PWS Comment/Question Answers
Section 3.0 – Requirements (para. 2) (Pg. 48)
Instructors shall possess a SECRET clearance prior to work on this requirement..."
Due to the time constraints between contract award and contract kick-off and the uncertainty of clearance processing times, does an "Interim SECRET" clearance for all instructors meet this requirement?
Yes, Interim SECRET meets the requirement;
however, no CAC cards can be issued unless individual has a current, final, favorably adjudicated investigation.
Section 3.0 - Requirements
(Pgs. 47 and 48)
Is the contractor’s attendance for the Annual JNLWD Director Review and the JCIG meeting considered part of Task 2?
Yes. Contractor attendance at the Annual JNLWD Director’s Review and the JCIG meeting are
Program Management related and are related to Task 2.
Section 3.1 - Task 1: Schedule of Courses (Pg. 49)
Will the Government set the dates/timeframe required for the classes or will the Contractor negotiate the schedule with each individual institution post award?
The solicitation provides timeframes for when classes would be required. Initially, the Government (JNLWD) will work with the contractor to determine dates that classes are to be in session. Once the contract work has begun, the contractor will routinely liaise with the various schools (see Task 2).
Section 3.1, Task 1 Course Development
(Pg. 49)
Will the government please provide the type of Learning Management System (LMS) (e.g., Blackboard) used by each of the schools?
The Core classes are all lecture type provided by the instructor. There is no reference in Section 3.1 for the Learning Management System; however, in Section 3.5 of the PWS references updating of the Government’s on line LMS listed under Optional Task 10. (See page 50).
Each venue uses a similar but different LMS.
If this option is elected by Govt., exact LMS version will be identified.

Amendment 0001 corrects this error.

Yes. The course materials are considered data as cited in Section 14.0 of the PWS.

Government/Marine Corps with the level of intellectual property/data rights provided by such DFARS data rights clauses." With this as background, DFARS clause 252.227-7020 states: When a work is first produced, created, or generated under this contract, and such work is required to be delivered under this contract, the Contractor shall assign copyright in those works to the Government. Therefore, the preferable default is the assignment of the deliverable Works to U.S.
Government/Marine Corps. However, the Government will be willing to negotiate the terms of the data rights at contract award if necessary, e.g., when a deliverable Work is not first produced, created, or generated under the contract.
