform repairs and maintenance on naval expeditionary equipment assets through organic and non-organic resources.

1.1.3 EXWC’s Expeditionary Maintenance Division is the principal organic resource for maintaining the readiness levels of naval expeditionary equipment assets.

1.1.3.1 To augment capabilities of EXWC’s Expeditionary Maintenance Division, EXWC manages an Equipment Support Services (ESS) Contract.

1.1.3.2 Within the context of this document, the term contractor references any contractor performing work under this contract, i.e. the ESS Prime Contractor and their subcontractors.

However, it should be noted that the ESS Prime Contractor bears ultimate responsibility for fulfilling the requirements of the contract.

1.1.3.3 Unless otherwise authorized by the Contracting Officer, the Contractor’s facilities where ESS related services are provided, shall be located within 175-miles of the Naval Expeditionary Equipment Epicenter (refer to section 1.5 of this document) that is the point of origin for the specific equipment.

1.1.4 The point of origin, and ultimate return point, of the naval expeditionary equipment assets will be at U.S. military installations located within the Contiguous United States (CONUS).

1.1.4.1 Only personnel, vehicles, and equipment (including transport means) that meets the requirements of the installation being accessed will be allowed onboard that installation.

1.1.5 It is the Contractor’s responsibility to provide personnel, vehicles, and equipment that can meet the access requirements of the particular military installation being accessed.

1.1.5.1 The Contractor shall validate access requirements with the Pass and ID Office of the installation being accessed prior to attempting to access the installation.

1.1.6 In addition, the Contractor shall submit the necessary documentation for access in sufficient time to meet schedule requirements.

1.1.6.1 Time in addition to what is allocated on Task Orders, will not be given to meet routine access requirements.

1.1.7 It should be noted that each military installation has access requirements specific to that particular installation.

1.1.7.1 Meeting the access requirements established by one installation does not constitute meeting the access requirements set by a different installation.

1.2 All ESS related services provided by the Contractor shall be conducted at facilities owned and/or operated by the ESS’s Prime Contractor or a pre-approved subcontractor.

1.2.1 The Contractor shall only utilize subcontractors and subcontractor locations for ESS Services approved by EXWC for this contract.

1.2.1.1 The Contractor shall identify locations and subcontractors where ESS related services is intended to be performed.

1.2.1.2 Any additional locations, changes to locations, additions or changes to subcontractors must be approved by the Contracting Officer assigned to the ESS contract prior to awarding any associated Task Orders (TO).

1.2.2 ESS services include: inspections, preventative maintenance, refurbishment, repairs, overhauls, upgrades, modernization, modifications, and Logistics Management Information Services provided to support of naval expeditionary equipment assets (refer to section 1.6 of this document).

1.2.3.2 The Contractor shall inform the COR in writing (e-mail is sufficient) each time equipment is transported; the COR must receive this notification no later than 24-hours prior to the transportation.

1.2.3.2.1 Notification must include: equipment to be moved (by USN, Make, and Type), current location of equipment, destination (company and address), and reason for relocation.

1.2.3.3 Notification on the part of the Contractor does not constitute concurrence from the COR.

The Contractor must receive written concurrence (e-mail is sufficient) from the COR prior to equipment being transported.

1.3 The Contractor shall perform all ESS related services at the Contractor’s facility or facilities (or EXWC approved subcontractor’s facility or facilities).

1.3.1 The Contractor’s facility or facilities (to include their subcontractor’s facility or facilities), where ESS services are being performed must be located CONUS.

1.3.2 Under no circumstances shall the Contractor transport Government property outside of

CONUS.

1.3.3 As a general rule, no repair work by a Contractor is to be conducted on a Government facility. However, the Government can make an exception to this rule its discretion.

1.3.3.1 Consideration for an exception may be given by the Government in cases where servicing can be accomplished immediately at the equipment’s location, or under certain circumstances in which the equipment cannot be moved.

1.3.3.2 It should be noted that exceptions to this rule are not often given. As such, the Contractor must have the exception from the Contracting Officer prior to the commencement of work.

1.3.3.3 It should also be noted that an exception granted for one tasking does not constitute, or otherwise stipulate, an exception for another task; even if the tasks are similar in scope. Each individual tasking, when applicable, must obtain its own exception.

1.4 The Contractor shall provide ESS related services for naval expeditionary equipment assets in accordance with the associated TO.

3.2 Within the context of this document, and associated TO, the term ‘Business Days’ shall be considered Monday through Friday, except for Federal holidays.

3.3 Federal holidays are identified as those designated by the federal government in section 6103(a) of title 5 of the United States Code.

3.4 ESS Services Process.

3.4.1 Request for Task Order Proposals (RFTOP). The process for ESS services begins with the release of a RFTOP by the Government to the Contractor.

3.4.1.1 The RFTOP will indicate the equipment involved and provide an overview of services being sought by the Government.

3.4.1.2 The RFTOP will be for either Inspection or Repair Services (reference sections 4 and 5 of this document respectively).

3.4.1.2.1 If the full scope of repairs are unknown, the Government would issue an Inspection

RFTOP.

3.4.1.2.2 If the full scope of repairs are known, the Government would issue an Repair RFTOP.

3.4.2 Initial Evaluation. Upon receipt of a RFTOP, the Contractor can schedule an on-site visit to the equipment’s location to conduct an initial evaluation of the equipment identified in the RFTOP. The Contractor would schedule on-site visits through the COR.

3.4.2.1 The initial evaluation allows the Contractor access to the equipment to make a visual determination as to the overall complexity of the work scope identified in the RFTOP. The initial evaluation can be helpful when developing a proposal for both Inspection and Repair RFTOPs; but particularly for Repair Services. In addition, the initial evaluation provides an opportunity for the Contractor to identify the mode of transportation for the equipment.

3.4.2.2 Within five (5) business days after the issuance of the RFTOP by the Government; the Contractor shall have conducted the initial inspection (if the option is taken) and submitted a Proposal (Inspection or Repair as applicable) to the Government.

3.4.2.3 The Government would review the Contractor’s submitted proposal. Giving consideration to the information provided in the proposal, the Government at its discretion may, or may not award a TO.

3.4.2.4 If a TO award is not issued by the Government resulting from the RFTOP; no further action is required on the part of the Contractor regarding the efforts identified in that particular

RFTOP.

3.4.2.5 Sections 3.4.4 (Inspection TO) and 3.4.5 (Repair TO) below describes the continued process if a TO award is issued by the Government.

3.4.3 Capturing Equipment Transportation Costs. When submitting an Inspection Proposal, the ‘To’ and ‘From’ transportation costs for equipment will be captured in that Inspection Proposal as a separate line item. The Contractor shall not include equipment transportation costs captured on an Inspection Proposal onto a follow-on Repair Proposal.

3.4.3.1 When submitting a Repair Proposal that is not a follow-on to an Inspection TO, the ‘To’ and ‘From’ transportation costs for equipment will be captured in that Repair Proposal as a separate line item.

3.4.4 Inspection TO. If an Inspection TO is issued, the services indicated in an Inspection TO will be in broad terms (versus detailed instructions). The intent is to provide the Contractor with a general understanding of the overall scope.

3.4.4.1 If an Inspection TO is issued by the Government, and unless otherwise stipulated in the individual TO, transportation of the equipment to the Contractor’s work facility must be completed within five (5) business days after issuance of the Inspection TO award.

3.4.4.2 After the equipment’s arrival at the Contractor’s work facility, the Contractor shall perform the necessary inspection procedures, diagnostic tests, and/or equipment/component tear-down required to establish the needed work to be performed and develop a follow-on Repair Proposal Report.

3.4.4.3 Repair Proposal Report. A deliverable for all Inspection TO will inherently be a Repair Proposal Report. The Repair Proposal Report must comply with CDRL A001 associated with this ESS Contract.

3.4.4.3.1 The Repair Proposal Report shall represent the Contractor’s official Firm Fixed Priced repair proposal submission for repair services requested in the associated TO.

3.4.4.3.2 Unless otherwise stipulated in the individual TO; the Contractor shall submit the Repair Proposal Report to the Government within fifteen (15) business days of receipt of the equipment at the Contractor’s work facility.

3.4.4.4 After receiving the Contractor’s Repair Proposal, if the Government decides to move forward with repairs, the Government will issue a Repair TO identifying scope and/or repair options (as applicable based on the Contractor’s Repair Proposal).

3.4.4.5 If the Government decides not to move forward with repairs after receiving the Contractor’s Repair Proposal Report, the Contractor shall return the equipment (in the condition it was received) to the place of origin no later than ten (10) business days after receiving notification from the COR by e-mail that a repair TO will not be issued.

3.4.4.6 Unless otherwise stipulated in the individual TO; all tasks associated with the Inspection TO must be completed in accordance with the schedule indicated above.

3.4.5 Repair TO. Based on the information provided in the Contractor’s Repair Proposal, the Government may or may not issue a Repair TO.

3.4.5.1 If a Repair TO is issued, the services required will be identified in detail within the Repair TO.

3.4.5.2 If a Repair TO is issued by the Government for equipment located at the Contractor’s facility (due to previous Inspection TO), the period of performance starts immediately upon issuance of the TO.

3.4.5.3 If a Repair TO is issued by the Government for equipment located at one of the naval expeditionary equipment epicenters, and unless otherwise stipulated in the individual TO, transportation of the equipment to the Contractor’s work facility must be completed within five

(5) business days after issuance of the Repair TO award.

3.4.5.3.1 The period of performance starts immediately upon the Contractor obtaining possession of the equipment at the naval expeditionary equipment epicenters.

3.4.5.3.2 If a Repair TO is not issued by the Government for equipment located at one of the naval expeditionary equipment epicenters; no further action is required on the part of the Contractor for this effort.

3.4.5.4 All tasks associated with the Repair TO must be completed in accordance with the schedule indicated in the associated TO.

3.4.5.5 If Additional Work Efforts (AWE) become evident during the performance of authorized repair efforts, the Contractor shall submit a Repair Proposal Report addressing the AWE.

3.4.5.5.1 Unless otherwise notified by the Contracting Officer, while awaiting the Government’s decision regarding the AWE, the Contractor shall continue with the repairs identified within the original Repair TO and maintain the Repair TO’s schedule.

3.4.5.5.2 After receiving the Contractor’s Repair Proposal Report, if the Government decides to move forward with the AWE, the Government will either issue a separate Repair TO or a Task Order Modification identifying work scope and/or repair options (as applicable based on the Contractor’s Repair Proposal).

3.4.5.5.3 If the Government decides not to move forward with the AWE after receiving the Contractor’s Repair Proposal Report, the Contractor shall complete the repairs identified on the original Repair TO in accordance with the original Repair TO’s schedule.
