SECTION M - EVALUATION FACTORS FOR AWARD

The following have been modified:

EVALUATION FACTORS FOR AWARD

I. GENERAL

A. The Government intends to award two separate Firm Fixed-Price contracts: one contract for the completion of the USS SOMERSET (LPD 25) FY21 SRA and one contract for the USS RUSSELL (DDG 59) FY21 SRA to the Offerors whose proposals, together, represent the best value to the Government.

B. Offerors are advised that the Government intends to make award on the basis of initial proposals without conducting discussions with Offerors, but the Government reserves the right to conduct discussions if determined by the Contracting Officer to be necessary (see paragraph (f)(4) of FAR 52.215-1). Therefore, each initial offer should contain the Offeror’s best terms from a price and technical standpoint. Should the Government establish a competitive range and enter discussions for either the USS SOMERSET or USS RUSSELL evaluation and source selection, the scope of that determination and discussions will be limited to either the USS SOMERSET or USS RUSSELL only, unless discussions are necessary for both.

C. Offerors are advised that the Government will not evaluate any proposal information not contained within the body of each proposal.

II. BASIS OF AWARD

A. The Government will restrict the awards of the USS SOMERSET and the USS RUSSELL such that both availabilities shall not be awarded to the same Offeror. The Government will award the USS SOMERSET and the USS RUSSELL to the technically acceptable and responsible proposals from two different Offerors that together represent the combined, lowest total evaluated price to the Government, based upon an assessment of Cost/Price Factor and Non-Price Factor 1: Eligibility. A contract may be awarded to the Offeror who is deemed responsible in accordance with FAR 9.104, whose proposal conforms to the RFP’s requirements (to include all stated terms, conditions, representations, certifications, and all other information required by Section L of this solicitation) and represents the best value to the Government.

B. For the USS SOMERSET and USS RUSSELL

a. The best value basis for award will be based on the following evaluation factors:

Non-Price Factor

a) Factor 1: Eligibility Factor

Cost/Price Factor

a) Factor 2: Price

b. Ratings will be applied to each factor as follows: Non-Price Factor 1 will be rated as either

‘acceptable’ or ‘unacceptable.’ A separate Factor 1 rating will be applied for each USS SOMERSET and USS RUSSELL.

C. The Government will initially only evaluate the Offeror with the lowest priced proposal submitted in response to each availability. However, if a single Offeror submits the lowest priced proposal for each availability, the Government will then review the next lowest priced proposal from a second Offeror, which together represent the combined, lowest total evaluated price to the Government. The Government will only evaluate the two (2) lowest Offerors, which together represent the combined, lowest total evaluated price to the Government. Following price evaluation, the Government will then make a determination as to whether the lowest priced Offerors meet the minimum technical requirements. If the lowest priced Offerors are determined to be technically acceptable, no competing proposals will be reviewed. In addition, if the Government determines discussions are necessary, the Government will complete a technical evaluation of all Offerors and establish a competitive range. The SSA will base the source selection decision on an assessment of proposals against all source selection criteria in the solicitation.

III. EVALUATION FACTOR DESCRIPTIONS

USS SOMERSET and USS RUSSELL

A. Factor 1 – Eligibility Factor:

The objective of this factor is to:

1. Assess whether the Offeror holds a Master Ship Repair Agreement (MSRA) or has demonstrated equivalency as outlined in Section L, subsections V.B.1 and V.D.1 for Factor 1.

2. Assess whether the Offeror has ownership or committed access to a pier capable of berthing the vessel, in accordance with Section L.

B. Factor 2 - Price

1. The Government will assess price proposals in accordance with FAR 15.404 to determine reasonableness of proposed pricing based on the information contained in the availability’s Pricing Workbook. The Government will not conduct a price realism analysis on any aspect of an Offeror’s price proposal. Although award will be made based on an Offeror’s total price, a price proposal that is found unreasonable and/or unbalanced may be rejected. Unbalanced pricing exists when, despite an acceptable total evaluated price, the price of one or more contract line items is significantly overstated or understated.

2. Total Evaluated Price for each availability shall be calculated by adding:

a) The price of the basic contract line item numbers (CLIN) (this amount shall match the total price of all work items),

b) The price of all option CLINs,

c) Contractor’s Fully Burdened Ship Repair Labor Rate & Material Burden Rates as applied to all

Growth Reservation CLINS (Base and Option) and New Work,

d) Contractor’s daily extension rate as applied to the number of additional days pier side requiring availability extension listed in Attachment J-4 (USS RUSSELL) and Attachment J-14 (USS SOMERSET), and

e) As applicable, the value of the inter-port differentials (as identified in Section L of this solicitation)

3. Evaluated price for Extension Day Rates and Fully Burdened Ship Repair Labor Rates & Material Burden Rates (as applied to Growth Reservation CLINs and New Work) shall be calculated in the following manner:

a) Growth Reservation CLINs (Base and Option)

(1) Multiply the proposed fully burdened ship repair labor rate by the number of hours associated with (1) each Growth Reservation CLIN and (2) New Work allocation to yield the labor hour price.

(2) Multiply the material burden rate proposed by the dollar value of material associated with (1) each Growth Reservation CLIN and (2) New Work allocation to yield the burdened material price for that CLIN.

(3) Add the sum of labor hour and material dollar price to find the total price for each Growth Reservation CLIN and New Work allocation. (Note, the offeror’s Fully Burdened Ship Repair Labor Rate & Material Burden Rate as applied to New Work allocation will be included in the Total Evaluated Price for evaluation purposes only. This figure will not be incorporated into the contract at the time of award; however, the offeror’s Fully Burdened Ship Repair Labor Rate & Material Burden Rate will be utilized for pricing of New Work arising during contract execution.)

b) Extension Day Price

(1) Multiply the proposed daily rate by the number of days associated with that rate to yield the evaluated price for the pier-side extension. Offerors are advised that the number of extension days used to calculate the Extension Day Price are for evaluation purposes only.

4. Subcontracting Plan: (For large businesses only.) The Government will assess the plan for:

a) Compliance with FAR clause 19.704; subcontracting goals identified in Section L, V.A.4.b; and

FAR 52.219-9 to include all subparagraphs in FAR 52.219-9(d).

b) Adequate rationale for any proposed goals that are lower than the goals identified in Section L, V

A.4.b.

5. Inter-port Differential

a) The inter-port differential chart in Section L provides the values to be included in all Offerors’ price proposals to determine the Offeror’s Total Evaluated Price.

IV. EVALUATION FACTOR RATINGS

The ratings will be based on what is contained in or referenced in the proposal, not on information obtained from other sources. The adjectival ratings described below are guides; a proposal need not have all aspects of the rating description to be rated accordingly. The ratings are set as follows:

A. Non-Price Factor 1: USS SOMERSET and USS RUSSELL

1. For Factor 1 for each ship, the rating reflects whether the information submitted in response to Factor 1 for that ship meets or does not meet the minimum requirements through an assessment of the proposal. The evaluation will identify any inconsistencies in Offerors’ proposals. The ratings for Factor 1 are as follows:

Rating Description

Acceptable Proposal clearly meets the minimum requirements of the solicitation.

Unacceptable Proposal does not clearly meet the minimum requirements of the solicitation.

B. Definitions:

1. Best Value means the expected outcome of an acquisition that, in the Government’s estimation, provides the greatest overall benefit in response to the requirement. See FAR 2.101.

2. Competitive Range - See FAR 15.306(c).

3. Discussions are exchanges (i.e., negotiations) in a competitive environment that are undertaken with the intent of allowing the Offeror to revise its proposal. Discussions take place after establishment of the competitive range. See FAR 15.306(d).

4. Clarifications are limited exchanges, between the Government and Offerors that may occur when award without discussions is contemplated.

5. Deficiency is a material failure of a proposal to meet a Government requirement or a combination of significant weaknesses in a proposal that increases the risk of unsuccessful contract performance to an unacceptable level. See FAR 15.001.
