The solicitation seeks to clarify that potential offerors may submit a Request for Equitable Adjustment if the scope of work changes over the contract term to adhere to the Contract Disputes Act for administering such requests. QUESTIONS AND ANSWERS # 12
The following are answers to questions received from potential offerors. The answers provide clarification only and DO NOT constitute an amendment to the solicitation.
250. Amendment 0008 has not addressed allowance of an REA to cover the fixed portion of the contract for any change in scope over the contract term. Without addressing this, the contract does not adhere to the Contract Disputes Act when administering REA’s during the contract term. If Amendment 0008 has addressed this, please advise the provision of the contract that clearly addresses our concern.
ANSWER: There is nothing in the contract language to prevent a contractor from submitting a Request for Equitable (REA) adjustment. In addition, DFARS
252.243-7001 will be added in a forthcoming amendment.
