West Side Bicycle Boulevards Project - Special Provisions Summary
This document comprises the Special Provisions for the West Side Bicycle Boulevards project, a City of Tucson Department of Transportation roadway improvement contract (Plan No. I-2024-018) designed to develop protected bicycle facilities across four separate boulevard segments. The project encompasses the Golden Hills Bicycle Boulevard (Greasewood Road to Riverview Boulevard, 1.9 miles), El Rio-Dragoon Bicycle Boulevard (Dragoon Avenue to Speedway Boulevard, 1.4 miles), Menlo Park Bicycle Boulevard (Speedway Boulevard to Bonita Avenue, 2.0 miles), and Ontario-Mecedora Bicycle Boulevard (Cholla Boulevard to Diamond Street Loop, 1.7 miles). Improvements include traffic calming features (speed humps and cushions, traffic circles), BikeHAWK signals at six intersections, thermoplastic and preformed pavement markings, signage, concrete curbs, sidewalks, curb access ramps, drainage modifications, utilities coordination, and extensive landscaping with a 24-month establishment period. The contractor is required to complete the construction phase within 150 calendar days of the Notice to Proceed, with landscape establishment comprising an additional 12-month period (365 consecutive calendar days). Critical project milestones restrict construction activities during the Gem and Mineral Show (late January to mid-February), Pima County Fair (late April), and designated seasonal utility windows, with no arterial or collector street restrictions permitted during peak traffic hours (7-9 a.m. and 4-6 p.m., Monday-Friday). The contractor must submit detailed traffic control plans at least five working days prior to construction commencement and provide weekly updated schedules documenting two-week look-ahead activities.
The contract requires the contractor to assume full responsibility for mobilization, demobilization, quality control testing, traffic control, utility coordination, environmental compliance (including stormwater management and erosion control), and maintenance of public access throughout construction. Liquidated damages apply if substantial completion is not achieved within the contract period, with retention of 10 percent of all non-landscape establishment items (minimum $2,000) through the 12-month landscape establishment phase. The contractor must obtain all applicable permits (air quality, water quality, excavation, storm water) at its own cost and coordinate extensively with utility providers including Tucson Water, Pima County Regional Wastewater Reclamation Department, Southwest Gas, Tucson Electric Power, and telecommunications providers. Special provisions mandate weekly quality control reports, certified payrolls, and contractor-provided testing by ADOT-approved laboratories; delinquent reports result in $2,500 monthly deductions from progress payments. The contractor bears all costs for construction water (from metered sources only), debris disposal, temporary erosion control, dust suppression, dewatering permits, survey monument preservation or replacement, and landscape establishment including hand watering, weed control, graffiti removal, and plant replacement. No separate compensation is provided for numerous incidental items including flagging coordination, temporary fencing, minor alterations under $10,000 (paid through ITEM 9300111), or various traffic control elements beyond predetermined rates detailed in Section 701.

SP-9 of 124
GENERAL PROVISIONS
For the purpose of these Special Provisions, the terms Agency, Department, City, City of Tucson, and Engineer are synonymous.
1. Project Objectives
The objective of this contract is to complete construction as quickly as possible while minimizing the impact to the Stakeholders. The Stakeholders are, but not limited to, the adjacent businesses, commuters, buses, emergency services, pedestrians, bicyclists, and adjoining neighborhoods. As such, this work will be accomplished in an orderly manner as defined herein.
Driver and pedestrian/access shall be maintained during the construction of improvements.
Temporary paved access shall be provided at all times to meet the Americans with Disabilities Act
(ADA) requirements. The contractor is advised that an approved construction sequencing scheme meeting the intent of the project objectives will need to be followed. The contractor shall propose a construction phasing plan for the Engineer’s approval prior to beginning work. Once approved, the contractor shall follow the phasing plan unless modified by the Engineer in writing.
2. Project Limits and Restrictions
The contractor shall perform all work within the public right-of-way, legally obtained easements including temporary construction easements (TCEs), legally obtained rights-of-entry (ROE), and legally acquired property by the City of Tucson. The contractor shall assume all responsibility and liability for any encroachment upon private property. The use of private property for construction yards will be allowed only if zoning requirements allows its use for this purpose. See Section 106-
9 of the Standard Specifications for further details regarding temporary construction yards. The cost of the construction yard is considered incidental to the project. Under no circumstances shall any equipment, vehicles or other construction items that are not specifically required or needed for the immediate construction at hand be stored or left on private property without the express written permission of the property owner.
The contractor shall field verify all existing conditions shown on plans and specified herein prior to beginning construction. Any significant deviations to the conditions that may affect the timely construction of improvements shall be brought to the attention of the Engineer within 24 hours of discovery. Prior to delivery of any equipment, materials or supplies to the site of any work, or the beginning of any construction work, it is strongly recommended that the contractor take pre-construction photos or videos as deemed appropriate for establishing the conditions existing in all the areas that may be affected by the construction.
A. Construction Scheduling
SP-10 of 124
Various activities within the community must be considered in the project scheduling to provide the most effective and least impacting effort. The following dates are provided for information and shall be referred to when planning work and lane restrictions:
Christmas Retail Season .......................................................... Thanksgiving Day to Jan 1st
Gem and Mineral Show ....................................................................... Late Jan to Mid Feb.
Pima County Fair .................................................................................................. Late April
Tucson Water Department Restrictions ............................................... April 1st to Sept. 30th
SWG Construction Restrictions .................................................... October 1st to March 30th
TEP Construction Restrictions ........................................................... May 1st to August 30th
School Session ................................................................................... Late July to Late May
The contractor shall factor these events into his construction schedule. The contractor may do incidental work during these restrictions to complete areas that are not specifically described herein if no additional impacts to commuters, businesses, and residents are imposed and the work is previously approved by the Engineer.
Due to the nature and location of this project, it will be necessary to provide accurate information regarding construction activities on a consistent and regular basis. Business owners, nearby residents and commuters traveling through the area will rely upon accurate construction activity information to maintain their daily business. Since construction activities have such a significant impact upon these operations, the following requirement is set forth:
- The contractor shall provide the Engineer with a written, detailed work schedule at each weekly construction meeting.
- Minutes to the meeting shall be taken by the contractor.
- A copy of each week’s minutes shall be provided to the Engineer and affected individuals attending each meeting.
- The schedule shall document the anticipated construction activities for the upcoming, two-week look ahead period.
It is also important that construction activities should be coordinated with the U.S. Post Office
(access for mail delivery services), the City of Tucson Environmental Services Department (access for trash pickup services), and Fire Department and Police Department (access for emergency services). There will be no separate measurement and payment to the contractor in assisting these agencies with the service they provide to the affected parcels along all streets, as shown on the plans, during construction. Such cost will be included in the overall cost of the project.
Access into and out of residential driveways shall always be maintained during construction. If these conditions cannot be met due to actual work occurring at the driveway, the contractor shall provide a means of pedestrian ingress and egress at no cost to the City; driveway closure shall not exceed thirty-six (36) hours at any one time. The contractor is required to give notice to the affected parcel regarding the status of the driveway prior to the work commencing and provide a written schedule as to when the work is scheduled to be completed.
SP-11 of 124
Work requiring lane restrictions beyond the minimum stated herein shall be done at night unless approved by the Engineer.
The intent of this project is to complete the work as quickly as possible to minimize any inconvenience to the traveling public, or adjacent stakeholders. To that end, the contractor is strongly encouraged to consider working weekends, double shifts, or as often as necessary to complete the work by the specific milestones. Lost time due to little or no work being performed shall not be considered when applying for a contract time extension.
B. Construction Sequencing
The contractor shall account for construction sequencing and work hour restrictions when scheduling and prosecuting the work as described in Subsection 108-4 of these Special Provisions.
All decisions regarding construction sequencing and work hour restrictions shall be made upon meeting the project objectives. Any alternate construction sequencing plan proposed by the contractor must meet the requirements specified in the notes of the construction sequencing sheets of the project plans, the PAG Standard Specifications for Public Improvements (latest edition), and these Special Provisions.
The contractor’s attention is drawn to the construction sequencing sheets included in the project plans and Subsection 108-4 of these Special Provisions. The sequencing plan depicted is intended to provide just one approach to constructing the major features of the project. Upon consideration and approval by the City of Tucson Department of Transportation & Mobility (DTM), the contractor is free to propose and follow his/her own sequencing approach of the roadway, drainage and construction features execution timeline. Alternative sequencing options will be considered based on approval by the Engineer.
3. Contract Time
Once the contract has been awarded and signed, the contractor shall be issued a Notice to Proceed
(NTP). This will begin Phase 1 of the project, the construction phase, and the contractor shall have
150 calendar days to complete this work as shown on the project plans and specified herein.
Phase 2 of the contract shall encompass the 12-month (365 consecutive calendar days) Landscape
Establishment period as detailed in Section 807 of the PAG Standard Specifications. All other items of work shall be completed and accepted (via acceptance of the roadway and/or drainage phase of the work) by the Engineering Representative prior to the commencement of Phase 2. The contractor shall obtain the acceptance of the previous phase(s) following a Final Inspection of that phase. If the Final Inspection should reveal work that is not completed or is unacceptable to the
Engineer for any reason, a "punch list" of these items shall be generated and provided to the contractor. Substantial completion (for the purpose of stopping the contract time) will be granted in accordance with Section 105-21 of the Standard Specifications. Once substantial completion is granted, the contractor shall actively work to achieve final acceptance of the construction phase of the contract within 15-calendar days from the substantial completion date of that phase. Failure to prosecute the remaining work within this time period will result in the resumption of time
SP-12 of 124 charges and the application of liquidated damages from the date scheduled for final acceptance.
When the work on this list has been satisfactorily completed, final acceptance of the phase(s) shall be given for all items of work other than Landscape Establishment. At this time the Landscape
Establishment period shall begin, and the monies retained for all items of work other than
Landscape Establishment (ITEM 8070001) shall be released. Through the duration of the
Landscape Establishment period, the Agency shall retain 10% of the cost of the aforementioned items of work or a minimum of $2,000.00, whichever is greater. (The amount retained for ITEM
8070001 shall not exceed 5% of the total contract bid amount). Upon completion of the Landscape
Establishment period, a final inspection will be held with Engineering and Streets Division staff to ensure that all plants are healthy and acceptable.
4. Maintenance & Protection of Traffic
The contractor shall be responsible for all construction zone traffic control and shall provide a traffic control plan in accordance with Section 701 of the Standard Specifications and these Special
Provisions and shall be approved by the Engineer prior to construction.
The traffic control plans shall meet the conditions and requirements described in Subsection 104-
5 of these Special Provisions.
The contractor shall not allow any work to commence unless the conditions and requirements of Subsection 104-5 Maintenance of Traffic are adhered to. If the contractor fails to abide by the conditions and requirements of this specification section, it shall be considered sufficient grounds for the City to suspend the contractor’s work.
5. Permits
Before undertaking any of this contract work at any location covered by this project, the contractor shall obtain all applicable business licenses and permits, including but not limited to: water quality permits, air quality permits, traffic control and street closure permits, excavation/construction in the public rights-of-way permits, storm water pollution prevention plan, and any other permits required by ordinance and/or state and federal law.
The contractor shall be pay for all necessary fees, taxes and other costs associated with obtaining and securing all permits, including plan review. The costs associated with obtaining permits shall be considered incidental and inclusive with the associated items of work. No additional compensation will be provided.
Excavation permits for excavation/construction in the public rights-of-way will not be required when the work is administered by the Agency.
No separate payment shall be made for preparation of the traffic control plans, and the costs shall be included in the overall cost of the project. The overall cost shall also include applicable plan review and permit fees.
SP-13 of 124
Prior to any ground disturbing activity, the contractor shall obtain an Activity Permit from the
Pima County Department of Environmental Quality. The contractor shall implement the standard specifications for dust suppression.
The contractor will be required to relocate certain water distribution facilities owned by Tucson
Water and modify certain sanitary sewer system facilities owned by Pima County Regional
Wastewater Reclamation Department (PCRWRD) as shown on the plans and hereinafter specified. The contractor shall obtain all construction permits required for this work. During construction operations, all contact between the contractor and Tucson Water or PCRWRD personnel will be through the Engineer. The contractor shall give all notices to the Engineer two
(2) working days in advance of the notice periods required by Tucson Water and PCRWRD.
6. Storm Water/Ground Water Management
It shall be the responsibility of the contractor to allow for any subsurface groundwater and storm water runoff during the time of project construction. The contractor shall not divert or impound water in such a manner as to flood adjacent homes, facilities, or roadways. No additional compensation shall be provided for dewatering or diversion structures required for constructing or protecting the work, the cost being considered incidental to the project.
Dewatering may be done by the contractor by permit only. No measurement or direct payment will be made for dewatering groundwater or channelizing surface water required during the course of construction, including all permits. A contractor’s licensed well driller is required for conducting any dewatering operation, and all costs for dewatering shall be considered incidental to the contract unit cost of the bid items requiring dewatering. The contractor shall apply to the Arizona
Department of Water Resources for the Dewatering Permit in a timely manner. The contractor shall note that up to approximately 90 days may be required for the approval of the Dewatering
Permit.
The contractor’s attention is also directed to Section 810 of these Special Provisions and the
Stormwater Pollution Prevention Plan for the project regarding the requirements for temporary and permanent erosion control.
7. Construction Survey and Layout
Construction survey and layout will be provided by the City of Tucson.
8. Existing Vegetation
Clearing limits must be approved in advance by the Engineer. Grading and construction near and around vegetation that is to be preserved-in-place may be required. The Engineer may require that specific vegetation remain within the construction limits in addition to what is shown in the project plans. The contractor and the Engineer shall tour the project site prior to any construction beginning and together verify what specific vegetation shall be preserved in place.
SP-14 of 124
The contractor shall prune existing trees to remain in place and provide fencing as described in
Sections 201 and 806 of these Special Provisions or as directed by the City Landscape Architect.
Existing project vegetation on this project shall not be disturbed by the contractor beyond those limits actually needed for the contractor’s construction purposes. Those items unnecessarily damaged by the contractor shall be repaired or replaced at the contractor’s expense.
9. Disposal of Materials
All construction debris, rubble, excess, surplus and unsuitable materials structures and obstructions, except as hereafter specified, shall be removed from the job site and disposed of by the contractor at a site previously secured by the contractor, and done in a manner approved by the
Engineer.
Disposal shall be the responsibility of the contractor. However, the contractor shall, with each and every disposal site arranged for (other than commercial waste sites), provide the Engineer with a copy of the written approval of the property owner indicating that the property owner is fully aware of what the material consists. The contractor shall also provide a letter to the Engineer from the
City or County (whichever has jurisdiction), giving site approval for materials disposal at each site to be used. The approval letter shall be received and approved by the Engineer prior to the disposal of any materials at any site.
Costs associated with the disposal of these materials shall be incidental to the related items of work. Fees associated with the disposal of these materials shall be paid by the contractor.
All material removals shall be transported and legally disposed of from the project site the same day they are removed. Stockpiling of removed materials within the public rights-of-way shall not be allowed unless previously approved and directed by the Engineer. The location of the disposal site shall be the responsibility of the contractor and the contractor shall identify in writing the quantity of materials removed and disposed of to that location.
Upon removal, existing material, including existing guardrail, anchors, breakaway cable terminals, posts, and hardware, shall become the property of the contractor unless otherwise specified in the project plans, or in these Special Provisions, or by the Engineer.
Upon removal, disposal of the existing asphaltic concrete shall be the responsibility of the contractor. When approved by the Engineer, the contractor may stockpile and use it as recycled asphaltic concrete or dispose of it at an approved site. No measurement or direct payment will be made for disposal. The cost of disposing the removed AC pavement shall be incidental and considered as included in the cost of contract items.
If in good condition as determined and approved by the Engineer, removal of existing fence and gate material along the project limits may be salvaged and used for reconstruction of fence and gates at necessary locations.
SP-15 of 124
10. Contract Administration
Prior to submittal of contract administration documents, examples of which are listed below, the contractor shall review all documentation for accuracy and compliance with the contract. Any variance from the plans and specifications shall be clearly noted and is subject to approval by the
Engineer. A contractor’s transmittal letter shall accompany all submittals and shall include certification as to accuracy and compliance with the plans and specifications.
Contract administration submittals shall include, but are not limited to, the following examples:
escrow agreements; subcontracts; purchase orders; certified payrolls for contractor and subcontractors; force account billings; equal employment opportunity reports for contractor and subcontractors; trainee preconstruction information; proof of apprenticeship; weekly individual training reports; rental equipment invoices; material invoices showing all unit prices; pay estimates; affidavit of certification of payments to small business enterprise firms; requested lien releases; and consent from surety.

104.08 (2008 Edition), and the City of Tucson Code 16-31(b)(5) which prohibits construction noise between the hours of 8:00 p.m. through sunrise, Mondays through Saturdays, and at any time on Sundays and legal holidays.
12. Shoring and Bracing
All contractor construction shall be conducted in conformance with the details shown on the project plans and these Special Provisions, with appropriate soil stabilization and bracing measures as previously approved by the Engineer. No measurement or direct payment will be made for
SP-16 of 124 shoring and/or bracing, unless shown as a line item(s) in the bidding schedule. Contractor shoring and/or bracing is considered incidental to the cost of the other bid items.
Appropriate soil stabilization and bracing measures as previously approved by the Engineer for the protection of utilities and private facilities shall be implemented by the contractor. No measurement or direct payment will be made for contractor soil stabilization and bracing measures, it will be considered incidental to the cost of the project.
13. Archeological Features
If human remains, including human skeletal remains, cremations, and/or ceremonial objects and funerary objects are found during excavation or any activity related to construction in any part of the project area, ground disturbing activities must cease in the immediate vicinity of the discovery.

All efforts have been made to avoid utility conflicts and assure as much of the utility work as possible was completed prior to the start of this project. If any relocation work is necessary due to additional conflicts, the utility companies will perform the relocation work during the project construction phases unless otherwise noted on the project plans. The contractor is hereby notified that the utility companies, in conjunction with the contract work, will perform their own utility relocation work. The contractor shall make every effort to cooperate fully with each utility company and acknowledges and agrees that delays to his operations may necessarily occur. Due to these delays that are anticipated by the utility companies, the Engineer will consider requests by the contractor for contract time extensions if necessary. The
SP-18 of 124 contractor will also acknowledge and agree that no monetary compensation will be given to the contractor by the Agency as a result of the impacts on the construction operations that are caused by the utility companies due to their anticipated work or delay. Utility locations shown on the plans are approximate, and all utilities located within the project limits may not necessarily be shown. The absence of a utility from the plans does not necessarily indicate that it is not present.
The possibility of conflicts with existing utilities-in-service always exists. If conflicting utilities interfere with the normal progress of the contractor towards completion of this project, the
Engineer may, with the prior written approval of the owner of the utility to be relocated, authorize the contractor to relocate said conflicting utilities by Force Account (see Section 515 of these
Special Provisions).
The contractor shall take full responsibility of costs incurred due to damage to utilities as a result of construction, grading or excavation operations. If any utilities are damaged, the contractor shall repair or replace the damaged utility at his sole expense.
