5. Rationale Justifying Use of Cited Authority:

a. WI 022 Dock Trials and Sea Trials

GE Energy Power Conversion is the single source vendor (SSV) for all T AKE Propulsion

System components, controls and ship operating software. These systems are critical to ship operation. During the course of the 42 day dry-docking these systems are shut down for long periods of time. This commonly results in problems when restarting the system and tuning it back up to operational status. Due to the highly sophisticated nature of the propulsion control electronics system components and software failure is probable during power cycles and long periods of inactivity such as a dry-docking. To troubleshoot and repair it is imperative that the

SSV with access to proprietary information and parts is available. General Power Conversion holds the MSC IDIQ contract for service and parts under N00044-12-D-8023.

b. WI 103 Elevator No. 1 and 3 Pit Coating

The WI requires elevator pits be coated with Belzona 5811. The proper preparation and application of this product requires the direct supervisor of the product OEM representative.

Proper surface preparation, surface testing and application are critical for the end product quality and greatly reduces the chance of failure. Any possible product failure will not be remedied by

Belzona with any questions regarding the application process. To ensure proper end results, and that the product will be covered under warranty by the OEM it is essential that a qualified Belzona

Representative be present to supervise the product application.

c. WI 201 Main Diesel Engine/Turbocharger #1 & 4 6,000-hr Maintenance

The OEM of the two (2) 8'L 48/60 four-stroke turbocharged diesel engines is MAN Diesel, Germany. Fairbanks Morse Engine and Motor Services Hugo Stamp are the only authorized

MAN Diesel, Germany representatives in the United States. Proper refurbishment and maintenance of these engines is critical to the safe operation of the T-AKE vessels. OEM parts from the original manufacturer are required to maintain all warranties, ensure engine reliability and crew safety, therefore precluding consideration of a product manufactured by another company. The OEM authorized representative will have access to parts and technical data from the OEM as required by USCG and ABS regulation. This maintains all OEM warranties, ship class continuity, and ensures ship reliability and crew safety.

d. WI 301 Propulsion Motor Cleaning

The Main Propulsion Motor is a component of the main propulsions Single Source Vendor (SSV) contract initiated during design and new construction of the T AKE class ships. GE Power

Conversion is the SSV. Due to the critical nature of the propulsion motor and it high dollar value it is imperative that qualified personnel work on, and test this component. Possible damage and motor replacement would result in extensive repairs that would require an extended dry-dock, major hull cuts and taking the ship out of service for months. This would cost the

Government millions of dollars. The GE Power Conversion representative is qualified to perform the required maintenance. By using the qualified SSV the Government’s exposure to risk of damaging the propulsion motor during maintenance is significantly reduced. The SSV has motor construction and design proprietary information available that allows them to perform maintenance actions and repairs in a prudent fashion and enables them to evaluate motor conditions and provide sound judgment on required actions.

e. WI 302 HV-SS-E Switchboard Cleaning and Maintenance

The electrical switchboard maintenance and repairs of this WI require unique High Voltage qualification and skills. Point Eight and Cadick Corp have demonstrated they are qualified to conduct High Voltage work in accordance with MSC SMS procedures. Point Eight is the original switchboard assembly manufacture and is familiar with the intricate computerized switching required to make the electrical distributions system work. Unlike conventional

Switchgear associated with earlier merchant vessels, the switchgear onboard the T AKE system is computerized via DAUS, PLC and Relays to tie into the propulsion controls system and vessel management system. These systems tie the electrical distribution into the engine room power generation equipment via the MCCS. To properly maintain and repair this equipment highly skilled personnel are required. Average shipyard electricians do not possess these skills. Both

Cadick and Point Eight representatives have demonstrated in past work that they have the required skill level and familiarity with the type of switchgear onboard the T- AKE class ships.

f. WI 409 Sperry Bridge Equipment Maintenance

The bridge equipment serviced by work item 409 is designed and manufactured by Sperry.

Sperry is the OEM and has proprietary knowledge unavailable to others regarding their equipment. Proper functioning of this equipment is necessary for the safe navigation of the vessel. USCG will not let the ship sail if equipment maintained by this WI is not operational.

This makes it critical to have qualified personnel with access to manufactures data maintain and repair this equipment. Sperry Tech representative has access to the navigational electronic programming, parts, and service upgrade records that other companies do not have. The navigational equipment design was developed to meet ABS requirements for NIBS notation.

This requires bridge components be integrated into a single navigational system. Sperry is the designer and installer of the TAKE Class integrated bridge system. This best qualifies them to perform WI 409 maintenance in lieu of single component vendors or shipyard personnel that don’t have access to the NIBS design information.

g. WI 504 MSD Discharge Pump

Eddy Pump Corporation is the OEM of the dual EPCON AKE units; seal air units, and operating electrical controllers for these units onboard the T-AKE class ships. The unique design using Eddy Pump Corporation's' proprietary technical data rights and patents makes the use of non-OEM parts impossible. Eddy Pump Corporation oversight of the installation and commissioning of the MSD pump modifications is essential to ensure the proper execution of the MSD pump modifications under T-ALT 191. The OEM authorized representative will have access to material and technical data from the OEM as required by

USCG and ABS regulation. This maintains all OEM warranties, ship-class continuity, and ensures ship reliability and crew safety.

Red Fox Environmental Services is the designer and manufacturer of the Sewage Treatment

Plant on the T-AKE class ships. Red Fox Environmental Marine Series Units are Bureau

Veritas certified for IMO Resolution MEPC 159(55). The IMO Marine Environmental

Protection Committee resolution applies to all sewage treatment systems installed onboard.

A Red Fox Environmental Services representative shall be present during the modification to the Red Fox controller and for the treatment system start up, testing and commissioning. A

Red Fox Environmental Services representative will have access to proprietary material and technical data from the OEM as required by EPA, USCG, and ABS regulation. Red Fox

Environmental Services oversight maintains all manufacturers’ warranties, ship-class continuity, and greatly mitigates the risk of unintentional accidental discharge of sewage products and emulsion into the ocean.

h. WI 511 Central Seawater System Spool Repairs

ENECON Corporation is the OEM of advanced proprietary polymer technologies, pioneering unique proprietary coating systems. These proprietary polymer systems are a result of many years of research and test results. ENECON representatives possess the technological expertise that can provide proven and cost effective repairs to their proprietary products. ENECON representative is required to provide technical assistance, assist in chloride, nitrates and sulfate remediation, low dust, review proper surface preparation, mixing, application tips, reduced waste and improve productivity. The OEM authorized representative will have access to material and technical data from the OEM as required by the WI.

i. WI 513 LTFW Endplate Installation

PHEX is the OEM rep of the GEA Ecoflex GMbH LTFW Coolers, Model Number Type VT

2508 B-6HEX onboard the T-AKE Class of Vessels. Approved MSC T-ALT No. T-AKE-

09-014 changed the design of the LTFW Cooler which installs special made endplates with strainer baskets and cleanouts that improves operating efficiency and reduces the maintenance cost associated with cleaning the LTFW Coolers. The special made strainer baskets prevents clogging of the cooler plates and allows for longer times between complete disassembly and cleaning of the cooler plates. Clogged basket strainers could render the LTFW coolers useless and in turn make them unable to efficiently cool thus effecting the operation of the main engines and related auxiliary equipment. Entire engineering plant loss could result from loss of the LTFW Coolers. PHEX is the only known provider of OEM technical representatives and they have been involved in all the installations to date. This T-ALT covers the entire fourteen (14) T-AKE Vessels. This work and installation maintains all OEM warranties, ship class continuity, and ensures ship reliability, proper plant operation and crew safety.

j. WI 902 Propeller Shaft and Stern Tube Inspection, WI 903 Stern Tube Seal Inspection / 907

Propeller Shaft Horizontal Proximity Probe & WI 908 Shaft Reference Cell Installation

Support will be provided as a sole source by Wartsila Defense Inc. of Chesapeake, VA for

WIs 902, 903, 907 & 908. Wartsila Defense will provide all material as Contractor Furnished

Material (CFM) and all special tools as Contractor Furnished Tools (CFD). Wartsila Defense of Chesapeake is the only known US provider of OEM components and service for Wartsila

Defense equipment. Wartsila Defense was a prime contractor to the shipbuilder, NG-

NASSCO, and designed and provided all of the propulsion chain components including the shafting, shaft couplings, stern tube cartridge, stern tube bearings, shaft bearing liners, and the stern tube shaft seals. Wartsila Defense served as an integrator for some components of the shaft and stern tube assemblies, meaning that those components such as the stern tube bearing were designed and manufactured by another company specifically for Wartsila Defense.

Wartsila Defense has agreements with these companies to provide repair parts for these components. Wartsila Defense has been fully involved in the remediating of the stern tube bearing failures. This is their design failure requiring them to evaluate the current problems.

All these WIs support this remediation work. At this point involvement of different vendors would result in a discontinuity of information and direction.

k. WI 904 Polish Bow Thruster Propeller and Inspect Seals

Rolls Royce is the OEM for the T AKE Bow Thruster. The existence of proprietary rights, limited rights in data, patent rights, copyrights or secret processed make the required item or services available form only one source Rolls Royce. The restrictive rights for the bow thruster design clearances are not available in NAVSEA tech manuals or NASSCO or MSC drawings.

Rolls Royce is identified as owning the drawings: MSC does not have access to drawings that show various design clearances and repair procedures. Another company couldn’t satisfy the

Government’s requirements. A Rolls Royce OEM representative is required to supervise local machinists accomplishing the repairs of the Bow Thruster.

l. WI 911 Inspect and Repair Cathodic Protection

US Filter Electocatilytic Products is the OEM of the proprietary CAPAC impressed current cathodic protection system on all T-AKE vessels. US Filter Electocatilytic Products is the proprietary owner of the software and parts used to install, set-up and test operate the CAPAC impressed current cathodic protection system. OEM parts are required to ensure proper operation of the CAPAC impressed current cathodic protection system thereby reducing the electrochemical action of galvanic corrosion and damage to the hull. MSC knows of no other product that has the galvanic corrosion protection properties that would be interchangeable with the currently installed CAPAC impressed current cathodic protection system in use across the T-AKE class. The OEM authorized representative will have access to material and technical data from the OEM as required by USCG and ABS regulation. This maintains all

OEM warranties, ship-class continuity, and ensures ship reliability and crew safety.

m. WI 912 Stern Tube Belzona Repair

The WI requires stern tube coating repair with Belzona 5811. The stern tube is currently coated with Belzona 5811 as required by the approved TransAlt. To be consistent and compatible with the currently installed coating the repairs are to be made with the currently installed product.

The proper preparation and application of this product requires the direct supervisor of the product OEM representative. Proper surface preparation, surface testing and application are critical for the end product quality and greatly reduces the chance of failure. Any possible product failure will not be remedied by Belzona with any questions regarding the application process. To ensure proper end results, and that the product will be covered under warranty by the OEM it is essential that a qualified Belzona Representative be present to supervise the product application.

MSC does not have manufacturing and technical information required to evaluate the listed WIs and determine whether non-OEM components and replacement parts offered are equivalent to the OEM components and replacement parts. The WIs listed in this section require special tools, specialized repair parts, and technical expertise unique to this equipment; only approved OEM parts are authorized to be installed on this highly sophisticated equipment. Only the OEM Representative has access to provide parts and technical data / drawings from the original manufacturer, as required to properly repair and maintain the equipment. All OEM repair parts are in compliance with USCG and ABS IMO regulatory requirements.
