Question: Response:
125 RFP Section L, Page 9 of 10;
Table 5-SBSIF Goal; &
Para (c)(i); Q&A No. 38, 68, 98, 107, and 108
It appears that the Government intent is to make this a 6% max contract wherever possible. Is it the intent of the Government that the decision whether a Delivery Order is
Fixed Fee or Award fee will be unilateral or by mutual agreement between the
Government and Contractor? If unilateral, what specific criteria will be used to make this determination and what appeal will the Contractor have in this process?
No. Vendors may bid Not To Exceed (NTE) six percent (6%) fee which is utilized as either fixed fee (CPFF)/base fee (CPAF) per clause fill-in B-232-
H003 PAYMENTS OF FEE (S) (COMPLETION) (NAVSEA) (OCT 2018).
Yes. The intent of the Government that the decision whether a Delivery Order is
Fixed Fee or Award Fee will be unilateral or by mutual agreement between the
Government and Contractor. To the maximum extent possible, order modifications will be made by bilateral modifications to the contract, which are fully priced and contain definitive delivery schedules. The ACO and the awardee should work in a collaborative manner via a bilateral modification
(after a unilateral DO is placed) per the terms set forth in Section G, Amendment 0003.
Unilateral orders may be placed in support of CM/emergent type of work (CLIN
0002/0003) but is not limited to those specific CLINs.
Please refer to Section G in Amendment 0004 which describes the process. The sentences were part of the SOW but are now moved to one consolidated
Section.

Para 3.5.2 Subpara 15
RFP Section L Para 3.5.2 Subpara 15 states that, "Subcontract Management Plan: If
Subcontracting or teaming is proposed, the Offeror shall propose a Subcontract
Management Plan (SMP). The Offeror’s SMP shall describe its processes and techniques used to manage subcontract performance (technical, schedule, and cost), billing, and reporting. The SMP shall be fully consistent with other portions of the proposal. The SMP shall only include those subcontractors, which are priced in the cost/price proposal. If subcontractors are not included in the cost/price proposal, they should not be referenced in any part of the proposal."
This seems to restrict information permitted in the Cost Volume that would otherwise support the prime offeror's best value decisions in developing an overall pricing strategy. For example, would it be the government's intent that offerors who obtained competitive bids in support of the prime proposal withhold all information relating to the unsuccessful potential teammate from the government?
If subcontractors are not included in the cost/price proposal, they should not be referenced in any part of the proposal has been removed. See Amendment 0004.
The SMP should be a separate plan unlike the cost/price analysis (best value selection) performed by the Prime. Evidence that the Prime went through the rigors of a competitive environment resulting in a downselect of the subcontractor is sufficient to satisfy Price Analysis.
127 RFP Attachments
J-5, L-3
Attachment J-5 shows that there will be two RCOHs during the seven year period of this contract. These are typically preceeded by a SCOOP availability performed by the
PSM, however it is not obvious which CLIN type this work would be performed under.
Please clarify.
The two (2) RCOHs/SCOOP do not apply to this procurement.

Question: Response:
128 RFP Section I, page 137 In regards to FAR 52.247-66, please clarify what the Government’s liability for third-party bodily injuries and/or property damages are while such cylinders are in the care, custody or control of the Government.
FAR 52.247-66 clause has been removed. See Amendment 0004.
129 RFP Section L, page 186 In the Government's response to bidder question # 019, it claimed that Amendment 1 removed duplicate language where the SF33 Solicitation Set was required in Volume I and the same Model Contract was required in Section 5 of Volume IV. However, even in the Amendment 3 Conformed RFP, it appears that both requirements are still present.
Please consider removing the Section 5 Model Contract of Volume IV to eliminate the redundancy.
7. Instructions for Section 5 – Completion of the following:
a) The completed sections as indicated below, including all
Representations and Certifications, shall be completed, signed, and provided under this section. All Section A signatures shall be original signatures. Sections of the Solicitation/Model Contract that are not being filled out or signed are not required to be included in this
Section.
b) The completion and submission to the Government of the above items will constitute an offer and will indicate the Offeror’s unconditional assent to the terms and conditions in this solicitation, including any attachments.
The Item 7. above has been removed as well as reference in other parts of
Section L. See Amendment 0004.
130 Q&A Question #116 Per the governments answer to Question #116, only one (1) volume submission will be accepted. Does this mean one (1) password protected zipfile will be acceptable?
The (1) volume was meant for a one to one ratio (not to combine volumes), meaning Vol I (can contain multiple files), Vol II (multiple files), Vol III
(multiple files), and Vol IV (multiple files). PIEE does NOT allow zip files for security reasons.
131 RFP Section L In order to comply with the requirement to submit only 4 separate e-files, will the government establish 4 VOLUME Sections in PIEE under the Offer tab where the
Offeror can attach all associated documents?
Due to security reasons, PIEE is a one file upload at a time (but can support infinite multiple files) environment. No tabs can be set up. Just upload one file one at a time until all files are uploaded. Government recommends a cheat sheet tracker attached to the proposal listing every file uploaded and what Volume they pertain to so that it is easy to identify if something is missing/does not open up/corrupt file as well as an organized/intuitive file naming convention.
132 RFP Section L Are there any file size limitations for PIEE submissions? Given the requirement that
“Submitted Electronic files shall not be compressed” and that original file types and traceability must be maintained, the file sizes may become quite large. If file size become an issue during PIEE submission, can Volume II be broken down into separate files by Factor (1,2,3) due to the requirements of those particular factors? If this is not acceptable, please provide a means where the Offer can submit the very large volumes.
Each single file shall not exceed 1.9GB. Yes, as clarified in Q130 above, vendor discretion at how they want to organize each Volume and stay within the size file constraint. Please do not submit large volumes.
