About this file

This document is a Living Wage Submittal attachment for the City of Austin, Texas, establishing wage requirements for a service contract identified as IFB 5000 MAS1005. The submission outlines the City of Austin's Living Wage Program requirements under Rule R161-17.14, which mandates that all contractor employees and subcontractor personnel directly assigned to the city contract must be compensated at a minimum living wage of $22.05 per hour. Contractors must provide certification with their offers that all assigned personnel will meet or exceed this wage threshold, and they must submit a comprehensive list of all employees and subcontractors assigned to the contract, including names and job titles. This list must be updated throughout the contract term as necessary. The City may stipulate higher wage rates in certain solicitations to ensure service quality and continuity.

Contractors are required to maintain employment and wage records in compliance with the Fair Labor Standards Act and submit individual employee certifications within 30 days of contract execution, with annual recertification on the contract anniversary date. The City reserves the right to request employee certifications at any time and will periodically review submitted employee data to verify compliance. Violations of the living wage provision—including willful or repeated breaches or fraudulent certification statements—may result in contract termination for cause, suspension or debarment of the violating firm, or legal action. Additionally, contractors are prohibited from retaliating against employees who report non-compliance, and any violation may result in daily deficiency payments to affected employees.
