About this file
This document is a Justification and Approval for Other Than Full and Open Competition (J&A) for a contract opportunity to replace the heating, ventilation, and air conditioning (HVAC) and refrigeration Air Cooled Condenser (ACC) systems at the Keesler AFB Commissary in Mississippi.
The scope of work includes replacing the sales area HVAC units and the ACC units for the product refrigeration systems. The government requires brand name or equivalent dual path cooling and dehumidification units, and refrigeration air cooled condenser units. The estimated contract amount is for a 365-day period of performance. The acquisition will be a 100% small business set-aside, with five interested small business sources identified through market research. The J&A cites the statutory authority of 10 U.S.C. 3204(a)(1), as only one responsible source can meet the agency's requirements due to limitations on dimensions and integration with existing systems. The Contracting Officer has determined the anticipated price will be fair and reasonable based on the competitive market.

4. Authority Cited - The statutory authority permitting acquisition of the requirement by other than full and open competition is 10 U.S.C. 3204(a)(1), as implemented by FAR 6.302-1(c), only one responsible source and no other supplies or services will satisfy agency requirements.
5. Reason for Authority Cited -Based on limitations ofthe dimensions and integration to existing systems at the existing commissary, we had to be specific with requirements which resulted with a brand name or equivalent.
6. Efforts to Obtain Competition -. A synopsis will be posted for a minimum of 15 days to the Governmentwide point of entry (GPE) at https://www.sam.gov.
7. Market Research - Market research indicates this requirement can be met by a small business concern and should be set aside as a 100% small business set aside. A search of the SBA Dynamic Small Business Search (DSBS) generated a list of 731 potential sources.
Telephone calls and email communications to some of the potential sources identified five small business concerns interested in and capable ofmeeting the agency's requirements. Each source was verified as active and qualified in the System for Award Management (SAM). All required checks were completed and each source is eligible for award.
8. Actions to Increase/Foster Competition - Proceeding with a brand-name or equal procurement is the most practicable way to foster competition given the constraints established by the current design of the commissary facilities.
