CLAUSES INCORPORATED BY FULL TEXT

5252.204-9501NATIONAL STOCK NUMBERS (NAVAIR)(MAR 2007)
(a) This clause applies to supplies that are stock numbered under Federal Catalog System procedures.
(b) Unless otherwise authorized by the Contracting Officer, in writing, the Contractor shall not deliver any supplies until the supplies have been marked with a National Stock Number. All available National Stock Numbers will be furnished by the Government. If National Stock Numbers are not furnished by the Government in time to meet the delivery schedule for the supplies, the Contractor may present the supplies that are scheduled for delivery to the Contracting Officer for acceptance. The Contracting Officer may accept such supplies without National Stock Numbers and the Government will pay the Contractor, provided that title to the supplies is vested in the Government.
(c) The term “Federal Stock Number” (FSN), which may be referred to in the specifications of this contract or elsewhere in this contract, shall mean “National Stock Number” (NSN), and the term “Federal Item Identification Number”, wherever it appears, shall mean “National Item Identification Number”.

(As used in the foregoing clause, the term “Contracting Officer” shall mean the “Administrative Contracting Officer” (ACO) with respect to provisioned items and other supplies ordered by the ACO.)

B-3 NOTE 1

Determination of Applicable Pricing Ranges

(a) CLINs 0101/0102, 0201/0202, 0301/0302, and 0401/0402 contain the same Fuze and CLINs 0101/0103, 0201/0203, 0301/0303, and 0401/0403 contain virtually the same accessories. To achieve economies of scale, the Government will combine the individual quantities of each pair of CLINs and the total quantity of both CLINs will be used to determine the pricing range under B-2 Pricing Ranges for both CLINs.

To achieve this, the unit price for CLINs 0101, 0201, 0301, and 0401 will be derived by adding the applicable price for the composite quantity of Fuzes (CLIN 0X02) and the applicable price for the composite quantity of accessory kits (0X03) together.

For example, if the Government orders 8,000 units of CLIN 0101, 4,000 units of CLIN 0102, and 1,000 units of CLIN 0103, the unit prices for each CLIN would be determined as follows;

(1) For CLIN 0102, the individual quantities of CLIN 0101 (8,000) and 0102 (4,000) would be added (8,000 + 4,000 = 12,000) and the pricing range for 12,000 in Table 3 would be used for the unit price of 4,000 CLIN 0102 Fuzes.

a.

Unit price of CLIN 0102 → CLIN 0101 order quantity of 8,000 units

+ CLIN 0102 order quantity of 4,000 units

CLIN 0102 total order quantity of 12,000 units

The total price for CLIN 0102 would utilize the unit price from pricing range at the 12,000 level in Table 3 then multiplied by the 4,000 units.

(2) For CLIN 0103, the individual quantities of CLIN 0101 (8,000) and 0103 (1,000) would be added (8,000 + 1,000 = 9,000) and the pricing range for 9,000 in Table 3 would be used for the unit price of 1,000 CLIN 0103 accessory kits.

Unit price of CLIN 0103 → CLIN 0101 order quantity of 8,000 units

+ CLIN 0103 order quantity of 1,000 units

CLIN 0103 total order quantity of 9,000 units

The total price for CLIN 0103 would utilize the unit price from pricing range at the 9,000 level in Table 3 then multiplied by the 1,000 units.

(3) For CLIN 0101, the unit price of CLIN 0102 from “(1)” above would be added to the unit price of CLIN 0103 from “(2)” above to develop a unit price for CLIN 0101 (CLIN 0102 pricing rage for 12,000, see “(1)” above + CLIN 0103 pricing range for 9,000, see “(2)” above = Unit price of CLIN 0101) .

Unit price of CLIN 0101 →
Unit price of CLIN 0102 from “(1)” above

+ Unit price of CLIN 0103 from “(2)” above

Unit price of CLIN 0101

Unit price of CLIN 0101 Calculation →
Unit price for CLIN 0102 at pricing range of 12,000 units

+ Unit price for CLIN 0103 at pricing range of 9,000 units

The total price for CLIN 0101 would utilize the unit price from pricing range for CLIN 0102 at the 12,000 level plus the unit price for CLIN 0103 at the 9,000 level in Table 3 then multiplied by the 8,000 units.

(b) The Government shall have the right at all times to unilaterally issue delivery order(s). If within 60 days of issuance of each delivery order the Government increases quantity, the respective unit prices and total prices shall be revised for all units ordered based on the combined quantity ordered within that 60 day period. The revised unit prices and total price shall be based upon the prices set forth in the B-2 Pricing ranges above for the total quantities ordered in the respective ordering period as modified for each item ordered.

(1) For example, if 60 days after the award of the delivery order for the quantities in the prior paragraph, the Government wanted to add an additional 3,000 units of CLIN 0102, the new combined total would be 15,000 (8,000 + 4,000 + 3,000 = 15,000) and the pricing range for 15,000 in Table 3 would be used for the unit price of the 7,000 units of CLIN 0102 and the unit price of the 8,000 units of CLIN 0101 would be adjusted for the revised Fuze price.

a.

Unit price of

CLIN 0102 →

CLIN 0101 order quantity of 8,000 units

CLIN 0102 order quantity of 4,000 units

+ CLIN 0102 order quantity of 3,000 units

CLIN 0102 total order quantity of 15,000 units

The total price for CLIN 0102 would utilize the unit price from pricing range at the 15,000 level in Table 3 then multiplied by the 7,000 units.

b.

Unit price of

CLIN 0103 →

CLIN 0101 order quantity of 8,000 units

+ CLIN 0103 order quantity of 1,000 units

CLIN 0103 total order quantity of 9,000 units

The total price for CLIN 0103 would utilize the unit price from pricing range at the 9,000 level in Table 3 then multiplied by the 1,000 units.

c.

Unit price of

CLIN 0101 →

Unit price for CLIN 0102 at pricing range of 15,000 units

+ Unit price for CLIN 0103 at pricing range of 9,000 units

The total price for CLIN 0101 would utilize the unit price from pricing range for CLIN 0102 at the 15,000 level plus the unit price for CLIN 0103 at the 9,000 level in Table 3 then multiplied by the 8,000 units.

(unit price at 15,000 + unit price at 9,000) = Adjusted unit price for CLIN 0101 * 8,000 units = Total price for CLIN 0101.
