General Environmental Requirements
1.0 Regulated Waste
1.1 Environmental Protection Plan Requirements - The Contractor shall maintain Environmental Protection/Hazardous Material/Hazardous Waste/Spill Program Coordinators within the organization qualified to administer and execute the environmental requirements of the work effort. Contractor shall designate individual shop coordinators from each work area who shall be familiar with all Local, State and Federal environmental instructions, directives, regulations and laws governing their assigned duties, and shall be provided, by the Contractor, the required 24 hour initial and annual 8-hour refresher Hazwoper and environmental/hazardous material training related to transportation, storage, and disposal of the hazardous materials/waste for its personnel and shall document on the host commands training forms. Copies of these training records shall be transferred to the NAVFAC command environmental office upon initiation of this contract. See paragraph 6.1.12.17 for Chemical Material Management requirements.
1.2 Local, State and Federally Regulated Waste Management - The Contractor shall perform regulated and hazardous waste disposal action to include containerizing, marking, labeling and temporary storage of such waste generated as a result of their contracted work obligations. The Government will be considered the generator of facility waste. However, the Contractor is responsible for their own waste i.e. spills, broken containers, and excess material. This shall not obviate the Contractor's responsibility for the proper handling, use, storage and their associate storage areas. When waste is generated, the Contractor must contact NAVFAC Environmental for disposal of all hazardous material/waste IAW pertinent regulations and local instructions. Record keeping and turn in procedures shall be IAW NAS Regulated Waste Management Plans (NASPAXRIVINST 5090.5). The following plans and regulations must be adhered to for Environmental Compliance:

· OPNAVINST 5090.1D
· COMAR, Title 26.13
· NASPAXRIVINST 5090.5
1.3 The Contractor shall identify the chemical and physical characteristics of hazardous waste generated and testify to its chemical composition. A combination of chemical analysis and historical data with resulting calculations may be used. A scientific approach is the best business practice which includes a sample analysis of the waste generated, if it is unknown. However, “generator knowledge” is sufficient if the chemicals are basic and known to the user. The Government encourages the use of recycling means for chemicals that can be recycled and reused for other purposes. Contractor shall contract through a recycling company to properly remove products such as oil, anti-freeze and assorted filters. Records of this recycling transaction must be forwarded to NAVFAC Environmental Division in order to retain the records and to provide annual reporting to local, state and federal agencies.
1.4 The Contractor shall be responsible for all waste containers. The Contractor shall order Department of Transportation (DOT) approved waste containers, labels, and markings. Approved containers shall be obtained through various sources outside of the Government supply system.
1.5 The Contractor shall ensure no generated wastes are maintained in the locations on-site storage facilities over the permissible time in accordance with base regulations. The maximum time allotted by NAS Patuxent River for generated wastes to be held in an on-site storage facility is two-weeks. If waste is generated off station (outside of the Pax River Complex, Webster Field and Solomon’s Annex fence lines) or material is used off station and waste is generated, it must be disposed of by the Contractor off station, at the Contractor’s expense. No waste can be brought back on station, for any reason, to be disposed of by the Government.
2.0 Asbestos Containing Material
2.1 Asbestos containing insulation, flooring, and other building materials may be encountered by the Contractor during the performance of work under this contract, and the Contractor shall remain alert to this possibility. If ACM is encountered or suspected in the performance of work, the Contractor shall avoid removing, sanding, abrading, or disturbing the material. The Contractor shall verbally notify the KO within one hour and follow-up with written ACM Notification within 24 hours.
3.0 Environmental Protection
3.1 The Contractor shall comply with all applicable Federal, State, and Local laws, and local instructions. All environmental protection matters shall be coordinated with the Environmental Division through the KO. Inspection of any of the facilities operated by the Contractor may be accomplished by the Activity Environmental Protection Coordinator, or authorized officials on a no-notice basis during Government regular working hours. In the event that a regulatory agency assesses a monetary fine against the Government for violations caused by Contractor negligence, the Contractor shall reimburse the Government for the amount of that fine, costs of defending against administrative or other legal action, remedial action, and other costs.
3.2 The Contractor shall comply with the instructions of the cognizant Navy Medical Department with respect to avoidance of conditions which create a nuisance or which may be hazardous to the health of military or civilian personnel. The Contractor is responsible for ensuring that its employees receive applicable environmental and occupational health and safety training, and are kept up to date on regulatory required specific training for the type of work to be conducted onsite. All on-site Contractor personnel, and their subcontractor personnel, performing tasks that have the potential to cause a significant environmental impact shall be competent on the basis of appropriate education, training or experience.
4.0 Environmental Planning
4.1 The Contractor shall utilize the Station’s planning checklist in the scoping of tasks to be performed. The Planning Checklist will be provided to the Contractor upon award of the contract. Updates to the planning checklist will be issued to the Contractor and shall be incorporated into the Contractor’s workflow within 24 hours of being received from the KO. The Contractor shall reapply the planning checklist during the life of all projects it undertakes as part of this contract. General rule of thumb is to use the planning checklist during scoping and anytime afterwards when the original scope of the task changes. The Contractor shall incorporate the requirements identified from the use of the checklist into the scope of the project/task to be performed.
5.0 Sustainable Procurement and Practices
5.1 Within 15 calendar days after award of the contract, the Contractor shall submit to the KO a Sustainable Procurement and Practices Plan that will identify how the Contractor will comply with all applicable Federal, State and Local laws and regulation, including Executive Order 13423, Installation Water Conservation Programs and energy reduction requirements. The plan shall specifically address the following components:
· Recycled contents products
· Energy/Water efficiency
· Alternate Fuels and Alternate Fuel Vehicles
· Bio-Based Products
· Non-Ozone Depleting Products
· Environmental Preferred Products and Services
· Low/Non-Toxic and Hazardous Materials The Contractor shall provide an annual Sustainable Delivery of Services Report.
6.0 Environmental Management System
6.1 The Contractor shall perform work under this contract in a manner that complies with NASPAXRIVINST 5090.1B Environmental Management System Implementation
6.2 All Contractor employees shall complete Environment Awareness Training within 30 days after award. Refresher training must be taken annually. New employees shall be trained within 30 days of reporting to work. The Contractor shall maintain a list of employees that have completed the training indicating the date the training was completed. The Government’s Environment Awareness Training module will be provided to the Contractor at the time of award, see Attachment J-17 for instructions.
6.3 All Contractor employees shall be briefed on NAS Patuxent River’s Environmental Policy Statement and the Environmental Policy Statement is to be posted in various locations within the on-station work place.
6.4 All Contractor Supervisors shall read and sign Environmental Manuals specific to their shops work assignments.
7.0 Spill Contingency Plan
7.1 The Contractor’s Contingency Plan shall comply with occupational safety and health standards contained in General Industry Safety and Health Standard 29 C.F.R. 1910 that have been implemented by the Naval Air Warfare Center Aircraft Division, Naval Test Wing Atlantic. The Plan shall follow guidelines listed in the NAS Patuxent River Instruction 5090.5 and be submitted to the NAS Patuxent River Public Works Environmental Division for review approval. All spill event procedures (including notification of a spill event) shall be consistent with the guidelines set forth in the NAS Patuxent River Facility Response Plan and Emergency Response Action Plan. Spills shall be remediated immediately, and the resultant waste properly containerized and labeled. Only noncombustible absorbents shall be used to clean up flammable material spills. Drip pans shall be used where spills or drips are likely to occur. Off-station notifications and reporting shall be coordinated with the MO/DMO and the NAS Patuxent River Emergency Management Office.
8.0 Air
8.1 The Contractor shall comply with Federal, State and Local regulatory requirements respecting air quality and emission limitations. Specific requirements that are potentially applicable to the scope of work are described below (these are not intended to be exhaustive, but are highlighted here for emphasis):
8.2 The Contractor shall comply with the conditions described by Title V/Part 70 Operating Permit No. 24-037-0017 and/or individual air emission permits in all relevant activities (e.g., painting of aircraft; anti-corrosion treatments; operation of fuel-burning boilers/heaters, stationary engines; and engine test stands).
8.3 The Contractor shall comply with the relevant VOC emission limitation standards that are established for aerospace coatings, as applicable. Refer to COMAR 26.11.19.13-1 and COMAR 26.11.19.23, respectively.
8.4 The Contractor shall comply with the requirements described at 40 CFR 63, Subpart WWWWWW, as applicable. This standard addresses certain metal surface treatments (e.g., chrome conversion coating; polishing of treated surfaces) that utilize hazardous air pollutants (e.g., chrome compounds).
8.5 The Contractor shall comply with the Clean Air requirements described in Chapter 22 of OPNAV M-5090.1D.
8.6 The Contractor shall comply with all recordkeeping requirements described by all applicable Federal, State and Local regulations, and support required station air emissions reporting (e.g., maintain operation and material usage logs). As such, the Contractor shall comply with the Hazardous Material Management requirements described in Chapter 23 of OPNAV M-5090.1D, and is required to participate in the Consolidated Hazardous Material Reutilization and Inventory Management Program (CHRIMP) described in Section 23-3.4 of the manual.
9.0 Storm Water
9.1 The Contractor shall comply with all Federal, State and Local regulations regarding storm water discharges. Specifically, NAS Patuxent River is under the guidance of National Pollution Discharge Elimination System (NPDES) permit 12SW2452.
9.2 These permits manage all types of activities that result in a storm water discharge. Common examples include aircraft washing (indoor/outdoor). If you have questions or need clarification about storm water generated from your activities, please contact the NAVFAC Washington, Public Works Department, Environmental Division, Storm Water Program Manager.
10.0 Wastewater
10.1 The Contractor shall comply with all Federal, State and Local regulations wastewater discharges. Specifically, NAS Patuxent River is under the guidance of National Pollution Discharge Elimination System (NPDES) permit 11-DP-2518, and the St. Mary's County wastewater/sewer contribution permit 11-WP-001. Webster Outlying Field wastewater/sewer discharge is regulated under NPDES permit 07-DP-2523.
10.2 These permits manage all types of activities that result in a wastewater discharge. Common examples include aircraft washing (indoor/outdoor), aircraft de-icing, plating operations, hangar floor cleaning, parts washers, and handling AFFF events. If you have questions or need clarification about wastewater generated from your activities, please contact the NAVFAC Washington, Public Works Department, Environmental Division, Clean Water Program Manager.
11.0 Emergency Planning and Community Right-to-Know Act
11.1 NAS PAX installations are required to comply with EPCRA recordkeeping and reporting requirements. The Contractor shall maintain and submit hazardous material storage and usage logs in order to support these station EPCRA reporting requirements. As such, the Contractor shall comply with the Hazardous Material Management requirements described in Chapter 23 of OPNAV M-5090.1D, and is required to participate in the Consolidated Hazardous Material Reutilization and Inventory Management Program (CHRIMP) described in Section 23-3.4 of the manual. See paragraph 6.1.12.17 for Chemical Material Management requirements.
12.0 Petroleum Systems
12.1 This section addresses the requirements for existing or proposed fuel storage tanks and existing or proposed fueling operations. This section will cover new or existing heating oil, fuel oil and jet fuel requirements. This section also covers all permits required for removal or installation of new fueling tanks and operations.
12.2 If the proposed project requires the installation or removal of an aboveground or underground storage tank, you shall contact the Environmental Fuel Tank Compliance Manager for proper input into the scope of work for the proposed project at the beginning of the design phase. Basic information that shall be required will consist of the estimated tank size, anticipated location of the fuel storage tank and the type of fuel that will be stored in the fuel tank.
12.3 If the proposed project requires a petroleum auxiliary power system, use of mobile or fixed equipment such as a heating system, generator, fire pump or other petroleum engine that would require a storage tank or fuel piping, you shall contact the Environmental Fuel Tank Compliance Manager for guidance. All above ground and underground storage tanks containing petroleum must be added to the NAS Oil Operations Permit. In addition, underground storage tanks are required to be registered and a permit is also required from the Maryland Department of the Environment. Project design must meet spill containment requirements in accordance with COMAR 26.10.
12.4 If the proposed project requires installation of an above ground or underground storage tank, or fuel line within 100 feet of an existing storage tank or fuel line, you shall contact the Environmental Fuel Tank Compliance Manager for guidance. NFPA and COMAR26.10 regulate the distance between fuel lines, (and tanks) and facilities, structures, utilities and hazardous waste storage areas.
12.5 If the proposed project includes the installation, removal, replacement or upgrade of a heating system which currently uses petroleum products as a fuel source, you must contact the Environmental Fuel Tank Compliance Manager for guidance. A description of the current heating source and proposed work shall be reviewed by the EFTCM.
13.0 Recycling/Solid Waste
13.1 This section addresses the requirements for the recycling of Municipal Solid Waste, the handling of excess Government materials and property and the recycling of Construction and Demolition debris.
13.2 The Contractor shall recycle through the base Recycling Program all grades of paper, cardboard, toner cartridges, plastic and glass bottles, aluminum beverage cans, steel/tin cans, and scrap metal. The Navy has established a goal of 50% to be achieved through proper recycling methods for Municipal Solid Waste.
13.3 Excess Government equipment and property shall be turned into DRMO for Government disposition.
13.4 Any Construction and Demolition projects performed by the Contractor shall include the recycling of the following commodities: asphalt, brick, concrete, carpeting, wiring and construction metals. The Contractor shall contact the Environmental Recycling /Solid Waste Manager for guidance on handling. The Navy has established a goal of 60% for the amount of construction and demolition debris that is diverted from the landfill.
13.5 The Contractor shall dispose of debris and rubbish resulting from the work under this contract after determined to be non-usable and non-recyclable, on-installation and off-installation.
13.6 All material and equipment removed or disconnected that is sound and of value shall remain the property of the Government. The Contractor shall deliver this material and equipment at the Contractor's expense to Building 604 for evaluation and processing of the equipment or material. All equipment must be free of liquids or hazardous material contained within the equipment prior to turn into DRMO. The Contractor must work directly with the DRMO personnel to ensure all necessary Government paperwork is filled out and turned in with appropriate equipment.
14.0 Public Water and Utilities
14.1 The Contractor shall obtain approval from the Public Works Department Utilities Division prior to tapping into existing Utilities (water, sewer, electrical, etc.). No activity is allowed to connect to or augment a potable water line, a drain line, or an electrical line outside and within the facility without being processed through the Public Works Department Utilities Division.
15.0 Protection of Endangered and Threatened Species (Flora and Fauna)
15.1 The Contractor shall not disturb endangered and threatened species and their habitat. The Contractor shall carefully protect in-place and report immediately to the KO endangered and threatened species discovered in the course of work. The Contractor shall stop work in the immediate area of the discovery until directed by the KO to resume work.
16.0 Noise Control
16.1 The Contractor shall comply with all applicable Federal, state and local laws, ordinances, and regulations relative to noise control.
17.0 Chemical Material Management
17.1 Chemical Material Management - The Contractor shall meet all requirements of the 29 C.F.R. 1910.1200, Hazardous Communication Program. Personnel shall be trained and Safety Data Sheets (SDS) shall be readily available. Government will fund training through a services support CLIN.
17.2 The Contractor shall ensure personnel handle and store chemical materials according to compatible hazard class as defined in 29 CFR 1910, Subpart H and 49 C.F.R 173. Hazardous material shall be stored in designated locations/containers and the Contractor shall maintain and housekeep the storage sites. Follow the CFR and all local state and federal regulations regarding hazardous material usage and storage. Two regional references noting that the HMC must be used for HAZMAT procurement. COMFISCSINST 5090.1 is noted in Chapter 8 and COMNAVREGMIDLANT 6280.1A in paragraph 5 also mentions HM procurements must go through the HMC.
17.3 Quantity of chemical material issued and kept in work center shall be IAW the Station Consolidated Hazardous Material Reutilization and Inventory Management Program (CHRIMP). Only material on the station material Authorized Use List (AUL) shall be brought aboard Government activity. The Contractor shall provide information storage and usage data to the Contracting Officer Representative.
