About this file
This is Amendment No. 1 to an Invitation to Bid (ITB #32701-13862) issued by the State of Tennessee Department of Environment and Conservation and the West Tennessee River Basin Authority (WTRBA) for stream maintenance and restoration services at Running Reelfoot Bayou in Gibson County. The amendment clarifies project scope, deliverables, and scheduling through responses to 21 contractor questions and comments submitted during the solicitation period. The ITB was issued April 29, 2026, with a questions and comments deadline of May 6, 2026 at 10:00 a.m. Central Time and an ITB response deadline of May 29, 2026 at 2:00 p.m. Central Time. The project encompasses floodplain bench excavation divided into four phases (downstream south bank, downstream north bank, upstream north/west bank, and upstream south/east bank), with a contract period of 36 months to completion. No pre-bid walk-through is scheduled; however, site visits for exact measurements and familiarization are required prior to bid submission. The amendment confirms that the State may exercise cost negotiations at its sole discretion and clarifies that no payment adjustments will be made for excavation volume variations from plans, though field adjustments may be made to balance the site.
Pricing consists of 17 distinct line items submitted as unit prices through the State of Tennessee EDISON Supplier Portal, with allowances for landowner impact ($450,000), drainage structures ($500,000), third-party services ($500,000), materials ($200,000), and construction contingency ($500,000), for a total expected contract value exceeding $2.65 million. The amendment specifies that all allowance amounts must be entered in the bid document as submitted in the specifications estimate quantity table. Key clarifications address material management, with contractors responsible for obtaining landowner contact information and managing excess excavated material through adjacent use agreements or slope adjustment, and confirm that flapgates are required on all outlet pipes as part of drainage structure material costs. No bid bond is required; however, performance and payment bonds are mandated. Permits have not yet been issued; WTRBA is currently obtaining necessary permits for the project. The contract term extends 36 months with optional renewal periods of up to 12 months each, provided the total term does not exceed 60 months, and pricing must remain firm for 365 days following contract award.

QUESTION / COMMENT STATE RESPONSE
1. With respect to the cut and fill volumes in the revised plans for excavation, once clearing is complete-if the volumes differ from the plans will adjustments be made to the payment of the lump sum item?
No. There may be adjustments in the field to vary the farmable slope to help balance the site but no payment adjustments will be made.
2. Does the contractor have the full 36 months to complete the lump sum excavation item?
Yes. Consideration should be given to the landowner impact allowance that is intended for 1 year of impact and is not intended for repeatable payment on the same parcel when determining the phasing of construction
3. Will this project exercise the best and final offer option?
The State, at it’s sole discretion, may exercise cost negotiations with Respondents.
4. Will a list of the affected/adjoining land owners be provided or contractors responsibility to obtain contact information?
It will be the responsibility of the contractor to obtain this information.
WTRBA has obtained much of this information through preliminary outreach to local producers that can be shared.
5. I see the requirement for a payment and performance There is no requirement for a bid bond included in the terms and conditions.

bond. Is a bid bond required for this project?
6. Is there a timetable on the floodplain portion of this contract?
The contract period of 36 months to completion is the only official timetable.
This is also referenced in question #2.
7. There is an import of material in the upstream right section.
Where will that shortage be located and where will the material come from on-site?
The most significant fill appears to be on the south side near Hwy 78.
Approximately STA 90+00 – 135+00.
The additional material for phase 4 should come from the overruns estimated for the other 3 phases.
Please note that cut/fill estimates are from Lidar and do not have any material shrink/swell factored in the estimate.
8. Can you tell me if there will be a pre-bid walk through for this project?
There is not a pre-bid walk through scheduled for this site.
9. In the Floodplain Bench plans is there a break point which divides the downstream left & right and the upstream left & right?
Please refer to the updated set of plans.
References on sheet C2.0 should be to phase 1-4. Any reference to left or right bank is not the appropriate construction set of plans.
Ph 1 – downstream Hwy 78 south bank
Ph 2 – downstream Hwy 78 north bank
Ph 3 – upstream Hwy 78 North/West bank
Ph 4 – upstream Hwy 78 South/East bank
10. There will be a net cy in dirt excavated, what are we to do with the extra?
This will be the responsibility of the contractor. Adjacent uses negotiated and permitted separately with landowner’s will be acceptable or the 15:1 back slope to the adjacent ag fields may be adjusted to balance the material on site.
11. There are two sets of plans one
Floodplain Bench & the other RRB Mid Bench but they appear to be the same plans.
Plans have been updated on the shared folder for clarification. Please refer to sheet C2.0. The excavated material table should have reference to phase 1
– 4 on the correct plan set. If you see a reference to left and right bank, you need to get the corrected plan set.
12. The Drainage Structure
Allowance states that it will pay for structures delivered and installed on-site. Then states installation of structures will be paid in other line items can you clarify.
The wording was intended to clarify that staged materials will not be paid for.
The structure must be “installed” at the time payment. The drainage structure allowance is solely for material costs.
The act of installing the structures will be paid for by appropriate other line items.
13. The Permanent Warm Season
Grasses allowance will pay contractor for seed & mulch.
Does this also pay for the placement of material?
Yes. The placement of the materials is also compensated under this line item.
14. Have permits been issued for this site?
No. WTRBA is currently working to obtain the necessary permits for this project.

This is also further described in the specifications in section A-14 on page 18.
