This contract, consisting of the signature page and numbered sections listed below and any attachments referenced in this contract, constitute the entire contract between the Parties concerning the subject matter of the contract, and in signing the contract, the Vendor affirms that the Certifications and Financial Disclosures and Conflicts of Interest attached hereto are true and accurate as of the date of the Vendor’s execution of the contract. This contract supersedes all prior proposals, contracts and understandings between the Parties concerning the subject matter of the contract. This contract can be signed in multiple counterparts upon agreement of the Parties.
1. SCOPE OF WORK
1.1. OVERVIEW AND PURPOSE:
1.1.1 The Illinois Department of Agriculture (“Department”) is statutorily required to operate the Illinois State Fair. The Department is seeking a vendor to pour and distribute beer and beverages during the 2026, 2027, and 2028 Illinois State Fair. This contracted solution would oversee operations and maintain a beer concession in at least six different locations throughout the Illinois State Fairgrounds. Beer, beverage, drink, and seltzer are all defined terms in 5.1 of this contract and are used throughout the contract based on those definitions.
1.1.2 The Illinois State Fair welcomes 750,000+ fairgoers to Springfield each year. Attendance to any outdoor event is highly dependent upon the weather.
1.1.3 This contract gives Vendor exclusive pouring rights to dispense beer and beverages in three different beer tents, the Village of Cultures, Reisch Pavillion and The Shed. Department is evaluating a “pilot program” that could shift operations from the Shed to another location on the Fairgrounds as yet to be determined for the 2026 State Fair. The alternate location would be operationally comparable in size and requirements to the identified beer tents, except that Vendor would not be responsible for obtaining a tent.
1.1.4 The number, size and location of the beer sales locations may be changed, increased, or reduced, at the Department's sole discretion. Illinois Department of Agriculture reserves the right to grant Vendor the exclusive or non-exclusive privilege to operate a beer concession in additional locations, with a formal amendment to this contract. This includes any continuation beyond 2026, or change in description of, the “pilot program” noted in 1.1.3.
1.1.5 Vendor must offer water for sale at all sales locations. Vendor may also sell other beverages approved by the Department.
1.1.6 This contract does NOT provide Vendor the right to dispense or sell anything at the Illinois State Fair Grandstand and Multi-Purpose Arena.
1.1.7 The Department retains rights to all non-beverage and non-beer dispensing areas in all sales locations under this contract.
1.1.8 This contract does NOT provide Vendor the right to dispense or sell anything other than drinks. If Vendor is interested in offering for sale non-drink items, sale of those items will be subject to a separate space rental agreement. Vendor must follow the space rental application process and abide by all requirements of said contract and process.
1.1.9 Vendor’s interest or lack thereof in selling or offering for sale non-drink items is not an evaluation factor for this contract bidding process.
1.2. SUPPLIES AND/OR SERVICES REQUIRED: The Vendor agrees to perform services as outlined in this contract, and any other duties that may be assigned, and to adhere to all work rules, and unless otherwise agreed, provide all tools, equipment, commodities and other property, tangible or intangible, necessary to provide said services. Books and records required to be maintained under this section shall be available for review or audit by representatives of the procuring Agency, the Auditor General, the Executive Inspector General, the Chief Procurement Officer, State of Illinois internal auditors or other governmental entities with monitoring authority, upon reasonable notice and during normal business hours. Vendor and its subcontractors shall cooperate fully with any such audit and with any investigation conducted by any of these entities. The Vendor or subcontractors shall not impose a charge for audit or examination of the Vendor’s or subcontractor’s books and records. 30 ILCS 500/20-65.
