QUESTION#2

Can you please confirm if it is the contractor's responsibility to pay for the electrical connection fees and taxes for the new building? According to North Macedonian regulations the for electrical connection, the beneficiary is responsible to sign the contract and pay all fees and taxes for the new electrical connection, electrical meters etc, to the Electric Utility Company.

That is because the amount to be paid is estimated by Electric Utility Company. We believe that our responsibility is to only bring all the necessary installations to the connection station. Please confirm.

ANSWER

It is the contractor’s responsibility in this design-build contract to provide a fully operational facility with the limitations described in the PTS. This requires the completed facility to have adequate power supply.

It is the contractor’s responsibility to perform all works related with the electrical connection, and to pay for the electric meter, grounding, for the cabinets, cables, protection, conduits, excavations, and to pay for any labor, materials, testing or equipment and any administrative tariff or fee related with the electrical connection. All technical and administrative requirements of the electrical company become requirements of our contract.

It is not the contractor’s responsibility to sign the power supply contract or to pay for any energy consumption after the building is formally accepted.

Basically, the contractor shall pay for everything related with the connection, but not related with the energy supply, which should be paid by the beneficiary after the pertinent power supply contract is signed. However, if the beneficiary chooses to rent the metering equipment, then the contractor would not be responsible to pay for the electric meter.

In summary, the contractor pays for everything until the supply contract is signed. After the supply contract is signed, the beneficiary pays for everything.

QUESTION#3

Can you please confirm for which areas does the diesel generator need to provide electricity for? At the site visit, the architect form the Ministry of Health, Mrs. Elena, informed us that the generator needs to provide backup electricity only for the isolation boxes. Please confirm.

Confirmed.

QUESTION#4

Is there a plan or project for the protective electrical earthing and lightning conductor for the existing building or is the contractor obligated to provide brand new earthing and lightning conductor installations and connections for the new floor?

ANSWER

It is the contractor’s responsibility to provide a new grounding system for the new floor, as well as a new lighting system. All shall be designed, installed and certified as per regulations of North Macedonia. It is authorized to connect the new grounding to the existing grounding as permitted by North Macedonian regulations. Grounding for lightning system shall be independent.

QUESTION#5

We would like to have a list of rules and regulations by the beneficiary for the utilities and appliances of the existing building that need to be uninterrupted during the rerouting of the electrical cables or executing other construction activities.

ANSWER

This is described in paragraph 3.7. Some examples and elements are described in this paragraph 3.7. However, we are aware of the difficulty and complexity of the issue. It is required a daily coordination with the beneficiary. The rooms under the work areas shall remain operational with patients with extreme medical conditions. We understand that this special circumstances imply costs, or requirements that have a significant impact on your cost proposal. The rules will change throughout the execution of works. However, for estimating purposes, and to expand the information already included in paragraph 3.7, you may estimate:

‐ No power interruptions to the electric supply of the Hematology Clinic. They have a generator. If any power interruptions are necessary, they will be limited to a maximum of 15 minutes and shall be performed with 15 days advance notice, and outside normal working hours.

‐ No activities emitting significant noise or vibrations during 4 hours within the normal working hours (12:00 to 16:00, or 08:00 to 12:00). No activities emitting significant noise or vibrations after normal working hours.

‐ Provide whatever physical protection is required by regulations to avoid any possibility of damages to the ceilings of the operational areas of the hospital. It is estimated that immediately after removal of the existing roof, the contractor shall cover all horizontal surfaces with plastic and metal plates to avoid any possibility of water and physical damage to the ceilings. There can be no possibility of errors until the new floor deck and waterproof barrier is provided.

‐ Access to the hospital complex by cranes and heavy vehicles shall be limited to weekends, holidays and after normal working hours

‐ Extremely difficult vehicle access. You will be given an area for a couple of trailers, storage and 5 parking spaces. However, any other vehicle access will be extraordinarily difficult during normal working hours.

‐ The normal working hours are 08:00 to 17:00 on non-holiday Mon-Fri. The contractor is authorized to work 24 hours per day and 7 days a week, given that they comply with the requirements of paragraph 3.7, with the additional or clarified restrictions described in this amendment, with any other technical requirements of the Hospital Complex, and with the labor laws and regulations of North Macedonia, especially referring to the labor safety and hygiene regulations.

QUESTION# 6

Can you please clarify whose responsibility is to pay for Construction Permit fees and taxes?

According to Macedonian Regulations and Law, there are two types of taxes and fees that need to be paid in order to obtain the necessary Construction Permit 1. Taxes and fees to Municipality of City of Skopje and 2. Municipality of Center).

The construction permit fees and taxes are paid by the beneficiary (user of the building) which in this case is the Clinic of Hematology. The textual description of this solicitation (page 5, paragraph 1.4) says that the contractor is required to pay for any applicable fee necessary to obtain a Construction Permit.

The average amount that may be needed to get paid for the Construction Permit is around 100.000 USD.

The party that submits the request for obtaining the Construction Permit is responsible for payment of the Construction Permit’s fees and taxes. In every case the contractors have submitted the request for permit on behalf of the beneficiary.

According to the Donation Agreement that is concluded between the USG (represented by the US Embassy) and the beneficiary, it clearly states that we can not pay any taxes associated to the construction process. So, the selected company works with the beneficiary to avoid any major tax and fees payments. Small fees if arise should be covered by the selected company.

The proposal due date is extended to Tuesday, 26 May 2020 by 2:00p.m. Central European Summer Time (CEST).
