The apparent low bidder must submit the completed form by 4:00 p.m. local time on the fifth full business day after bid opening and notification as the apparent low bidder. The form requires contractors to certify their responsibility status under Arizona Revised Statutes Title 34, which mandates contracting with the lowest responsible bidder. Contractors must demonstrate adequate financial resources, ability to meet schedules, satisfactory performance records, demonstrated integrity and ethics, adequate experience and technical expertise, and access to necessary equipment. The certification requires disclosure of any debarment or suspension; criminal convictions or civil judgments within the preceding three years related to fraud, antitrust violations, or crimes such as embezzlement or bribery; liquidated damages paid, terminations for poor performance, claims for improper work, payment failures, or successful bond claims within the last three years; current Experience Modification ratings; three representative completed projects with owner references and detailed scope information; current workload and resource availability; and any anticipated legal action or bankruptcy proceedings. The City reserves the right to contact provided references and request additional documentation. Failure to provide sufficient information may result in a finding of non-responsibility and contract termination if any certification is determined to be knowingly erroneous.
