About this file

This is a Questions and Answers document for federal contract solicitation N00244-26-R-3101, a SeaPort NxG task order issued by the Navy.

The document addresses eight questions raised by potential offerors regarding the solicitation requirements. Key clarifications include: (1) correction of overtime hours in the pricing template to reflect 60 total hours annually (30 in each of Norfolk and San Diego locations); (2) reallocation of Other Direct Costs CLINs to distribute one per year to Norfolk instead of concentrating all ten in San Diego; (3) confirmation that the 8% SeaPort fee cap applies only to Cost-Plus-Fixed-Fee orders, not to this firm-fixed-price effort, and that ODCs are non-fee-bearing CLINs; (4) explanation that the detailed pricing template requirements serve to assist small business offerors and support realism analysis and fair pricing determinations under FAR 52.222-46, with offerors required to provide certified cost or pricing data; (5) requirement for subcontractors to submit separate pricing spreadsheets; (6) expansion of the technical approach page limit from 20 to 30 pages to accommodate detailed coverage of all seven major task areas and 61 subtask areas; (7) notification that Q&A responses will be provided via SAM.gov as an excel sheet due to SeaPort NxG portal decommissioning; and (8) confirmation that interim Top Secret security clearances are acceptable at award for personnel requiring Top Secret/SCI/SAP access for tasks 4.1, 4.2, and 4.4, with offerors required to submit a draft DD-254 demonstrating current or eligible facility security clearance status.

Reference Question Government Response

Att 01 Pricing Template

With respect to Attachment 01 Price Template, tab labeled "Far 52.217-8", cells D24 and D25 appear to calculate 60 hours each of Overtime in Norfolk and San Diego. This is the same as all other years.

Should these be calculating 30 hours each of Overtime in Norfolk and San Diego, to equal half a year?

Should be 60 hours of overtime total for the year, 30 in each location. Corrected in the attachment.

2 2.0 Objectives

It appears in Section B that all 10 ODC CLINs have been labeled as being allocated to San Diego.

Would the government please relabel one ODC CLIN per year to be allocated to Norfolk?

Re-labeled.

3 3.0 Scope

With the understanding that all applicable clauses and provisions of the basic SeaPort NxG contract are incorporated into this solicitation: would the government please confirm that the SeaPort fee cap of 8% applies only to cost reimbursable efforts, and that the fee cap does NOT apply to this solicitation which is a firm fixed price effort?

The 8% maximum fee cap applies only to Cost-Plus-Fixed- Fee orders. Offerors are on notice that ODCs are non-fee bearing CLINs.

4 3.0 Scope

Though the incumbent contract consisted of CPFF labor, the draft RFP Section B sets forth all labor CLINs as Firm-Fixed Price. The instructions set forth in Section L for the cost proposal include many requirements that are not standard for FFP proposals, such as the request for a fully disclosed breakout of labor costs and specified hours. Will the government consider instead requiring only hours and FFP hourly rates, which ensure that the LOE is being proposed as reflected in the PWS, but allow for a more standard FFP pricing?

The intention of the price template is to help small business offerors develop price proposals. The pricing elements also help with the realism analysis required pursuant to FAR 52.222-46 and help determine a fair and reasonable price if adequate price competition is not achieved. Of note, this requirement is non-commercial, so the offeror shall provide certified cost or pricing data as requested by the Contracting Officer. Also of note, this requirement has cost type CLINs, an offeror with an adequate accounting system that is eligible for award should have little difficulty filling out the price template.

4.0 Course

Requirements

Will the government confirm that a subcontractor is not required to provide a separate pricing spreadsheet, assuming the subcontractor's burdened labor rates are included in the prime contractor's pricing?

Subcontractors should have a separate excel with their price information. Of note, the limitations on subcontracting apply to this task order.

4.0 Course

Requirements

Subfactor I - Technical Approach: The solicitation states the offeror shall provide, in detail, an approach that demonstrates the offerors ability to perform ALL tasks listed in the PWS. Would the government please confirm that this includes addressal of both the 7 major task areas and ALL 61 subtask areas as a part of this detailed approach? If so, will the government consider allowing for 30 pages vice 20 pages to accommodate a compliant and responsive approach?

Section L will be revised to allow for 30 pages.

Requirements

The solicitation stipulates that questions are to be submitted via email to the government, vice through the SeaPort portal. Would the government consider allowances for vendors to have visibility into all questions and answers?

Guidance from our policy department has the SeaPort NxG portal being de-commissioned. If it was within my purview, continuing to maintain and utilize the SeaPort portal would be a high priority action item. Since it is regrettably not within my purview to budget and maintain the SeaPort NxG portal, an excel sheet with the Govt. responses will be provided via SAM.gov.

8 PWS Section 8

Section 8.0 Security Requirements, para 8.1 states that, as outlined in the DD-254, contractor personnel providing services in support of task 4.1,

4.2 and 4.4 require a Top Secret security clearance, and access to "Sensitive Compartmented Information" (SCI) and "Special Access Programs (SAP)”. Would the government please confirm this requirement for task 4.4 and , if confirmed, would the government consider interim Top Secret acceptable at award?

Yes, the government will grant an interim clearance. Per page 40 of the solicitation: The offeror must submit the draft DD254 as part of their proposal. The offeror shall demonstrate that it either currently possesses a required Facility Security Clearance in accordance with the draft DD-254, or evidence that they are willing and eligible to obtain the required FCL security clearance.
