About this file

This Amendment #1 Questions and Answers document addresses clarifications submitted for RFB #PA180737, issued by the Wisconsin Department of Public Instruction (now under the Department of Administration) for the processing of USDA bulk cheese into cheese quesadillas. The state seeks to procure the best product passing student taste tests at the lowest total price per serving for distribution to Wisconsin schools participating in the National School Lunch Program and Summer Food Service Programs. The RFB specifies that quesadillas must be bulk wrapped with CN labeling, maintained at specific temperature requirements throughout shipment, and sealed in cases with a minimum net weight of ten pounds using approved closure methods. Products must comply fully with all RFB specifications to receive consideration for award, and no additional items may be added to the contract during its term. The contract period runs from July 1, 2018 through June 30, 2019, with an estimated amendment posting date of August 25, 2017.

Pricing is structured as a fee-for-service processing model where bidders submit a total processing bid price per case in Column A of Attachment A, which represents the fee to produce one case of end product using USDA bulk cheese provided by the state. Column C reflects the USDA food value per case, calculated using the SY2018 rate of $1.6929 per pound, with updates to follow for the contract period. The submitted processing fee per case will remain fixed for the entire 2018-19 school year and will be invoiced to the department for all orders placed. Bidders may offer either 50/50 or 100% cheese products, with final award determination based on the total bid price per serving. Proof of insurance need not accompany the bid response, though awarded contractors must provide certificates of authority and complete affirmative action plans after contract execution if estimated contract value exceeds $50,000. Standard Terms and Conditions section 34 regarding Work Center Program does not apply to this procurement.

Amendment #1, Questions and Answers

RFB # PA180737

Cheese Quesadilla, Bulk Fook Processing Wisconsin Department of Public Instruction (8/23/2017)

The following is the response to questions submitted according to Section 6.2 CORRESPONDENCE, CLARIFICATIONS AND QUESTIONS, of the RFB document.

Q1:If our product is not 100% compliant to the specs, is there ANY case in which we would be considered for an award, even if no other product were offered?
A1:Submitted product must meet the specifications as outlined in the RFB.
Q2:Regarding “Wisconsin municipalities” is the RFB allowing the proposer to drop ship to larger school districts who can handle a minimum shipment?
A2:The Vendor Agreement Form DOA 3333 allows the contractor to offer the bid pricing to school districts. The State of Wisconsin is not part of this so it would mean that contractor would enter into a separate contract with the school district(s).
Q3:What if we drop ship a school district, will we still bill the State of Wisconsin?
A3:As indicated in Form DOA-3333, Vendor Agreement,

“The State of Wisconsin is not a party to these purchases or any dispute arising from these purchases and is not liable for delivery or payment of these purchases.”

Therefore, any pricing that bidder extends to any Wisconsin school districts would be a separate contract from a contract with Wisconsin Department of Public Instruction.

Q4:Concerning ST&C #23-Insurance, do you want the proposer to submit proof of insurance with our response?
A4:No.
Q5:Concerning ST&C #33-Foreign Corporations, can we provide the “Certificate of Authority” after the award?
A5:Yes.
Q6:Concerning ST&C #34-Work Center Program, our company cannot provide this process and is limiting our ability to respond to the RFB. Do I declare we cannot provide the process on Form DOA 3333 under “Special Conditions”? Will our company still be able to receive an award if all other conditions of the RFB are met?
A6:Standard Terms and Conditions, #34-Work Center Program, does not apply to this Request for Bid.
Q7:Question during the life of the contract will the awardee be able to add additional items to the contract?
A7:No.

Q8: Concerning 3.1.1.3, The Food safety Modernization Act for handling Human Food just passed and made into law the following shipping temperature’s, will the State accept these new standards into the RFB?

Temperature Range Allowed Deviation Time 10° F to 30° F 2 hours 31° F to 41° F 1 hour >41° F 30 mins If the temperature deviation goes outside the allowed deviation time, the product may be deemed “temperature abused” and the Shipper must be notified immediately. Product shall at all times be maintained at no more than 0° F. degrees not to exceed 10° F.

A8: No, bidder must follow the temperature requirements as outlined in the RFB.

Q9:How do you want to purchase the Quesadilla “Bulk Packed” or “Individually Wrapped” or both ways?
A9:Section 3.1.1.4 indicates “Quesadillas shall be bulk wrapped and shall be CN labeled.”
Q10:3.1.3TRUCK SEAL- easy to specify on truckload quantities, difficult to manage on less than truckload quantities. Will the State accept locked trailers on less than truckload shipments?
A10:No, contractor must follow the truck seal requirements as outlined in the RFB.
Q11:3.1.5.2Finished Product shall be bulk packed in inner bags, with the case net weight a minimum of ten (10) pounds. Bags shall be securely closed. Metal wire ties, metal clips, paper-coated wire ties or staples shall not be used for sealing inner bags. Please clarify how the state would like to receive the Quesadillas “Bulk Packed” or “Individually Wrapped”?
A11:Section 3.1.1.4 indicates “Quesadillas shall be bulk wrapped and shall be CN labeled.” Inner bags in Section 3.1.5.2 means one inner bag/liner within the master case.
Q12:3.1.5.5 (F) Pallet exchange is required with all warehouses. Is this mandatory? Most Common carriers do want to pallet exchange with the warehouses.
A12:Yes.
Q13:3.1.6.3, Each case shall be stamped with the USDA Contract compliance stamp and the certificate number. With no minimum quantities stated in the bid does the State want to incur this non value add to a non -meat item?
A13:Yes.

Q14: Standard Terms and Conditions, 19.0 NONDISCRRMINATION / AFFIRMITIVE ACTION, Section 19.1. “Contracts estimated to be over fifty thousand dollars ($50.000) require the submission of a written affirmative action plan by the contract” Is there a form required to be completed and included with the bid submission, or will a form be required at a later date?

A14: The awarded bidder will be contracted for this information after a contract has been signed.

Q15:6.2 CORRESPONDENCE, CLARIFICATIONS AND QUESTIONS “In the event that it becomes necessary to provide additional clarifying data or information, or to revise any part of this RFB, supplements or revisions shall be posted on VendorNet (http://vendornet.State.wi.us).” When will the latest amendment be posed to VendorNet? I would like to know when I can send out my bid, to ensure it arrives on time, without missing an amendment.
A15:Section 6.1, Calendar of Events provides an estimated date of August 25th.

Q16: Attachment A, Price Sheet, Column A “Bid Price Per Case” Are you looking for the Commercial Price Per Case (Includes USDA Value Per Case) ?, Or are you looking for the Net Price Per Case (Commercial Price – USDA Value Per Case)?

A16: When completing Attachment A, in Column A “Total Processing Bid Price per Case,” bidder shall fill in the “fee-for-service processor” price. The price reported in this column is the bid price to produce one case of end product, factoring in that the bidder would use the bulk USDA Food (cheese) to produce this product. In addition, this price is the per-case price that will be invoiced to Wisconsin Department of Public Instruction for all orders placed and received by the Department.

Q17:Attachment A, Price Sheet, Column C “USDA Value per Case”. The USDA Foods price ($1.6929 per lb.) is the USDA rate for SY17-18, as the NEW USDA rate for SY18-19 will not be released until November 15th. Could you please clarify which price we will need to honor (Net or Commercial)?
A17:For purposes of this bid, bidder shall complete this form using the SY2018 rate. Bidder is required to bid a processing fee based on the Fee-for-Service value pass through method in Column A. Column C will be updated for the contract period of July 1, 2018 to June 30, 2019. The “Total Processing Bid Price per Case” in Column A is the price submitted by bidder and will be the price the contractor will use to invoice the Wisconsin Department of Public Instruction for every case of product ordered. This price will be for the entire 2018-19 school year. Column C “USDA Food Value per Case” is used to determine the bid price per serving, based on processing fee and yield.
Q18:The SPECS do not specify whether or not the State of Wisconsin is looking for a 50/50 or 100% product. What type of additional consideration will be given if both 50/50 and 100% products are bid?
A18:For each product that passes all steps of the “Method of Award,” the final determination for award is Step 4. Step 4 is the submitted bid price based on the fee-for-service processing fee per case plus the USDA food value per case.
