The security classification guidance for classified information needed for this effort is identified below. If any difficulty is encountered in applying this guidance or if any other contributing factor indicates a need for changes in this guidance, the contractor is authorized and encouraged to provide recommended changes; to challenge the guidance or the classification assigned to any information or material furnished or generated under this contract;

and to submit any questions for interpretation of this guidance to the official identified below. Pending final decision, the information involved shall be handled and protected at the highest level of classification assigned or recommended.

Technical papers, briefings, presentations, either classified or unclassified to be presented at classified symposia must be submitted to A0N0000 for approval prior to presentation. Unclassified material submitted for public release (that is not to be presented at classified symposia) shall be forwarded for review prior to release as stated in item 12 above. All controlled unclassified and classified technical information shall be appropriately marked with distribution statements as specified in DoDI 5230.24 (Distribution Statements on Technical Documents) http://www.dtic.mil/whs/directives/corres/pdf/523024p.pdf.

Determination of need-to-know in connection with a classified visit is the responsibility of the individual/host who will disclose the classified information.

All contracts with non-Sensitive Compartmented Information and Non-Compartmented work that may reveal mission-related information of a sensitive activity or sensitive operation should be routed to the NAVAIR STILO for approval.

The COR, TPOC, and Government Security Office, concerning instances of possible loss, compromise, and electronic spillage of classified

The following Security Classification Guide(s) apply to classified performance on this contract. Subsequent updates shall be provided by the Technical Point of Contact/Contracting Officer Representative/Contracting Officer Security Representative (as applicable) as Government Furnished Information (GFI) and shall be executed by the Contractor without obligation to modify this DD Form 254.

Block 10e (2) – The contractor is authorized access to Non-SCI National Intelligence Information and/or Foreign Intelligence Information on behalf of Rebecca Ahne, NAVAIR Senior Intelligence Officer. A final security clearance at the appropriate level is required for access to Non-SCI National Intelligence Information and/or Foreign Intelligence information. Further security guidance for reproduction, release, retention, return, and destruction of National Intelligence Information is stipulated in the attached NAVAIR Memorandum titled POLICY GOVERNING RELEASE OF INTELLIGENCE TO CONTRACTORS dated 01 MARCH 2022. Written concurrence of the Technical Point of Contact/Contracting Officer Representative/ Contracting Officer Representative for Security (as applicable) is required prior to subcontracting.

Block 10.g –To facilitate potential access to NATO classified information, to include NATO accredited SIPRNet terminals, all DoD military, civilian, and contractor personnel who are briefed on their responsibilities for protecting U.S. classified military information, shall also be briefed on the requirements for protecting NATO information, per Deputy Under Secretary of Defense Policy Security Memo of 5 Dec 01. Written concurrence of the Contracting Officer/Technical Point of Contact, identified in Block 16, is required prior to subcontracting.

Block 10.h – Foreign Government Information (FGI) is not releasable to contractor employees who have not received a final security clearance at the appropriate level. Written concurrence of the Technical Point of Contact/Contracting Officer Representative identified in Block 16, or Contracting Officer Representative for Security (as applicable) is required prior to subcontracting.

Block 10.j – Controlled Unclassified Information including Legacy FOUO and Covered Defense Information (meeting the definition of DFARS Clause 252.204–7012 Safeguarding covered defense information and cyber incident reporting) generated and/or provided under this contract shall be marked and safeguarded as specified in DoD Instruction 5200.48 (Controlled Unclassified Information) (CUI)) available at https://www.esd.whs.mil/Portals/54/Documents/DD/issuances/dodi/520048p.PDF. Any product containing Covered Defense Information shall be assigned the appropriate distribution statement using the criteria set forth in DoDI 5230.24 (Distribution Statements on Technical Documents); and have this statement displayed per DoDI 5230.24, Enclosure 3-4.

All Covered Defense Information (CDI), Legacy FOUO, and program Controlled Unclassified Information (CUI) data transmitted and safeguarded via electronic means shall use approved encryption. The Contractor shall ensure that when transmitting CUI/Legacy FOUO/ CDI over non-secure e-mail (e.g. not connected to the Navy Marine Corps Intranet through Broadband Unclassified Remote Access System / Virtual Private network), those transmissions are encrypted using Department of Defense Public Key Infrastructure (PKI), or an approved DoD External Certificate Authority, in accordance with Public Key Infrastructure & Public Key Enabling, DoDI 8520.02, 24 May 2011.

Block 10.k – Secret Internet Protocol Network (SIPRNet) access authorized. The contractor shall not access, download, or further disseminate any information or data that falls outside the scope and execution of the defined contract requirements. In the event any additional access is required, the Technical Point of Contact/Contracting Officer Representative must modify the requirements for DD Form 254 revision. Contractor shall prepare and submit all required documentation as required by Command policy prior to receiving access. Written concurrence of the Technical Point of Contact/Contracting Officer Representative identified in Block 16, or Contracting Officer Representative for Security (as applicable) is required prior to subcontracting.

Block 11.c- Information Systems (IS) shall be protected in accordance with DoDI 8510.01; and/or per guidance in the DoD National Industrial Security Program Operating Manual (NISPOM) codifying 32 Code of Federal Regulation Part 117, NISPOM Rule, 24 February 2021.

Block 11.d-Contractor shall provide adequate storage at their facility for classified hardware. Classified shipments are not to exceed two cubic feet. Larger size shipments require prior coordination with the Facility Security Officer (FSO) to confirm facility storage capacity.

Preparation and transmission of material for shipment will be in accordance the DoD National Industrial Security Program Operating Manual (NISPOM) codifying 32 Code of Federal Regulation Part 117, NISPOM Rule, 24 February 2021 and the DoD 5200.01 V3, DoD Information Security Program Manual.

Block 11.g – To use DTIC services, the contractor must register for an account at http://www.dtic.mil/dtic/registration/contractors/ index.html.

Block 11.i – TEMPEST information is not releasable to contractor employees who have not received a final security clearance at the appropriate level. The TEMPEST Requirements Questionnaire shall be submitted to the SPAWAR TEMPEST IPT in accordance with

Block 11.j – APSD, (the Requiring Organization), has made a determination that BASIC Operations Security (OPSEC) measures are sufficient to protect the contracted related Critical Information associated with this Contract. The NAVAIR DD254 OPSEC Annex, dated Jan 2013, shall be included as an attachment to this DD254. When basic OPSEC measures are prescribed, there shall be no required OPSEC CDRLs associated with this contract. However, the contractor will adhere to all OPSEC requirements specified in the NAVAIR DD254 OPSEC Annex. The Contractor shall be responsible for subcontractor implementation of the OPSEC Program requirements for this contract.

1. Per reference (a), the Command Senior Intelligence Officer is the official approving authority for release of intelligence information via NAVAIR contracts.

a. Contractors are not authorized to disclose further or release intelligence without the prior written notification and approval of the Senior Intelligence Officer. Contractors are not authorized to release intelligence information to sub-contractors without a sub-contract DD-254 signed by an Intelligence Officer with DD-254 signature authority appointed by the Senior Intelligence Officer.

i. All contracts and sub-contracts authorizing access to non-SCI intelligence information must include a copy of this memorandum and the following language in the DD-254:

The contractor is authorized access to non-SCI National Intelligence Information and/or Foreign Intelligence Information on behalf of Rebecca Ahne, NAVAIR Senior Intelligence Officer. A final security clearance at the appropriate level is required for access to Non-SCI National Intelligence Information and/or Foreign Intelligence information. Further security guidance for reproduction, release, retention, return, and destruction of National Intelligence Information is stipulated in the attached NAVAIR Memorandum titled POLICY GOVERNING RELEASE OF INTELLIGENCE TO CONTRACTORS dated 24 JANUARY 2022. ii. All contracts and sub-contracts authorizing access to the SECRET Internet Protocol Router Network, but not authorizing access to non-SCI intelligence, must include the following language in the DD-254:

The contractor is authorized access to the SECRET Internet Protocol Router Network; however, access to non-SCI intelligence information is not authorized.

iii. Contracts and sub-contracts authorizing access to the SECRET Internet Protocol Router Network, but DD-254 block 10e(2) is not selected meaning the contractor is not authorized access to non-SCI intelligence information, do not require review or signature by the Senior Intelligence Officer.

b. Intelligence released to contractors, all reproductions thereof, and all other material generated based on, or incorporating data there from, including authorized reproduction, remain the property of the US Government. Unless otherwise specified in the contract, the contractor shall return all intelligence documents to the Scientific and Technical Intelligence Liaison Office within 24 months of date of receipt, or the termination date of the contract. The contractor shall properly destroy and dispose of the intelligence information as soon as possible after it has served the purpose for which it was released by the government, developed, prepared, or retained after completion or termination of the contract in accordance with the NISPOM.

c. All intelligence information will be reviewed and validated by the Senior Intelligence

Officer prior to being utilized and/or delivered in a finished product. Intelligence information intended to be utilized form other contractual efforts satisfying this contract will be coordinated and approved prior to execution by all parties.

2. Per reference (b), contractor personnel involved in intelligence and intelligence-related activities are required to report any significant highly sensitive matter, or questionable intelligence activities, to the NAVAIR Senior Intelligence Officer.

3. The contractor must restrict access to only those individuals who are actually providing services under the contract with a valid need to know.

text: Technical papers, briefings, presentations, either classified or unclassified to be presented at classified symposia must be submitted to A0N0000 for approval prior to presentation. Unclassified material submitted for public release (that is not to be presented at classified symposia) shall be forwarded for review prior to release as stated in item 12 above. All controlled unclassified and classified technical information shall be appropriately marked with distribution statements as specified in DoDI 5230.24 (Distribution Statements on Technical Documents) http://www.dtic.mil/whs/directives/corres/pdf/523024p.pdf.

Determination of need-to-know in connection with a classified visit is the responsibility of the individual/host who will disclose the classified information.

All contracts with non-Sensitive Compartmented Information and Non-Compartmented work that may reveal mission-related information of a sensitive activity or sensitive operation should be routed to the NAVAIR STILO for approval.

The COR, TPOC, and Government Security Office, concerning instances of possible loss, compromise, and electronic spillage of classified or controlled unclassified information shall be notified immediately upon discovery and/or no later than 72 hours of discovery.

The following Security Classification Guide(s) apply to classified performance on this contract. Subsequent updates shall be provided by the Technical Point of Contact/Contracting Officer Representative/Contracting Officer Security Representative (as applicable) as Government Furnished Information (GFI) and shall be executed by the Contractor without obligation to modify this DD Form 254.

Block 10e (2) – The contractor is authorized access to Non-SCI National Intelligence Information and/or Foreign Intelligence Information on behalf of Rebecca Ahne, NAVAIR Senior Intelligence Officer. A final security clearance at the appropriate level is required for access to Non-SCI National Intelligence Information and/or Foreign Intelligence information. Further security guidance for reproduction, release, retention, return, and destruction of National Intelligence Information is stipulated in the attached NAVAIR Memorandum titled POLICY GOVERNING RELEASE OF INTELLIGENCE TO CONTRACTORS dated 01 MARCH 2022. Written concurrence of the Technical Point of Contact/Contracting Officer Representative/ Contracting Officer Representative for Security (as applicable) is required prior to subcontracting.

Block 10.g –To facilitate potential access to NATO classified information, to include NATO accredited SIPRNet terminals, all DoD military, civilian, and contractor personnel who are briefed on their responsibilities for protecting U.S. classified military information, shall also be briefed on the requirements for protecting NATO information, per Deputy Under Secretary of Defense Policy Security Memo of 5 Dec 01. Written concurrence of the Contracting Officer/Technical Point of Contact, identified in Block 16, is required prior to subcontracting.

Block 10.h – Foreign Government Information (FGI) is not releasable to contractor employees who have not received a final security clearance at the appropriate level. Written concurrence of the Technical Point of Contact/Contracting Officer Representative identified in Block 16, or Contracting Officer Representative for Security (as applicable) is required prior to subcontracting.

Block 10.j – Controlled Unclassified Information including Legacy FOUO and Covered Defense Information (meeting the definition of DFARS Clause 252.204–7012 Safeguarding covered defense information and cyber incident reporting) generated and/or provided under this contract shall be marked and safeguarded as specified in DoD Instruction 5200.48 (Controlled Unclassified Information) (CUI)) available at https://www.esd.whs.mil/Portals/54/Documents/DD/issuances/dodi/520048p.PDF. Any product containing Covered Defense Information shall be assigned the appropriate distribution statement using the criteria set forth in DoDI 5230.24 (Distribution Statements on Technical Documents); and have this statement displayed per DoDI 5230.24, Enclosure 3-4.

All Covered Defense Information (CDI), Legacy FOUO, and program Controlled Unclassified Information (CUI) data transmitted and safeguarded via electronic means shall use approved encryption. The Contractor shall ensure that when transmitting CUI/Legacy FOUO/CDI over non-secure e-mail (e.g. not connected to the Navy Marine Corps Intranet through Broadband Unclassified Remote Access System / Virtual Private network), those transmissions are encrypted using Department of Defense Public Key Infrastructure (PKI), or an approved DoD External Certificate Authority, in accordance with Public Key Infrastructure & Public Key Enabling, DoDI 8520.02, 24 May 2011.

Block 10.k – Secret Internet Protocol Network (SIPRNet) access authorized. The contractor shall not access, download, or further disseminate any information or data that falls outside the scope and execution of the defined contract requirements. In the event any additional access is required, the Technical Point of Contact/Contracting Officer Representative must modify the requirements for DD Form 254 revision. Contractor shall prepare and submit all required documentation as required by Command policy prior to receiving access. Written concurrence of the Technical Point of Contact/Contracting Officer Representative identified in Block 16, or Contracting Officer Representative for Security (as applicable) is required prior to subcontracting.

Block 11.c- Information Systems (IS) shall be protected in accordance with DoDI 8510.01; and/or per guidance in the DoD National Industrial Security Program Operating Manual (NISPOM) codifying 32 Code of Federal Regulation Part 117, NISPOM Rule, 24 February 2021.

Block 11.d-Contractor shall provide adequate storage at their facility for classified hardware. Classified shipments are not to exceed two cubic feet. Larger size shipments require prior coordination with the Facility Security Officer (FSO) to confirm facility storage capacity. Preparation and transmission of material for shipment will be in accordance the DoD National Industrial Security Program Operating Manual (NISPOM) codifying 32 Code of Federal Regulation Part 117, NISPOM Rule, 24 February 2021 and the DoD 5200.01 V3, DoD Information Security Program Manual.

Block 11.g – To use DTIC services, the contractor must register for an account at http://www.dtic.mil/dtic/registration/contractors/index.html.

Block 11.i – TEMPEST information is not releasable to contractor employees who have not received a final security clearance at the appropriate level. The TEMPEST Requirements Questionnaire shall be submitted to the SPAWAR TEMPEST IPT in accordance with OPNAVINST C5510.93F, Navy Implementation of National Policy on Control of Compromising Emanations. Written concurrence of the Technical Point of Contact identified in block 16, or the Contracting Officer Representative/Contracting Officer Representative for Security (as applicable) is required prior to subcontracting.

Block 11.j – APSD, (the Requiring Organization), has made a determination that BASIC Operations Security (OPSEC) measures are sufficient to protect the contracted related Critical Information associated with this Contract. The NAVAIR DD254 OPSEC Annex, dated Jan 2013, shall be included as an attachment to this DD254. When basic OPSEC measures are prescribed, there shall be no required OPSEC CDRLs associated with this contract. However, the contractor will adhere to all OPSEC requirements specified in the NAVAIR DD254 OPSEC Annex. The Contractor shall be responsible for subcontractor implementation of the OPSEC Program requirements for this contract.
