About this file

This solicitation amendment provides clarification to questions from potential offerors on a solicitation to construct an additional floor for a hematology clinic in Skopje, North Macedonia. The amendment separates pricing requirements into individual contract line items to allow for partial awards of separate areas, requires the awarded area to be fully operational independent of non-awarded areas, and provides a summary of an engineering report assessing the building's structural capacity.

AMENDMENT 0002

The purpose of the solicitation amendment is to respond to Pre-Proposal Inquiries (PPI’s)

QUESTION#1

According to Attachment 3 for Price Schedule we are requested to provide prices separately for each CLIN but according to the Textual description page 13, the areas of Isolation Rooms and Day Hospital CLIN001 need to be perfectly operational. Our concern is that it is not possible to provide separate offers as per the CLINS because the entire floor is interconnected via construction elements such as beams and concrete slabs and they all share the same installations (HVAC, Electrical, Heating which are based in the Technical Room). As an alternative, we could provide prices per separate phases instead, such as:

1. Shell construction position (includes walls, concrete works etc.)

2. Electrical installations

3. HVAC Installation

4. Water supply and sewage installations

5. Medical Gases installations etc.

Can you please review and revise this?

ANSWER TO QUESTION#1

The contractor needs to assume that the US Government may only award CLIN0001, and consequently this area needs to be fully operational without CLIN0002 or CLIN0003. However, the US Government cannot award CLIN0002 or CLIN0003 without awarding CLIN0001. To expand on this idea further:

CLIN0001 includes the design of all the works included in the Performance Technical Specification (PTS), but it includes only the construction of the Isolation Rooms and Day Hospital. It is possible that the US Government may only award this part of the building addition into the contract. In this case, the Isolation Rooms and Day Hospital areas shall be perfectly operational, but the other areas described in CLIN0002 and CLIN0003 shall not be built as part of this contract.

Paragraph 4.4 states: “The contract in its base-Bid includes the design for all portions of the contract, including the Contract Option-1 and the Contract Option-2. However, these areas and all related works shall be clearly defined as optional works. Similarly, the design shall include required elements, which are not part of the contract, as the wall mounted air conditioning equipment for the areas outside the Isolation areas, which shall be clearly marked as “NIC – Not in Contract””

It is possible that the US Government may only award CLIN0001 which shall include the complete design, and that the Government of North Macedonia may award a separate contract to a separate company to build the work included in CLIN0002 and CLIN0003.

Consequently, the schedule of prices need to be structured depending on how many CLIN’s are awarded.

If CLIN0001 is awarded, your structure is not reasonable, as you cannot include in CLIN0001 construction elements of CLIN0002 or CLIN0003 which will not be part of the contract.

If CLIN0002 is awarded, your structure for the Schedule of Prices is perfectly reasonable.

However, financially, CLIN0001 and CLIN0002 may be independent, and consequently we would need to separate them. In other words, if there is a common element, for example the electrical installation or the HVAC Installation, the Schedule of prices shall separate them by percentage. In the CLIN0001 would appear HVAC and Electrical Installation, and in CLIN0002 would also appear HVAC and Electrical Installations. There is nothing that impedes an element to be repeated in the Schedule of Prices between two or more CLIN’s.

QUESTION#2

In relation to the Addendum 0001 clarification response, we have some uncertainties regarding the report that was provided from the Civil Engineering Faculty UKIM which in a way does not guarantee if there are sufficient conditions for the construction of an additional floor with the existing structure. According to the Construction Regulation and Law of North Macedonia, the Construction permits are provided from the Reports of the competent Institutes for Civil Engineering (not the Faculty of Civil Engineering) that can guarantee the stability of the existing building. This step is crucial before conducting any construction activities or architectural design. Can you please provide a copy of the reports/tests from the Institute for Civil Engineering if any?

ANSWER TO QUESTION#2

Find the summary of the report from the Civil Engineering Faculty UKIM in the next 5 pages.
